BU D G OFFICIAL/ASSISTANT DIRECTOR DEV OPMENT SERVICES STATE OF TEXAS COUNTY OF TARRANT CITY OF GRAPEVINE The Board of Zoning Adjustment for the City of Grapevine, Texas, met on Monday evening, August 5, 2002, at 6:00 P.M. in the Planning and Zoning Conference Room, 2nd Floor, 200 South Main Street, Grapevine, Texas, for a Briefing Session with the following members present to wit: Carl Hecht Dennis Luers Ron Cook Kip Bruner Jim Kelso Debbie Holt Chairman Vice -Chairman Secretary Member Member 1 st Alternate constituting a quorum with 2nd Alternate Carl Tomerlin absent. Also present were City Council Representative Roy Stewart and the following City Staff: Scott Williams Building Official Ron Stombaugh Planner II Gerrie Graham Development Services Assistant CALL TO ORDER Chairman Carl Hecht called the Briefing Session of the Board of Zoning Adjustment to order at approximately 6:00 P.M. ROLL CALL Chairman Carl Hecht held Roll Call and announced that 2nd Alternate Carl Tomerlin was not present. NEW BUSINESS BRIEFING SESSION Mr. Stombaugh briefed the Board of Zoning Adjustment regarding the items scheduled to be heard in the regular public hearing. ADJOURNMENT With no further discussion, Kip Bruner made a motion to adjourn. Board of Zoning Adjustment to conduct a public hearing relative to Board of Zoning Adjustment Case BZA02-10, submitted by Salyer and Associates, Inc., for property located at 2172 McPherson Dr, and consideration of same. B. Board of Zoning Adjustment to conduct a public hearing relative to Board of Zoning Adjustment Case BZA02-12, submitted by Fablen Goury for property located at 326 E Texas St, and consideration of same. C. Board of Zoning Adjustment to conduct a public hearing relative to Board of Zoning Adjustment Case BZA02-14, submitted by Randy and Miriam Gilbert for property located at 1213 Sandhurst Ct, and consideration of same. SCOTWILL AMS BUILPOG OFFICIAL/ASSISTANT DIRECTOR OF DEVELOPMENT SERVICES STATE OF TEXAS COUNTY OF TARRANT CITY OF GRAPEVINE The Board of Zoning Adjustment for the City of Grapevine, Texas, met in regular session, Monday evening, August 5, 2002, at 6:15 P.M., in the Council Chambers, 200 South Main Street, Grapevine, Texas with the following members present: Carl Hecht Chairman Dennis Luers Vice -Chairman Ron Cook Secretary Kip Bruner Member Jim Kelso Member Debbie Holt 1't Alternate constituting a quorum with 2nd Alternate, Carl Tomerlin absent. Also present were City Council Representative Roy Stewart and the following City Staff: Scott Williams Building Official Ron Stombaugh Planner 11 Gerrie Graham Development Services Assistant Chairman Carl Hecht called the meeting to order at approximately 6:15 P.M. Chairman Hecht held roll call and announced that Carl Tomerlin was absent. NEW BUSINESS BOARD OF ZONING ADJUSTMENT CASE BZA02-10, SALYER AND ASSOCIATES — 2172 MCPHERSON DRIVE The first item was for the Board of Zoning Adjustment to consider BZA02-10, submitted by Salyer and Associates for property located at 2172 McPherson Drive, platted as Lot 1, Block 1, Clairmont Estates, City Of Grapevine. The following requests were from Grapevine Comprehensive Zoning Ordinance 82- 73: Section 211.2, "R -MF -1" Multifamily District Regulations, Density Requirements, requires that lots for any permitted use shall have a minimum area of two (2) acres. Board of Zoning Adjustment 08/05/2002 The applicant requested a variance of approximately 0.7 acres (30,492 square feet) to this requirement and if approved by the Board, will allow a lot size of approximately 1.3 acres (56,629 square feet) for a proposed multifamily project. Mr. Stombaugh explained that Staff found a special condition for the requested variance, specifically, the subject property was surrounded by platted, developed property to the north, east, and west and McPherson Drive to the south. He explained that there was no possibility for expansion of the subject property to meet the minimum lot size requirements. Mr. Stombaugh explained that the City Council, at their July 16, 2002 meeting tentatively approved a rezoning of this property from "R -MF -2" Multifamily District to "R -MF -1" Multifamily District pending approval by the Board of Zoning Adjustment. Phillip P. Salyer of 303 Ridgeview Lane, Trophy Club, Texas, took the Oath of Truth. Mr. Salyer explained that the land was landlocked and that the partnership wanted to build an upscale condominium project. Mr. Salyer noted that the neighbors liked the proposed project, as the current zoning would allow a 20 -unit project . In response to Kip Bruner's question, Ron Stombaugh explained that Planning and Zoning Commission did have reservations about the project but, along with City Council, unanimously approved it. There was discussion regarding the number of units that could be built on the property. Roy Stewart of 309 Drexel Drive, took the Oath of Truth and explained that when the plan was brought before City Council, it showed a 10 unit project. Mr. Stombaugh explained that the concept plan was turned in to Planning and Zoning, but the concept plan did not apply to the case, only the lot size was to be considered. Mr. Williams addressed the Board stating that if they had any reservations about the number of units changing, they could simply add the condition that the development be limited to 10 units. With no one else to speak regarding the case, Dennis Luers made a motion to close the public hearing. Kip Bruner seconded the motion which prevailed by the following vote: Ayes: Hecht, Luers, Cook, Bruner, Kelso