Also present were City Council Representative Sharron Spencer and the following City Staff: Scott Williams Building Official Ron Stombaugh Planner II Gerrie Graham Development Services Assistant CALL TO ORDER Chairman Carl Hecht called the Briefing Session of the Board of Zoning Adjustment to order at approximately 6:00 P.M. ROLL CALL Chairman Carl Hecht held Roll Call and announced that everyone was present. 1g,ATITA: BRIEFING SESSION Mr. Stombaugh briefed the Board of Zoning Adjustment regarding the items scheduled to be heard in the regular public hearing. Mrs. Spencer talked about the reappointment process and that City Council was very pleased with the Board of Zoning Adjustment. Ms. Spencer explained that several years ago, the City Council instituted that the alternate members of the Planning and Zoning Commission, take turns in voting. She explained that it was working well and suggested that it be implemented with the Board of Zoning Adjustment. She suggested that the Board discuss whether or not they would want it implemented. The Board requested that Mr. Williams have the City Attorney meet with the Board regarding discussion among the alternates. With no further discussion, Kip Bruner made a motion to adjourn. Jim Kelso seconded the motion which prevailed by the following vote: Ayes: Hecht, Luers, Cook, Bruner, Kelso Nays: None Absent: None The Briefing Session was adjourned at 6:13 P.M. With no other nominations, Jim Kelso seconded the motion which prevailed by the following vote: Ayes: Luers, Cook, Bruner, Kelso Nays: None Absent: None Abstain: Hecht Board of Zoning Adjustment 07/01/2002 For office of Vice -Chairman, Kip Bruner made a motion to renominate Dennis Luers. With no other nominations, Jim Kelso seconded the motion which prevailed by the following vote: Ayes: Hecht, Luers, Bruner, Kelso Nays: None Absent: None Abstain: Cook NEW BUSINESS BOARD OF ZONING ADJUSTMENT CASE BZA02-07 CORLEY HOMES INC 1834 ANGLERS PLAZA The first item was for the Board of Zoning Adjustment to consider was BZA02-07, submitted by Marvin Bonner representing Corley Homes, Inc., for property located at 1834 Anglers Plaza and platted as Lot 49, Shorecrest Acres, City Of Grapevine. The following requests were from Grapevine Comprehensive Zoning Ordinance 82-73: Section 15.G.1, "R-7.5" Single Family District, Area Regulations, requires the depth of the front yard to be a minimum of 30 -feet. The applicant requested a variance of five feet to this requirement and if approved by the Board would allow a front yard setback of 25 -feet along Anglers Plaza. Section 15.G.2, "R-7.5" Single Family District, Area Regulations, which requires the depth of the rear yard to be a minimum of 25 -feet. The applicant requested a variance of 1 -foot to this requirement and if approved by the Board would allow a rear yard setback of 24 -feet. Mr. Stombaugh explained that Staff found that there was a special condition for both requested variances, specifically, the lot was particularly shallow being 85 - feet in depth. Mr. Stombaugh explained that the Board approved a variance of K Board of Zoning Adjustment 07/01/2002 15 -feet to the minimum lot depth requirement of 100 -feet for this lot at the December 3, 2001 meeting. Marvin Bonner of 53 Panorama Circle, Trophy Club, Texas, took the Oath of Truth and explained that when he purchased the lot , the plot plan showed a 25 - foot front yard setback. He explained that when the form survey was inspected, it was noted that the front yard setback had to be 30 -feet. With no one else to speak regarding the case, Kip Bruner made a motion to close the public hearing. Dennis Luers seconded the motion which prevailed by the following vote: Ayes: Hecht, Luers, Cook, Bruner, Kelso Nays: None Absent: None Chairman Hecht announced that one letter of protest had been received. Dennis Luers then made a motion that there was a special condition, specifically, the lot was particularly shallow being 85 -feet in depth. Kip Bruner seconded the motion which prevailed by the following vote: Ayes: Hecht, Luers, Cook, Bruner, Kelso Nays: None Absent: None Dennis Luers then made a motion to grant the variances to Grapevine Comprehensive Zoning Ordinance 82-72, Section 15.G.I., Single Family District Regulations, Area Regulations, allowing a front yard setback of 25 -feet along Anglers Plaza, and to Section 15.G.2., Single Family District Regulations, Area Regulations, allowing a rear yard setback of 24 feet. Kip Bruner seconded the motion which prevailed by the following vote: Ayes: Hecht, Luers, Cook, Bruner, Kelso Nays: None Absent: None BOARD OF ZONING ADJUSTMENT CASE BZA02-08, PHILIP MORLEY- BGO ARCHITECTS, 204 NORTH DOOLEY STREET Next the Board of Zoning Adjustment considered BZA02-08, submitted by Philip Morley, for property located at 204 N. Dooley Street and platted as Lot 1, Block 6, W. R. Boyd Center, City Of Grapevine. The following requests were from Grapevine Comprehensive Zoning Ordinance 82-73: Section 25.G.5, "CC" Community Commercial District, Area Regulations which KI Board of Zoning Adjustment 07/01/2002 requires a rear yard setback of not less than 25 -feet. The applicant requested a variance of five -feet to this requirement for two existing structures and if approved by the Board, would allow a rear yard setback of 20 -feet. Section 25.G.6, "CC" Community Commercial District, Area Regulations which requires a minimum distance of 40 -feet between detached principal or accessory buildings on the same lot. The applicant requested