The Board of Zoning Adjustment for the City of Grapevine, Texas, met in regular
session, Monday evening, July 10, 2000, at 6:00 P.M., in the Council Chambers,
200 South Main Street, Grapevine, Texas with the following members present:

CALL TO ORDER
Chairman Carl Hecht called the meeting to order at 6:00 P.M.
NEW BUSINESS
BOARD OF ZONING ADJUSTMENT CASE BZA00-11 RUBEN C. DELEON
314 E. COLLEGE STREET
The first item that the Board of Zoning Adjustment considered was BZA00-11,
submitted by Ruben C. DeLeon, for property located at 314 E. College Street,
platted as Lot 5, Block 2, City of Grapevine. The following request was from
Grapevine Comprehensive Zoning Ordinance 82-73:
Section 43.E.3 Nonconforming Uses and Structures which allows the Board of
Zoning Adjustment to approve the remodeling or enlargement of a
nonconforming use.
The applicant requested a special exception to allow the remodeling and
enlargement of a residence on property that does not meet minimum lot width
requirements, and with structures that do not meet current minimum setbacks.

Mr. Williams explained that Staff found that there were special conditions,
specifically the structures exist and the addition does not affect violations in any
manner. Mr. Williams explained that Mr. DeLeon plans a small addition, which
would fill in the "empty" corner of his house. He said the addition would not
project beyond the existing boundaries of the home and would not affect the
current noncompliance in any way.
Chairman Hecht announced that one letter of approval was received.
With no one to speak either for or against the case, Ron Cook made a motion to
close the public hearing. Ery Meyer seconded the motion which prevailed by the
following vote:
Ayes: Hecht, Meyer, Luers, Cook, Bruner, Kelso
Nays: None
Absent: Anderson
After further discussion, Dennis Luers made a motion that there was a special
condition, specifically the structures exist and the addition would not increase
encroachments in any way according to the plot plan. Ery Meyer seconded the
motion which prevailed by the following vote:
Ayes: Hecht, Meyer, Luers, Cook, Bruner, Kelso
Nays: None
Absent: Anderson
Dennis Luers made a motion to approve the special exception to Section 43.E.3.,
allowing the remodeling and enlargement of a residence on property that does
not meet minimum lot width requirements, and with structures that do not meet
current minimum setbacks according to the plot plan. Jim Kelso seconded the
motion which prevailed by the following vote:

BOARD OF ZONING ADJUSTMENT CASE BZA00-12 JAROD MARCUS
4202 VALLEYWOOD DRIVE
Next the Board of Zoning Adjustment considered BZA00-11, submitted by Ruben
C. DeLeon for property located at 4202 Valleywood Drive and platted as Lot 19,
Block 2, The Meadows. The following request was from Grapevine
Comprehensive Zoning Ordinance 82-73:
Section 15.G.1., R-7.5, Single Family District Regulations, Area Regulations,
which requires a front yard setback of 30 -feet.

The applicant requested a variance of 1 -foot and if approved would allow a front
yard setback of 29 -feet.
Mr. Stombaugh explained that Staff found there was a special condition,
specifically it was an existing structure.
With no one to speak either for or against the request, Dennis Luers made a
motion to close the public hearing. Kip Bruner seconded the motion which
prevailed by the following vote:
Ayes: Hecht, Meyer, Luers, Cook, Bruner, Kelso
Nays: None
Absent: Anderson
Mr. Williams explained that when the house was constructed in 1991, a true form
survey was not required for single family structures. He explained that a string -
line method was used to ensure the structure met the required setbacks which
had some inherent inaccuracies compared to today's standards.
Ery Meyer then made a motion that there was a special condition, specifically the
structure exists. Kip Bruner seconded the motion which prevailed by the
following vote:
Ayes: Hecht, Meyer, Luers, Cook, Bruner, Kelso
Nays: None
Absent: Anderson
Ery Meyer then made a motion to approve the variance request to Section
15.G.1., allowing a front yard setback of 29 -feet as shown on the plot plan. Kip
Bruner seconded the motion which prevailed by the following vote:
Ayes: Hecht, Meyer, Luers, Cook, Bruner, Kelso
Nays: None
Absent: Anderson

The next item of new business was for the Board of Zoning Adjustment to
consider BZA00-13, submitted by Sandra L. Farquhar for property located at
1822 Evergreen Court, platted as Lots 9R1 and 9R2, Block 5, Ridgecrest
Addition. The following request was from Grapevine Comprehensive Zoning
Ordinance 82-73:

After some discussion on whether or not there was a hardship, Jim Kelso made a

Section 20.G.1, "R-TH" Townhouse District Regulations which requires a front
yard setback of 25 -feet.
Section 17.D.2, "R-3.5" Two Family District Regulations, Limitation of Uses,
allows a duplex structure to be converted to separate ownership which will be
considered a townhouse unit subject to all the requirements and regulations of
the "R-TH" Townhouse District. The applicant requested a variance of 7 -feet for
both Lots 9R1 and 9R2 and if approved would allow a front yard setback of 18 -
feet at the narrowest portion for Lots 9R1 and 9R2.
Mr. Stombaugh explained that Staff found that there was a special condition,
specifically the duplex which the applicant proposed to convert to townhomes,
was existing. Mr. Stombaugh explained that as a duplex under the provisions of
the "R-3.5" Two Family District Regulations, the structure conformed, however,
conversion of the structure to townhomes required platting a property line
between the dwelling units. He explained that a revised front building line was
required and that the reconfiguration of the front yard setback created the
encroachment of the existing structure.
Chairman Hecht noted that one letter of approval had been received based on a
firewall being constructed separating the two townhouses. He announced that
three other letters of approval and one letter that did not state approval or
disapproval had also been received.
Mr. Williams explained that a fire -rated wall on each side of the property line was
required by the Building Code to completely separate the two dwelling units. He
explained that Ms. Farquhar was fully aware of having to add a firewall through
the attic.
Mr. Hecht asked about the requirement for the garage area.
Mr. Williams explained that based on observation the current firewall separated
the dwelling units completely, except for the attic, and that the original plans
indicated this as well.
Ms. Sandra Farquhar, applicant, of 313 Sheffield Drive, Southlake, 76092, took
the Oath of Truth and explained that according to the Lancaster's, who built the
structure, the walls were built to code, but knew that the attic area needed the
addition of a firewall.
Mr. Williams assured the Board that before the property could be replatted, Ms.
Farquhar would have to have a final inspection on the structure.
With no one else to speak for or against the request, Ron Cook made a motion to
close the public hearing. Dennis Luers seconded the motion which prevailed by
the following vote:

Kip Bruner then made a motion to accept the applicant's letter dated June 30,
2000, requesting the withdrawal of BZA00-14. Ery Meyer seconded the motion
which prevailed by the following vote:
Ayes: Hecht, Meyer, Luers, Cook, Bruner, Kelso
Nays: None

Next the Board of Zoning Adjustment considered the minutes of the June 5,
2000, meeting.
Kip Bruner made a motion to approve the minutes of the June 5, 2000, meeting.
