Also present were City Council Representative Roy Stewart and the following City Staff: Ron Stombaugh Planner II Gerrie Anderson Development Services Assistant Chairman Carl Hecht called the meeting to order at approximately 6:05 P.M. NEW BUSINESS BOARD OF ZONING ADJUSTMENT CASE BZA00-25. FRANK MCCORD. 1014 PINE STREET The first item for the Board of Zoning Adjustment to consider was BZA00-25, submitted by Frank McCord, for property located at 1014 Pine Street, platted as Lot 2, Block 1, J. J. Daniel Addition. The following requests were from Grapevine Comprehensive Zoning Ordinance 82-73: Section 15.G.1., R-7.5, Single Family District Regulations which requires a 30 foot front yard setback. The applicant requested a one foot variance and if approved would allow an addition to be placed on an existing residence with a 29 foot front yard setback. Sections 42.C.3. / 15.G.3., Accessory Building Regulations / R-7.5 Single Family District Regulations which requires detached accessory buildings to meet the same side yard setback as required for the main structure which is six feet. Board of Zoning Adjustment 12/04/2000 The applicant requested a six foot variance to allow an existing accessory building to remain as built on the property line. Section 58.B., Parking, Loading and Outside Storage Area Development Standards requires all off-street parking and drives to be paved with concrete or asphalt. The applicant requested to allow an existing gravel drive to remain. Mr. Stombaugh explained that Staff found special conditions, specifically the property was currently developed, and had existed since well before the current zoning ordinance. He explained that the variances were required because Mr. McCord wished to place an addition on the home and that the addition would comply with all current codes and ordinances. With no one else to speak regarding the case, Jim Kelso made a motion to close the public hearing. Kip Bruner seconded the motion which prevailed by the following vote: Ayes: Hecht, Bruner, Kelso, Holt, Tomerlin Nays: None Absent: Luers, Cook Kim Kelso then made a motion that there were special conditions, specifically the property was currently developed, and had existed since well before the current zoning ordinance. Kip Bruner seconded the motion which prevailed by the following vote: Ayes: Hecht, Bruner, Kelso, Holt, Tomerlin Nays: None Absent: Luers, Cook 4 Board of Zoning Adjustment 12/04/2000 BOARD OF ZONING ADJUSTMENT CASE BZA00-26 MRS. HERMAN CHIVERS / MORLEY ARCHITECTS 318 TURNER ROAD Next the Board of Zoning Adjustment considered BZA00-26, submitted by Mrs. Herman Chivers and Morley Architects for property located at 318 Turner Road, legally described as Tract 30R1, Abstract 946, City of Grapevine. The following request was from Grapevine Comprehensive Zoning Ordinance 82 -73 - Section 43.G.1 Nonconforming Uses and Structures requires that in the event of damage or destruction of a nonconforming use to the extent of 60 -percent of the replacement cost on the date of the damage, the nonconforming use may only be rebuilt after a public hearing and favorable action by the Board of Zoning Adjustment. The applicant requested to rebuild a nonconforming structure (single family home) that was damaged by fire to the extent of 53 -percent of its replacement value. Mr. Stombaugh explained that Staff found there were special conditions, specifically the existing lot configuration precluded the development of any type of conforming structure based on the current zoning of R -MF -1, Multifamily District. Mr. Stombaugh explained to the Board that the ordinance requires that if a structure is destroyed 61 % or higher, it could not be rebuilt. He explained that the structure would have to be razed, removed and would have to go before the Board of Zoning Adjustment requesting a variance to rebuild. Louise Halprin of 20807 Summertree Lane, Colleyville, and representing Morley Architects, took the Oath of Truth and explained about the family's hardship due to the fire. Ms. Halprin explained that the construction would take approximately 90 days after the building permit was issued. Nona Jean Chivers of 318 Turner Road, Grapevine, and applicant, took