The Board of Zoning Adjustment for the City of Grapevine, Texas, met on Monday
evening, December 6, 2004, at 6:00 P.M. in the Planning and Zoning Conference
Room, 2nd Floor, 200 South Main Street, Grapevine, Texas, for a Briefing Session with
the following members present to wit:
Carl Hecht
Chairman
Ron Cook
Secretary
Kip Bruner
Member
Debbie Holt
Member
Richard Adams
Alternate
constituting a quorum with Vice -Chairman Dennis Luers and 2nd Alternate Scott Baker
absent. Also present were applicants Jerry and Robert Stone, City Council
Representative Roy Stewart and the following City Staff:

Ginger Watson Development Services Assistant
Chairman Carl Hecht called the Briefing Session of the Board of Zoning Adjustment to
order at approximately 6:03 P.M.
ROLL CALL
Chairman Hecht held roll call and announced that all were present except Vice
Chairman Dennis Luers, Member Debbie Holt and 2nd Alternate Scott Baker. Ms. Holt
arrived at approximately 6:06 P.M.
NEW BUSINESS
BRIEFING SESSION
Mr. Williams briefed the Board of Zoning Adjustment regarding the item scheduled to be
heard in the regular public hearing.
ADJOURNMENT
With no further discussion, Kip Bruner made a motion to adjourn. Ron Cook seconded
the motion which prevailed by the following vote:
Ayes: Hecht, Cook, Bruner, Holt and Adams
Nays: None
Absent: suers, Baker
The Briefing Session was adjourned at 6:15 P.M.

The Board of Zoning Adjustment for the City of Grapevine, Texas, met in regular
session, Monday evening, December 6, 2004, at 6:15 P.M., in the Council Chambers,
200 South Main Street, Grapevine, Texas with the following members present:

BOARD OF ZONING ADJUSTMENT CASE BZA04-14 ROBERT J. STONE III 2721
ANDERSON GIBSON ROAD
The first item for the Board of Zoning Adjustment to consider was BZA04-14, submitted
by Robert J. Stone, III for property located at 2721 Anderson Gibson Road and legally
described as Tract 1C, Abstract 1415, Henry Suggs Survey. The following request was
from Grapevine Comprehensive Zoning Ordinance 82-73:
Section 21.M.5, Multifamily District Regulations, Design Requirements, states that no
building shall be located closer than fifteen (15) feet to the edge of an off-street parking,
vehicular use, or storage area.

The applicant requested a variance of five (5) feet to this requirement and if approved
by the Board, would allow buildings along the escarpment to be located ten (10) feet
from the edge of an off-street parking, vehicular use, or storage area.
Section 21.M.8 "R -MF -1", Multifamily District Regulations, Design Requirements
requires vehicular use or storage areas to be located at least ten (10) feet from any
adjacent property line.
The applicant requested a complete variance to this requirement and if approved by the
Board, would allow a retaining wall and driveway near the southwestern corner of the
site at the edge of the property line.
Section 53.H.2.b Landscaping Regulations requires a (10) foot landscaping setback be
maintained between the edge of any parking or vehicular use area and an adjacent
property line.
The applicant requested a complete variance to this requirement and if approved by the
Board, would allow a retaining wall and driveway near the southwestern corner of the
site at the edge of the property line.
Mr. Williams explained Staff found that a special condition existed for the requested
variances. Specifically, the extreme elevation change of approximately 70 feet and
dense tree coverage severely limited the buildable area of the site. He added that the
applicant planned to develop the property much less densely than he could have by
ordinance, while working to preserve the natural beauty of the site and maintain the full
grown trees. Mr. Williams then stated that the City Council had approved a zone
change for the site, pending BZA approval of the requested variances.
Jerry Stone and Robert Stone, applicants, took the Oath of Truth. Mr. Jerry Stone
stated that the subject property is a seven -acre parcel located just outside the
Grapevine Mills Mail. He explained that there are two golf courses in the area, and the
site contains trees ranging from 30 to 54 inches in diameter. He explained that they
tried to get the best use and maintain the integrity of the property by staying at the base
of the escarpment, and that moving the buildings would require removal of beautiful oak
trees. He added that situating buildings on the golf course would require a 12 or 15 foot
retaining wall which would also sacrifice the natural beauty and integrity of the property.
Ron Cook expressed concern that some of the variances could be avoided if the
applicant built fewer structures.
Jerry Stone, applicant, stated that due to the low density of the existing design, he could
not eliminate structures and make the plan work economically.
There was also discussion regarding the flood plain on the site, which further restricted
the development.
Chairman Hecht announced that one letter of approval had been received.

Roy Stewart, City Councilman, took the Oath of Truth and noted that only after seeing
this site could one truly appreciate it. He added that the site contains some of the
largest trees in Grapevine.
With no additional speakers, Kip Bruner made a motion to close the public hearing.
Debbie Holt seconded the motion which prevailed by the following vote:
Ayes: Hecht, Cook, Bruner, Holt and Adams
Nays: None
Absent: Luers, Baker
Kip Bruner made a motion that a special condition existed. Specifically, the extreme
topography of the site severely limits the buildable area of the site. Debbie Holt
seconded the motion which prevailed by the following vote:
Ayes: Hecht, Cook, Bruner, Holt and Adams

Absent: Luers, Baker
Kip Bruner then made a motion to approve the request of a variance of five feet to
Section 21.M.5, Multifamily District Regulations, a complete variance to Section 21.M.8
"R -MF -1", Multifamily District Regulations, and a complete variance to Section 53.H.2.b,
Landscaping Regulations. Debbie Holt seconded the motion which prevailed by the
following vote:
Ayes: Hecht, Bruner, Holt and Adams
Nays: Cook
Absent: Luers, Baker
Next the Board of Zoning Adjustment considered the minutes of the November 1, 2004,
Briefing Session and Public Hearing.
Ron Cook made a motion to accept the minutes of the November 1, 2004, Briefing
Session. Richard Adams seconded the motion which prevailed by the following vote:
Ayes: Hecht, Cook, Bruner, Holt and Adams
Nays: None
Absent: Luers, Baker
Ron Cook made a motion to accept the minutes of the November 1, 2004, Public
Hearing. Kip Bruner seconded the motion which prevailed by the following vote:
Ayes: Hecht, Cook, Bruner, Holt and Adams
