CITY OF GRAPEVINE
The Board of Zoning Adjustment for the City of Grapevine, Texas, met on Monday evening,
November 4, 2002, at 6:00 P.M. in the Planning and Zoning Conference Room, 2nd Floor, 200
South Main Street, Grapevine, Texas, for a Briefing Session with the following members
present to wit:

constituting a quorum with Chairman Carl Hecht and Vice -Chairman Dennis Luers absent.
Also present were City Council Representative Sharron Spencer, and the following City Staff:

Gerrie Graham Development Services Assistant
Secretary Ron Cook presided over the meeting in Chairman Carl Hecht's absence and called
the Briefing Session of the Board of Zoning Adjustment to order at approximately 6:00 P.M.
Secretary Ron Cook announced that all members were present except Chairman Carl Hecht
and Vice -Chairman Dennis Luers.

Mr. Stombaugh briefed the Board of Zoning Adjustment regarding the items scheduled to be
heard in the regular public hearing.

With no further discussion, Kip Bruner made a motion to adjourn. Jim Kelso seconded the
motion which prevailed by the following vote:
Ayes: Cook, Bruner, Kelso, Holt, Tomerlin
Nays: None
Absent: Hecht, Luers
The Briefing Session was adjourned at 6:10 P.M.

The Board of Zoning Adjustment for the City of Grapevine, Texas, met in regular

CALL TO ORDER
Secretary Ron Cook presided over the public hearing in Chairman Carl Hecht's
absence and called the meeting to order at approximately 6:15 P.M.
ROLL CALL
Secretary Ron Cook announced that all members were present except
Chairman, Carl Hecht and Vice -Chairman, Dennis Luers.
NEW BUSINESS
BOARD OF ZONING ADJUSTMENT CASE BZA02-18 JOHNNY SWYDEN
2425 WHITNEY LANE
The first item was for the Board of Zoning Adjustment to consider BZA02-18,
submitted by Mr. Johnny Swyden, for property located at 2425 Whitney Lane,
platted as Lot 12, Block 1, Blair Manor, City Of Grapevine. The following request
was from Grapevine Comprehensive Zoning Ordinance 82-73:
Section 15.G.2, "R-7.5" Single Family District, Area Regulations, requires a 25 -
foot rear yard setback.

The applicant requested a variance of 12 -feet to this requirement at the
narrowest point near the northwest corner of the lot. If approved by the Board, it
would allow a garage addition with a minimum rear yard setback of 13 -feet at the
northwest corner of the lot.
Mr. Stombaugh explained that Staff found that there was a special condition,
specifically the angled rear property line precluded any reasonable addition to the
rear of the house without an encroachment into the rear yard. He explained that
Staff's recommendation of approval was contingent on the applicant attaching
the addition to the existing home and ensuring that the addition's exposed wall
covering matched that of the existing home.
Mr. Stombaugh explained that the Board denied a similar request from Mr.
Swyden at the January 7, 2002 meeting.
Johnny Swyden, applicant, of 2425 Whitney Lane, Grapevine, took the Oath of
Truth and explained that the concrete was existing, the garage would be bricked
to match the house and that his property backed up to Corp of Engineers
property. He explained that the Corp of Engineers had no problem with the
proposed addition.
With no one else to speak regarding the case, Jim Kelso made a motion to close
the public hearing. Debbie Holt seconded the motion which prevailed by the
following vote:
Ayes: Cook, Bruner, Kelso, Holt, Tomerlin
Nays: None
Absent: Hecht, Luers
Kip Bruner then made a motion that there was no special condition. Ron Cook
seconded the motion which prevailed by the following vote:
Ayes:
Bruner, Cook
Nays:
Kelso, Holt, Tomerlin
Absent:
Hecht, Luers
The motion failed due to lack of a majority vote.
Debbie Holt voiced concerns about the size of the addition and its proposed
location.
Mr. Swyden explained that the size of the proposed addition was needed for a
27 -foot long boat and the extra space was needed so his vehicles could be
driven into the existing garage.

There was discussion about using the east side of the house for the addition, but
Mr. Swyden explained that his electrical equipment and heating and air-
conditioning units were located on that side.
After further discussion, Carl Tomerlin made a motion that there was not a
special condition. Kip Bruner seconded the motion which prevailed by the
following vote:
Ayes: Cook, Bruner, Holt, Tomerlin
Nays: Kelso
Absent: Hecht, Luers
The variance was denied.
BOARD OF ZONING ADJUSTMENT CASE BZA02-19. PEMBERTON FINE
CUSTOM HOMES — 201 CENTRAL AVENUE
Next, the Board of Zoning Adjustment considered BZA02-19, submitted by
Richard Pemberton of Pemberton Fine Custom Homes for property located at
201 Central Avenue, platted as Lot 2R, Block A, Pemberton Addition. The
following request was from Grapevine Comprehensive Zoning Ordinance 82-73:
Section 16.H, "R-5.0" Zero Lot Line District, Buffer Area Regulations which
requires that all buildings in the "R-5.0" Zero Lot Line District be set back a
minimum of 40 -feet from the adjoining property line when located adjacent to an
existing multifamily district or a non-residential district.
The applicant requested a variance of five feet to this requirement and if
approved by the Board would allow a building setback of 35 -feet from the
adjoining non-residential zoning district to the south.
Mr. Stombaugh explained that Staff found that there was a special condition for
the requested variance, specifically, the lot was platted in which the applicant
proposed to place the proposed single family home as far north as possible on
the lot to minimize the encroachment into the buffer area.
Richard Pemberton, applicant, of 1701 Dunn Street, Grapevine, took the Oath of
Truth and explained that this lot had been replatted a year ago. He explained
that when the City widened Turner Street, some of the land was taken from the
north lot which reduced the square footage of both lots. Mr. Pemberton also
explained that the plans the property owner's had chosen would not fit on the lot
without a variance to the side yard on the south side.
Debbie Holt asked if the lot to the north would need a variance in the future. Mr.
Pemberton explained that it would not need a variance.

With no one else to speak for or against the request, Kip Bruner made a motion
to close the public hearing. Debbie Holt seconded the motion which prevailed by
the following vote:
Ayes: Cook, Bruner, Kelso, Holt, Tomerlin
Nays: None
Absent: Hecht, Luers
Kip Bruner made a motion that there was a special condition, specifically the lot
was platted in which the applicant proposed to place the proposed single family
home as far north as possible on the lot to minimize the encroachment into the
buffer area. Jim Kelso seconded the motion which prevailed by the following
vote:
Ayes: Cook, Bruner, Kelso, Holt, Tomerlin
Nays: None
Absent: Hecht, Luers
Kip Bruner then made a motion to grant the variance to Section 16.H., R-5.0,
Single Family District, Buffer Area Regulations, allowing a building setback of 35 -
feet from the adjoining non-residential zoning district to the south. Carl Tomerlin
seconded the motion which prevailed by the following vote:
Ayes: Cook, Bruner, Kelso, Holt, Tomerlin
Nays: None
Absent: Hecht, Luers

2002, Briefing Session and Public Hearing.
Jim Kelso made a motion to approve the minutes of the October 7, 2002, Briefing
Session. Debbie Holt seconded the motion which prevailed by the following vote:

Nays: None
Absent: Hecht, Luers
Ron Cook made a motion to approve the minutes of the October 7, 2002, Public
