Also present were City Council Representative Roy Stewart and the following City Staff: Scott Williams Ron Stombaugh Gerrie Bewley CALL TO ORDER Building Official Planner 11 Secretary Chairman Carl Hecht called the Briefing Session of the Board of Zoning Adjustment to order at approximately 6:00 P.M. ROLL CALL Chairman Hecht held roll call and announced that all were present. NEW BUSINESS BRIEFING SESSION Mr. Stombaugh briefed the Board of Zoning Adjustment regarding the item scheduled to be heard in the regular public hearing. ADJOURNMENT With no further discussion, Dennis Luers made a motion to adjourn. Kip Bruner seconded the motion which prevailed by the following vote: Ayes: Hecht, Luers, Cook, Bruner, Kelso, Holt, Adams Nays: None Absent: None The Briefing Session was adjourned at 6:15 P.M. PASSED AND APPROVED BY THE BOARD OF ZONING ADJUSTMENT OF THE CITY OF GRAPEVINE, TEXAS, ON THE 1st DAY OF NOVEMBER, 2004. CHAIRMAN SECRETARY STATE OF TEXAS COUNTY OF TARRANT CITY OF GRAPEVINE The Board of Zoning Adjustment for the City of Grapevine, Texas, met in regular session, Monday evening, June 7, 2004, at 6:15 P.M., in the Council Chambers, 200 South Main Street, Grapevine, Texas with the following members present: Carl Hecht Chairman Dennis Luers Vice -Chairman Ron Cook Secretary Kip Bruner Member Jim Kelso Member Debbie Holt Alternate Richard Adams Alternate constituting a quorum. ROLL CALL Chairman Hecht held roll call and announced that all members were present. NEW BUSINESS BOARD OF ZONING ADJUSTMENT CASE BZA04-11 RANDY POPEIL 222 LUCAS DRIVE The item for the Board of Zoning Adjustment to consider was BZA04-11, submitted by Randy Popeil, for property located at 222 Lucas Drive, platted as Lot 2, Block 2, and a portion of Lot 3, Block 2, W. C. Lucas Addition, City of Grapevine. The following request was from Grapevine Comprehensive Zoning Ordinance 82-73: Section 43.E.3., Non -conforming Uses and Structures, allows the Board of Zoning Adjustment to approve the remodeling and/or enlargement of a non- conforming use. Board of Zoning Adjustment 06/07/2004 If approved, the existing site would be allowed to remain as developed and would also allow the construction of a new accessory building. Mr. Stombaugh explained that Staff found that there were special conditions for the requested special exception, specifically, the subject site is developed as a single family residence and has been utilized as a single family residence since it was constructed in 1950 predating the City's first zoning ordinance enacted in 1955. He explained that during the 1984 City Rezoning the subject site was rezoned to "CC" Community Commercial District and the lot width, front and side yard setback, and masonry requirements are not in compliance with the current zoning. Mr. Stombaugh noted that Staff's recommendation of approval was based on the condition that the applicant file and have approved by the City Council, a replat combining both pieces of property prior to issuance of a building permit for the accessory structure. Randy Popeil, applicant of 1532 Tiffany Forest Lane, Grapevine, Texas, took the Oath of Truth. He explained that he has collectible cars and has been looking for property for the past 10 years. He explained that he would be able to build an all masonry accessory building for his cars on this piece of property which would meet all requirements. He explained that the existing house and garage do not meet the current zoning requirements. Mr. Popeil explained that all buildings except for the existing house and steel building, which would be used for their garage, would be removed. Mr. Popeil explained that they would live in the existing house. With no additional speakers regarding the request, Dennis Luers made a motion to close the public hearing. Jim Kelso seconded the motion which prevailed by the following vote: Ayes: Hecht, Luers, Cook, Bruner, Kelso Nays: None Absent: None Chairman Hecht announced that no letters of approval of disapproval had been received. Dennis Luers made a motion that there were special conditions, specifically the subject site was developed as a single family residence and had been utilized as a single family residence since it was constructed in 1950 predating the City's first zoning ordinance enacted in 1955. Jim Kelso seconded the motion which prevailed by the following vote: Ayes: Hecht, Luers, Cook, Bruner, Kelso Nays: None Absent: None VA Board of Zoning Adjustment 06/07/2004 Dennis Luers then made a motion to approve the request special exception to Section 43.E.3., Non -conforming Uses and Structures, allowing the existing site to remain as developed and the construction of a new accessory building, with the condition that the applicant file and have approved by the City Council, a replat adding the additional 10 feet of property prior to issuance of a building permit for the accessory building. Kip Bruner seconded the motion which prevailed by the following vote: Ayes: Hecht, Luers, Cook, Bruner, Kelso Nays: None Absent: None MINUTES Next the Board of Zoning Adjustment considered the minutes of the May 3, 2004, Briefing Session and Public Hearing. Ron Cook made a motion to accept the minutes, as corrected, of the May 3, 2004, Briefing Session. Kip Bruner seconded the motion which prevailed by the following vote: Ayes: Hecht, Luers, Cook, Bruner, Kelso Nays: None Absent: None Ron Cook made a motion to accept the minutes, as corrected, of the May 3, 2004, Public Hearing. Kip Bruner seconded the motion which prevailed by the following vote: Ayes: Hecht, Luers, Cook, Bruner, Kelso Nays: None Absent: None With no further discussion, Kip Bruner made a motion to adjourn.