Nays: None Absent: Tomerlin 1 Board of Zoning Adjustment 08/05/2002 Chairman Hecht announced that one letter of protest had been received. There was further discussion regarding the number of units that could be placed on the property, Kip Bruner made a motion that there was a special condition, specifically the subject property was surrounded by platted, developed property to the north, east, and west and McPherson Drive to the south, and that there was no possibility for expansion of the subject property to meet the minimum lot size requirements.. Dennis Luers seconded the motion which prevailed by the following vote: Ayes: Hecht, Luers, Bruner, Kelso Nays: Cook Absent: Tomerlin Kip Bruner then made a motion to approve the request to Section 215.2., R -MF - 1, Multifamily District Regulations, allowing a lot size of approximately 1.3 acres (56,629 square feet) for a proposed multifamily project and the condition that the conceptual plan layout be attached. Jim Kelso seconded the motion which prevailed by the following: Ayes: Luers, Bruner, Kelso Nays: Hecht, Cook Absent: Tomerlin The request failed due to a vote of 3-2. BOARD OF ZONING ADJUSTMENT CASE BZA02-12 FABIEN GOURY — 326 E. TEXAS STREET Next the Board of Zoning Adjustment considered BZA02-12, submitted by Fabien Goury, for property located at 326 E. Texas Street and platted as Lot 3, Block 37, City Of Grapevine. The following requests were from Grapevine Comprehensive Zoning Ordinance 82-73: Section 43.E.3., Nonconforming Uses and Structures, allows the Board to approve the remodeling and/or enlargement of a nonconforming use. The applicant requested to allow an enclosed addition as well as porch addition to be constructed at the rear of an existing single family home. Section 15.G.7, "R-7.5" Single Family District Regulations, Area Regulations, mandates that only one single-family detached dwelling shall be permitted on each lot. 3 Board of Zoning Adjustment 08/05/2002 The applicant requested to allow three, existing detached single family structures to remain as developed at the rear of the property. Mr. Stombaugh explained that Staff found that there were special conditions for both the special exception and the variance request, specifically, the site was existing and it was estimated that the main single family residence to which the additions were proposed was constructed in 1947 with the outbuildings constructed shortly thereafter. Mr. Stombaugh explained that the construction predates the City's first zoning ordinance, which was enacted in 1955. Fabien Goury, applicant of 525 S. Main Street, Grapevine, took the Oath of Truth and explained that he had made improvements to the property. He explained that he wanted to add a bedroom and porch. With no one else to speak regarding the case, Dennis Luers made a motion to close the public hearing. Kip Bruner seconded the motion which prevailed by the following vote: Ayes: Hecht, Luers, Cook, Bruner, Kelso Nays: None Absent: Tomerlin Mr. Stombaugh explained that if the three outbuildings were not on the lot, the variance would not have to be heard because Mr. Goury's proposed additions met all zoning requirements. Dennis Luers made a motion that there was a special condition, specifically, the site existed and was estimated that the main single family residence to which the addition were proposed was constructed in 1947 with the outbuildings constructed shortly thereafter. Mr. Luers further explained that the construction predated the City's first zoning ordinance, which was enacted in 1955. Kip Bruner seconded the motion which prevailed by the following vote: Board of Zoning Adjustment 08/05/2002 Ayes: Hecht, Luers, Cook, Bruner, Kelso Nays: None Absent: Tomerlin BOARD OF ZONING ADJUSTMENT CASE BZA02-14 RANDY AND MIRIAM GILBERT — 1213 SANDHURST COURT Next the Board of Zoning Adjustment considered BZA02-14, submitted by Randy and Miriam Gilbert for property located at 1213 Sandhurst Court, platted as Lot 22, Block 1, Forest Lake. The following request was from Grapevine Comprehensive Zoning Ordinance 82-73: Section 15.G.2, "R-7.5" Single Family District Regulations, Area Regulations, which requires the depth of the rear yard to be a minimum of 25 -feet. The applicant requested a variance of two feet to this requirement for an encroachment into the rear yard setback at the southwest corner of the residence. If approved by the Board, it will allow a rear yard setback of 23 -feet for an existing single family residence. Mr. Stombaugh explained that Staff found that there was a special condition for the requested variance, specifically, the single family residence was existing. Mr. Stombaugh explained that when the residence was constructed in the mid to late 1980's, a form survey was not required at that time to ensure that the concrete foundation met the setback requirements leading to occasional slight encroachments into required yards. Chairman Hecht announced that five letters of approval had been received. With the applicant not being present and no one to speak regarding the case, Ron Cook made a motion to close the public hearing. Kip Bruner seconded the motion which prevailed by the following vote: Ayes: Hecht, Cook, Luers, Bruner, Kelso Nays: None Absent: Tomerlin Ron Cook then made a motion that there was a special condition, specifically, it was an existing residence and at the time of construction in the mid to late 1980's, a form survey was not required to ensure that the concrete foundation met the setback requirements.