the Oath of Truth and explained that her nephews would help with the rebuilding. There was discussion regarding the time frame of construction. Mr. Stombaugh explained that if there were no construction activity for six months, the nonconforming use would have to cease. With no one else to speak regarding the case, Jim Kelso made a motion to close the public hearing. Kip Bruner seconded the motion which prevailed by the following vote: 3 Ayes: Hecht, Nays: None Absent: Luers, Bruner, Kelso, Holt, Tomerlin Cook Board of Zoning Adjustment 12/0412000 Kip Bruner made a motion that there was a special condition, specifically the existing lot configuration precluded the development of any type of conforming structure based on the current zoning of R -MF -1, Multifamily District. Jim Kelso seconded the motion which prevailed by the following vote: Ayes: Hecht, Bruner, Kelso, Holt, Tomerlin Nays: None Absent: Luers, Cook Chairman Carl Hecht announced that one letter of approval had been received. Jim which prevailed by the following vote: Ayes: Hecht, Bruner, Kelso, Holt, Tomerlin Nays: None Absent: Luers, Cook request to Section 43.G.1., the applicant to rebuild a was damaged by fire to the Kelso seconded the motion BOARD OF ZONING ADJUSTMENT CASE BZA00-28 WILLIE IHNFELDT THE RANCH OF LONESOME DOVE 2299 LONESOME DOVE ROAD Next the Board of Zoning Adjustment considered BZA00-28 submitted by Willie Ihnfeldt, representing the Ranch of Lonesome Dove, Inc., for property located at 2299 Lonesome Dove Road, platted as Lots 1 and 2, Block 1, Ranch of Lonesome Dove. The following request was from Grapevine Comprehensive Zoning Ordinance 82-73: Section 58. B Parking, Loading, and Outside Storage Area Development Standards requires that all off-street parking areas and drives be paved. The applicant was seeking a complete variance to this requirement allowing the gravel drives and parking areas to remain as developed. Mr. Stombaugh explained that Staff found that there were special conditions specifically, Lot 1 was heavily wooded with many large diameter trees that would be lost due to construction of paved parking and drive areas, Lot 2 contained a historic building that was moved to the site and used for church related activities; gravel parking and drives on Lot 2 were relative to maintaining the historic nature of the church structure, and the entire site was within a flowage easement of M Board of Zoning Adjustment 12/04/2000 Lake Grapevine and was subject to occasional flooding which would be damaging to any paved surfaces. Mr. Stombaugh explained that on November 7, 2000, the City Council approved the first reading of their zone change request for RA — Recreation/Amusement Zoning District and for a conditional use request. Mr. Jeff Cook of 802 Shadow Glen, Southlake, took the Oath of Truth. Mr. Cook explained that he was an adjacent property owner and approved of Mr. Ihnfeldt's request. Chairman Hecht announced that Mr. Cook had also submitted a letter of approval. With no one else to speak regarding the case, Kip Burner made a motion to close the public hearing. Jim Kelso seconded the motion which prevailed by the following vote: Ayes: Hecht, Bruner, Kelso, Holt, Tomerlin Nays: None Absent: Luers, Cook There was discussion regarding the church that was moved onto the property and about the property being in the flowage easement. Due to Mr. Ihnfeldt needing to answer questions from the Board, Jim Kelso made a motion to reopen the public hearing. Kip Bruner seconded the motion which prevailed by the following vote: Ayes: Hecht, Bruner, Kelso, Holt, Tomerlin Nays: None Absent: Luers, Cook Willie Ihnfeldt, applicant, of 2717 Anderson Gibson Road, Grapevine, took the Oath of Truth and explained that the building had been in existence since 1992. He also noted that the property had recently flooded twice. He also explained that the wedding chapel, which was 100 years old, was moved onto the property four years ago and business was being conducted prior to that date. He mentioned that no changes were being made to the property. Kip Burner then made a motion to close the public hearing. Jim Kelso made a motion to approve the minutes of the October 2, 2000, meeting.
