The Board of Zoning Adjustment for the City of Grapevine, Texas, met on Monday evening,
April 19, 2004, at 6:00 P.M. in the Planning and Zoning Conference Room, 2nd Floor, 200
South Main Street, Grapevine, Texas, for a Briefing Session with the following members
present to wit:
Carl Hecht
Ron Cook
Dennis Luers
Kip Bruner
Debbie Holt
Richard Adams

constituting a quorum with Member Jim Kelso absent. Also present were City Council
Representative Roy Stewart and the following City Staff:

CALL TO ORDER
Chairman Carl Hecht called the Briefing Session of the Board of Zoning Adjustment to order
at approximately 6:06 P.M.

Chairman Hecht held roll call and announced that all were present except for Member Jim
Kelso.
NEW BUSINESS
BRIEFING SESSION
Mr. Stombaugh briefed the Board of Zoning Adjustment regarding the item scheduled to be
heard in the regular public hearing. Mr. Williams explained to the Board that the City Attorney
has ruled that when there is a conflict between a plat and the current zoning, zoning takes
precedent.
ADJOURNMENT
With no further discussion, Ron Cook made a motion to adjourn. Kip Bruner seconded the
motion which prevailed by the following vote:

Hecht, Cook, Kelso, Holt
Nays:
None
Absent:
Bruner
The Briefing Session was adjourned at 6:14P.M.

The Board of Zoning Adjustment for the City of Grapevine, Texas, met in regular
session, Monday evening, April 19, 2004, at 6:16 P.M., in the Council Chambers,
200 South Main Street, Grapevine, Texas with the following members present:

Chairman Carl Hecht called the public hearing to order at approximately 6:16
P.M.

Chairman Hecht held roll call and announced that Member Jim Kelso was
absent.

BOARD OF ZONING ADJUSTMENT CASE BZA04-09 BRIAN LATAS 2606
EVINRUDE DRIVE
The item for the Board of Zoning Adjustment to consider was BZA04-09,
submitted by Brian Latas, for property located at 2606 Evinrude Drive, platted as
Lot 16, Block 9, Placid Peninsula Addition, City of Grapevine. The following
request was from Grapevine Comprehensive Zoning Ordinance 82-73:
Section 15.G.1, "R-7.5" Single Family District, Area Regulations, which requires

- that every lot have a minimum front yard setback of 30 -feet for a new single
family residence. The applicant was requesting a variance of five feet to this
requirement and if approved by the Board would allow a front yard setback of 25 -
feet for a new single family residence.
Mr. Stombaugh explained Staff found that a special condition existed for the
requested variance, specifically; the plat for the Placid Peninsula Addition was
approved in 1959 with the front yard setback for all lots designated at 25 -feet.
Numerous lots in this subdivision are platted with occupied single family
residences having both 25 -foot and 30 -foot front yard setbacks. In addition, an
error was made by Staff approving plans for the applicant's single family
residence with a 25 -foot setback rather than the 30 -foot setback that is now
required.
Chairman Hecht swore in the applicant to address the Board. Brian Latas, 1612
Choteau, Grapevine, TX, the owner and applicant, took the oath and offered to
answer any questions the board had. Mr. Latas reaffirmed that a permit had been
issued for a 25 foot setback.
Chairman Hecht announced that three letters of protest and five letters of
approval had been received.
With no additional speakers regarding the request, Dennis Luers made a motion
to close the public hearing. Kip Bruner seconded the motion which prevailed by
the following vote:

Dennis Luers made a motion that a special condition existed; specifically, the plat

Kip Bruner then made a motion to approve the request for a five foot variance to
Section 15.G.1 "R-7.5" Single Family District, Area Regulations, which requires
every lot to have a minimum front yard setback of 30 -feet. Dennis Luers
seconded the motion which prevailed by the following vote:

Next the Board of Zoning Adjustment considered the minutes of the February 2,
2004, Briefing Session and Public Hearing.
Ron Cook made a motion to accept the minutes of the February 2, 2004, Briefing
Session. Kip Bruner seconded the motion which prevailed by the following vote:

Nays:
