ACCORDANCEIN GOVERNMENT•rCHAPTER 10 ACTS OF THE 1993 TEXAS LEGISLATURE, THE BOARD OF ZONING ADJUSTMENT MEETING AGENDA , PREPARED . . 1r r POSTED •,, • r DAY OF 2000 , 5:00 TT WILLIAMS DING OFFICIAL/ASSISTANT DIRECTOR STATE OF TEXAS COUNTY OF TARRANT CITY OF GRAPEVINE The Board of Zoning Adjustment for the City of Grapevine, Texas, met in regular session, Monday evening, October 2, 2000, at 6:00 P.M., in the Council Chambers, 200 South Main Street, Grapevine, Texas with the following members present: Carl Hecht Dennis Luers Ron Cook Kip Bruner Jim Kelso Debbie Holt Carl Tomerlin Chairman Vice -Chairman Secretary Member Member 1 st Alternate 2"d Alternate constituting a quorum. Also present was the following City Staff: Scott Williams Building Official Ron Stombaugh Planner II Gerrie Anderson Development Services Assistant CALL TO ORDER Chairman Carl Hecht called the meeting to order at approximately 6:06 P.M. NEW BUSINESS BOARD OF ZONING ADJUSTMENT CASE BZA00-23 BETH PACE TIGGELAAR 516 POST OAK ROAD The first item for the Board of Zoning Adjustment to consider was BZA00-23, submitted by Beth Pace Tiggelaar, for property located at 516 Post Oak Road, platted as Lot 21, Block 8, Glade Crossing 1 B. The following request was from Grapevine Comprehensive Zoning Ordinance 82-73: Section 15.G.2., Single Family District Regulations, which requires a 25 foot rear yard setback. The applicant requested a three foot variance, and if approved would result in a 22 foot rear yard setback for a proposed addition to the existing house. Board of Zoning Adjustment 10/02/2000 Mr. Stombaugh explained that Staff found no special conditions. He explained that the applicant proposed a 16.5' by 24' addition to the home that would encroach approximately three feet into the rear yard setback. He explained that there were no existing physical conditions that would justify encroachment into the rear setback. Beth Tiggelaar of 516 Post Oak Road and applicant, took the Oath of Truth. She explained that an addition to the back of the house was needed for their family. She explained that the neighbors had no problem with the addition. Ms. Tiggelaar also explained that she felt there was a special condition because the proposed addition would line up with other existing improvements in the neighborhood. With no one else to speak either for or against the motion to close the public hearing. Ron Cook prevailed by the following vote: Ayes: Hecht, Luers, Cook, Bruner, Kelso Nays: None Absent: None request, Kip Bruner made a seconded the motion which Chairman Hecht announced that 11 letters of approval had been received. Chairman Hecht felt that the proposed extension would not extend any further than other additions in the neighborhood. There was discussion among the board members whether or not there was a special condition. Mr. Cook asked the applicant if she would consider an 18' room addition which would conform to the requirements. Ms. Tiggelaar explained that she would have to consider if that would be feasible. With no further discussion, Ron Cook made a motion that there was no special condition. Kip Bruner seconded the motion which prevailed by the following vote: Ayes: Luers, Cook, Bruner, Kelso Nays: Hecht Absent: None GROULX, 2911PENINSULA DRIVE Next the Board of Zoning Adjustment considered BZA00-24, submitted by Daniel and Elisabeth Groulx for property located at 2911 Peninsula Drive, platted as Lot 2 Board of Zoning Adjustment 10/02/2000 31 R, Block 4, City of Grapevine. The following requests were from Grapevine Comprehensive Zoning Ordinance 82-73: Section 15.G.3., Single Family District Regulations, Area Regulations, requires a six foot side yard setback. The applicant requested a one foot variance and if approved would result in a five foot side yard (at the narrowest point). Section 42.C.3., Supplementary District Regulations requires detached accessory buildings to be located on the rear one-half of the lot. The applicant requested to allow an addition to an existing garage located in the front one-half of the lot. Mr. Williams explained that Staff found special conditions for Section 15.G.3., due to existing mature trees and the location of the floodplain in the rear. He explained that there was no other area on the lot for the addition. He explained that there was a hardship for Section 42.C.3., as the garage was existing. With no one else to speak either for or against the request, Dennis Luers made a motion to close the public hearing. Kip Bruner seconded the motion which prevailed by the following vote: Ayes: Hecht, Luers, Cook, Bruner, Kelso Nays: None Absent: None Chairman Carl Hecht announced that four letters of approval had been received. Mr. Luers explained that he was familiar with the lot and that it would be hard to build on due to the topography and property being narrow. Dennis Luers made a motion that there were special conditions, specifically the lot was unbuildable in the flood plain area and the garage was existing. Kip Bruner seconded the motion which prevailed by the following vote: Ayes: Hecht, Luers, Cook, Bruner, Kelso Nays: None Absent: None Dennis Luers then made a motion to grant the variances to Section 15.G.3., allowing a five foot side yard (at the narrowest point), and to Section 42.C.3., allowing an addition to an existing garage located in the front one-half of the lot. Kip Bruner seconded the motion which prevailed by the following vote: 3 Ayes: Nays: Absent: MINUTES Hecht, Luers, Cook, Bruner, Kelso None None Board of Zoning Adjustment 10/02/2000 Next the Board of Zoning Adjustment considered the minutes of the September 11, 2000, meeting. Kip Bruner made a motion to approve the minutes, as amended, of the September 11, 2000, meeting. Dennis Luers seconded the motion which prevailed by the following vote: Ayes: Hecht, Luers, Cook, Bruner, Kelso Nays: None Absent: None STAFF REPORTS Mr. Williams announced that the permit for Best Buy had been issued and that City Council approved the Conditional Use for a 130,000 square foot Corvette Museum to be located on William D. Tate Avenue. Mr. Stombaugh explained that the City Council approved the Option B parking plan for 627 Church Street. There was discussion regarding the progress of the First United Methodist Church's proposed construction. ADJOURNMENT Dennis Luers made a motion to adjourn.
