STATE OF TEXAS COUNTY OF TARRANT CITY OF GRAPEVINE The Board of Zoning Adjustment for the City of Grapevine, Texas, met on Monday evening, September 9, 2002, at 6:00 P.M. in the Planning and Zoning Conference Room, 2nd Floor, 200 South Main Street, Grapevine, Texas, for a Briefing Session with the following members present to wit: Carl Hecht Dennis Luers Ron Cook Kip Bruner Debbie Holt Carl Tomerlin Chairman Vice -Chairman Secretary Member 1 st Alternate 2nd Alternate constituting a quorum with Member Jim Kelso absent. Also present were City Council Representative Sharron Spencer and the following City Staff: Scott Williams Building Official Ron Stombaugh Planner II Gerrie Graham Development Services Assistant Chairman Carl Hecht called the Briefing Session of the Board of Zoning Adjustment to order at approximately 6:00 P.M. ROLL CALL Chairman Carl Hecht held Roll Call and announced that Member Jim Kelso was not present.. NEW BUSINESS BRIEFING SESSION Mr. Stombaugh briefed the Board of Zoning Adjustment regarding the items scheduled to be heard in the regular public hearing. ADJOURNMENT With no further discussion, Kip Bruner made a motion to adjourn. ROLL CALL Chairman Hecht held roll call and announced that Jim Kelso was absent. NEW BUSINESS BOARD OF ZONING ADJUSTMENT CASE BZA02-13. G. PHILIP MORLEY — BGO ARCHITECTS, 925 MINTERS CHAPEL ROAD The first item was for the Board of Zoning Adjustment to consider BZA02-13, submitted by G. Philip Morley — BGO Architects, for property located at 925 Minters Chapel Road, platted as Lot 1, Block 1, HFCC Addition, City Of Grapevine. The following requests were from Grapevine Comprehensive Zoning Ordinance 82-73: Section 31.G.5, "Ll" Light Industrial District, Area Regulations requires that every lot have a rear yard setback of not less than 30 -feet in depth. The applicant requested a variance of 12 -feet to this requirement and if approved Board of Zoning Adjustment 09/09/2002 would allow a rear yard setback of 18 -feet for an existing structure. Section 58.1, Parking, Loading, and Outside Storage Area Development Standards requires a minimum 25 -foot driving lane width for two-way driving lanes with ninety -degree head -in parking stalls in private parking lots. The applicant requested a variance of 5 -feet to this requirement and if approved, would allow a driving lane width of 20 -feet for a small portion of the driving lane near the entrance to the site. Mr. Stombaugh explained that Staff found that there was a special condition for both requested variances, specifically this was an existing developed site. He explained that the site was developed as a nursing home in the late 1960's and has operated continuously as such until its recent closure. Mr. Stombaugh explained that the City Council tentatively approved at their August 20 meeting, a conditional use permit to allow for a religious institution for the above referenced property. He explained that the new owner of the property intended to use the site for church related activities as well as a vocational school. He further explained that the property was zoned "R-3" Multifamily Dwelling District when the site was initially developed and the nursing home was a permitted use at that time. Philip Morley with BGO Architects of 925 S. Main Street, Suite 190, Grapevine, took the Oath of Truth. Mr. Morley explained that the property was surrounded by industrial property. He explained that the front driveway and porch was part of the original design and that the fire lane regulations were only 20 feet. He explained that the parking was angled in a different direction of entering. With no one else to speak regarding the case, Dennis Luers made a motion to close the public hearing. Kip Bruner seconded the motion which prevailed by the following vote: Ayes: Hecht, Luers, Cook, Bruner, Holt Nays: None Absent: Kelso With no one else to speak regarding the case, Dennis Luers made a motion that there was a special condition. Kip Bruner seconded the motion which prevailed by the following vote: Ayes: Hecht, Luers, Cook, Bruner, Holt Nays: None Absent: Kelso 2 Board of Zoning Adjustment 09/09/2002 Dennis Luers then made a motion to approve the request to Sections 31.G.5., LI, Light Industrial District, Area Regulations, allowing a rear yard setback of 18 -feet for an existing structure, and 58.1, Parking, Loading, and Outside Storage Are Development Standards, allowing a driving lane width of 20 -feet for a small portion of the driving lane near the entrance to the site. Kip Bruner seconded the motion which prevailed by the following: Ayes: Hecht, Luers, Cook, Burner, Holt Nays: None Absent: Kelso BOARD OF ZONING ADJUSTMENT CASE BZA02-16. HUGH SHRADER- 2133 WESTWOOD TERRACE Next the Board of Zoning Adjustment considered BZA02-16, submitted by Hugh Schrader, for property located at 2133 Westwood Terrace and platted as Lot 2, Block 3, Lake crest Estates. The following request was from Grapevine Comprehensive Zoning Ordinance 82-73: Section 15.G.1, "R-7.5" Single Family District Regulations, Area Regulations, which requires the minimum depth of the front yard setback to be 30 -feet. The applicant requested a variance of three feet to this requirement and if approved, would allow a front yard setback of 27 -feet for an existing single family residence. Mr. Stombaugh explained that Staff found that there was a special condition, specifically the residence was existing. Mr. Stombaugh explained that the residence was constructed in 1985, and a form survey was not required at that time to ensure that the structure met all setback requirements. Hugh Shrader, applicant and owner of 2133 Westwood Terrace, Grapevine, took the Oath of Truth. Mr. Shrader explained that he bought the house three and one-half months ago and that the fireplace extended past the 30 foot building setback. He explained that he was not going to build onto the house. Chairman Hecht announced that one letter of approval had been received. With no one else to speak either for or against the motion to close the public hearing. Ron Cook prevailed by the following vote: Ayes: Hecht, Luers, Cook, Bruner, Holt Nays: None Absent: Kelso 3 request, Kip Bruner made a seconded the motion which Board of Zoning Adjustment 09/09/2002 Kip Bruner then made a motion that there was a special condition, specifically the residence was existing. Dennis Luers seconded the motion which prevailed by the following vote: Ayes: Hecht, Luers, Cook, Bruner, Holt Nays: None Absent: Kelso Dennis Luers made a motion to approve the variance request to Grapevine Comprehensive Zoning Ordinance 82-73, Section 15.G.1, R-7.5, Single Family District Regulations, allowing a front yard setback of 27 -feet for an existing single family residence. Kip Bruner seconded the motion which prevailed by the following vote: Ayes: Hecht, Luers, Cook, Bruner, Holt Nays: None Absent: Kelso ASSOCIATES — 2172 MCPHERSON DRIVE Next the Board of Zoning Adjustment considered placing BZA02-10, on the October 7, 2002, public hearing. Mr. Stombaugh explained that the case failed by a vote of 3-2 at the August 5, 2002, meeting. He explained that Staff has since received a request from Board Member Carl Hecht asking that the Board consider rehearing the case. Chairman Carl Hecht made a motion that the Board of Zoning Adjustment rehear the case if the applicant files an amended site plan. Kip Burner seconded the motion. Kip Bruner then made a motion to amend the previous motion that the case be placed on the next public hearing agenda. The following vote prevailed: Ayes: Hecht, Luers, Bruner, Holt Nays: Cook Absent: Kelso MINUTES Next the Board of Zoning Adjustment considered the minutes of the August 5, 2002, Briefing Session and Public Hearing. Ron Cook made a motion to approve the minutes of the August 5, 2002, Briefing Session.