a variance of 17 -feet to this requirement for two existing principal buildings, and if approved by the Board would allow a building separation of 23 -feet between the two existing structures. Mr. Stombaugh explained that Staff found that there was a special condition for both requested variances, specifically, this was an existing development on a platted lot constructed before the adoption of the current zoning regulations. Philip Morley — BGO Architects of 920 S. Main Street, Grapevine, took the Oath of Truth. Mr. Morley explained that the owners wanted to convert the property from an industrial use to a professional office use. He explained that in the future, the owner stated that he might connect the two existing buildings. Mr. Morley also noted that the existing metal building located on the north end of the property would be removed along with some of the concrete. Lisa Prude, manager of the Montelena Apartments, 501 Turner Street, Grapevine, took the Oath of Truth. She explained that the management was eager to see improvements to the property and they were in favor of the request. With no one else to speak regarding the case, Kip Bruner made a motion to close the public hearing. Jim Kelso seconded the motion which prevailed by the following vote: Ayes: Hecht, Luers, Cook, Bruner, Kelso Nays: None Absent: None Jim Kelso made a motion that a special condition did exist, specifically the property was an existing development on a platted lot constructed before the adoption of the current zoning regulations. Dennis Luers seconded the motion which prevailed by the following vote: Ayes: Hecht, Luers, Cook, Bruner, Kelso Nays: None Absent: None 0 Board of Zoning Adjustment 07/01/2002 Jim Kelso then made a motion to approve the requests to Grapevine Comprehensive Zoning Ordinance 82-73, Section 25.G.5., CC, Community Commercial District, Area Regulations, allowing a rear yard setback of 20 -feet; and to Section 25.G.6, CC, Community Commercial District, Area Regulations, allowing a building separation of 23 -feet between the two existing structures. Dennis Luers seconded the motion which prevailed by the following vote: Ayes: Hecht, Luers, Cook, Bruner, Kelso Nays: None Absent: None Jim Kelso then amended his motion to include "as indicated on the plot plan" and "that the building on the northeast corner of the lot would be removed". Kip Bruner seconded the amended motion which prevailed by the following vote: Ayes: Hecht, Luers, Cook, Bruner, Kelso Nays: None Absent: None BOARD OF ZONING ADJUSTMENT CASE BZA02-09 LESTER STRAIT 410 E. NORTHWEST HIGHWAY Next the Board of Zoning Adjustment considered BZA02-09, submitted by Lester Strait for property located at 410 E. Northwest Highway, legally described as Tract 4982, Abstract 946. The following request was from Grapevine Comprehensive Zoning Ordinance 82-73: Section 26.G.1., HC, Highway Commercial District, Area Regulations, which requires that every lot have a minimum lot width of 50 -feet. The applicant requested a variance of 1 -foot and if approved would allow a lot width of 49 -feet. Mr. Stombaugh explained that Staff found that there was a special condition, specifically the property was an existing, developed property with no possibility of expansion and was developed prior to the adoption of the current zoning ordinance. Lester Strait, applicant of 1900 N. Kimball Road, Southlake, Texas, took the Oath of Truth and explained that he bought the property one year ago. He explained that he was in the process of getting the property platted. He noted that the property would have to be platted before he could obtain a building permit to make repairs. Board of Zoning Adjustment 07/01/2002 With no one else to speak regarding the case, Dennis Luers made a motion to close the public hearing. Kip Bruner seconded the motion which prevailed by the following vote: Ayes: Hecht, Luers, Cook, Bruner, Kelso Nays: None Absent: None Kip Bruner made a motion that there was a special condition, specifically the property was an existing, developed property with no possibility of expansion and was developed prior to the adoption of the current zoning ordinance. Dennis Luers seconded the motion which prevailed by the following vote: Ayes: Hecht, Luers, Cook, Bruner, Kelso Nays: None Absent: None BOARD OF ZONING ADJUSTMENT CASE BZA02-11 TERRY & MARY DOYLE 2946 OAK FOREST DRIVE The next item for the Board of Zoning Adjustment to consider was BZA02-11, submitted by Terry and Mary Doyle for property located at 2946 Oak Forest Drive, platted as Lot 8, Block 10, Oak Creek Estates. The following request was to Grapevine Comprehensive Zoning Ordinance 82-73: Section 15.G.2., R-7.5, Single Family District, Area Regulations which requires the depth of the rear yard to be a minimum of 25 -feet. The applicant requested a variance of two -feet to this requirement and if approved would allow a rear yard setback of 23 -feet for a proposed patio room. Mr. Stombaugh explained that Staff found no special condition. Terry Doyle, applicant of 2946 Oak Forest Drive, Grapevine, Texas, took the Oath of Truth. Mr. Doyle explained that their contractor suggested an alternative plan which would be to encompass the existing fireplace, but trees would have to be removed. 2 Board of Zoning Adjustment 07/01/2002 Mr. Luers noted that five letters of approval had been received. With no one else to speak regarding the request, Kip Bruner made a motion to close the public hearing. Mr. Cook then made a motion that no special condition existed.
