Also present were City Council Representative Roy Stewart and the following City Staff: Scott Williams Betsy Dunham Gerrie Anderson CALL TO ORDER Building Official Plans Examiner/Office Coordinator Development Services Assistant Chairman Carl Hecht called the meeting to order at approximately 6:03 P.M. NEW BUSINESS BOARD OF ZONING ADJUSTMENT CASE BZA01-02 DEANA L. MORGAN 409 E. FRANKLIN STREET The first item for the Board of Zoning Adjustment to consider was BZA01-02, submitted by Deana Morgan for property located at 409 E. Franklin Street, platted as W. Part of Lot 8, Block 33, Original Town of Grapevine. The following request was from Grapevine Comprehensive Zoning Ordinance 82-73: Section 15.G.3., Single Family District Regulations, Area Regulations, which requires a six foot side yard. The applicant requested to allow alterations and additions to a property with an existing residence with a five foot side yard. Mr. Williams explained that there were special conditions, specifically the house was existing and all alterations and additions complied with the current ordinance. Mr. Williams explained that Ms. Morgan wished to enclose her Board of Zoning Adjustment 03/05/2001 garage, provide a drive to the rear of the property, and construct a detached garage. He explained that Staff would ensure that complying off-street parking would be provided before a final inspection would be issued for the garage enclosure. Mitchell Morgan of 409 E. Franklin Street, Grapevine, took the Oath of Truth. Deana Morgan of 409 E. Franklin Street, Grapevine, took the Oath of Truth. Ms. Morgan explained that they had not finished the garage enclosure and were unaware of a permit being required for the work. Mr. Morgan explained that the contractor, C. F. Wolf, of Keller, was no longer doing the work. Mr. Morgan apologized for not being aware of the requirements and expressed that he was thankful the City informed them of what was needed for the garage enclosure. Chairman Hecht explained that one letter of approval had been received. With no one else to speak regarding the case, Dennis Luers made a motion to close the public hearing. Kip Bruner seconded the motion which prevailed by the following vote: Ayes: Hecht, Luers, Cook, Bruner, Holt Nays: None Absent: Kelso After further discussion, Dennis Luers made a motion that there were special conditions, specifically the house was existing with a five foot sideyard setback, and all alterations and additions would comply with the current ordinance. Kip Bruner seconded the motion which prevailed by the following vote: Ayes: Hecht, Luers, Cook, Bruner, Holt Nays: None Absent: Kelso Dennis Luers then made a motion to grant the variance to Section 15.G.3, allowing alterations and additions to a property with an existing residence with a five foot sideyard. Kip Bruner seconded the motion which prevailed by the following vote: Ayes: Hecht, Luers, Cook, Bruner, Holt Nays: None Absent.- Kelso BOARD OF ZONING ADJUSTMENT CASE BZA01-03 MAGDALENA MALANOWSKI 1221 TERRACE DRIVE 2 Board of Zoning Adjustment 03/05/2001 The next item was for the Board of Zoning Adjustment to consider BZA01-03, submitted by Magdalena Malanowski for property located at 1221 Terrace Drive, platted as Lot 4, Block 8, Bellaire Addition. The following request was from Grapevine Comprehensive Zoning Ordinance 82-73: Section 43.E.3., Supplementary District Regulations which allows the Board to approve the remodeling of a nonconforming use. The applicant requested to allow an addition to be placed on an existing nonconforming residence. Mr. Williams explained that staff found that there were special conditions, specifically the structure was existing, and was built prior to the current ordinance requirements. He explained that the additions and alterations would comply with all current ordinance requirements. Magdalena Malanowski, applicant, of 1221 Terrace Drive, Grapevine, took the Oath of Truth and explained that she was a single mother and needed extra room for her family. Beth Livingston of 600 Frontier Court, Colleyville, Texas, and friend of Ms. Malanowski, took the Oath of Truth and explained that the add-on would be approximately 500 square feet. Chairman Hecht announced that one letter of approval had been received. With no one else to speak regarding the case, Kip Bruner made a motion to close the public hearing. Dennis Luers ICI Board of Zoning Adjustment 03/05/2001 seconded the motion which prevailed by the following vote: Ayes: Hecht, Luers, Cook, Bruner, Holt Nays: None Absent: Kelso BOARD OF ZONING ADJUSTMENT CASE BZA01-04 MARKO GRACAK 5315 GLADE LANE Next the Board of Zoning Adjustment considered BZA01-04, submitted by Marko Gracak for property located at 5315 Glade Lane, platted as Lot 9, Block 2, Glade Lane, Grapevine. The following requests were to Grapevine Comprehensive Zoning Ordinance 82-73: Section 42.C.3., Supplementary District Regulations which requires a 10 foot separation for accessory buildings from any dwelling. The applicant requested a five foot variance to this requirement, and if approved, would allow an accessory structure five feet from the residence. Section 42.C.3, Supplementary District Regulations also requires detached accessory structures to be six feet from side and rear property lines. The applicant requested to allow an accessory structure to be located two feet from the side property line. Mr. Williams explained that Staff found there was no special condition for the request. Mr. Marko Gracak, applicant of 5315 Glade Lane, Grapevine, took the Oath of Truth and explained that he would not have built the shed if he had known it was illegal. He explained that he needed a shed to house his pool equipment. He explained that the pump was five feet from the house and the heater for the pool was two feet -six inches from his neighbor's property line. Mr. Gracak stated that he came to the City and was told at the front counter that the structure would be "no problem". Mr. Williams explained that there was no violation with the setback of the pool equipment, only the structure was in violation. Mr. Williams stated that permit requirements for accessory structures have been posted at the front counter for many years and that his Staff was well aware of all permit requirements. He stated that Staff does not issue "approvals" without plans, and furthermore, no approvals are granted or implied until a permit is issued. Phyllis Catrucco, property owner of 5315 Glade Lane, took the Oath of Truth and explained that the pool was built by the time the house was finished in 1989. El Board of Zoning Adjustment 0310512001 There was discussion regarding the need for such a tall shed to house the pool equipment. Bob Ronk of 5319 Glade Lane, Grapevine, took the Oath of Truth, and explained that he was a neighbor to Mr. Gracak. He explained that Mr. Gracak did have problems with his pool equipment and that his intent when he built the shed was to protect the equipment. He explained that Mr. Gracak did add on to the shed to be able to store his lawn equipment. Chairman Hecht announced that one letter of approval and three letters of opposition had been received. With no one else to speak regarding the case, Dennis Luers made a motion to close the public hearing. Kip Bruner seconded the motion which prevailed by the following vote: Ayes: Hecht, Luers, Cook, Bruner, Holt Nays: None Absent: Kelso After further discussion, Ron Cook made a motion that there was no special condition and that the barn be relocated to another area that met the zoning regulations within 45 days from the date of the meeting. Debbie Holt seconded the motion which prevailed by the following vote: Ayes: Hecht, Luers, Cook, Bruner, Holt Nays: None Absent: Kelso MINUTES Next the Board of Zoning Adjustment considered the minutes of the February 5, 2001, meeting. Dennis Luers made a motion to approve the minutes of the January 8, 2001, meeting. Ron Cook seconded the motion, which prevailed by the following vote: Ayes: Hecht, Luers, Cook, Bruner, Holt Nays: None Absent: Kelso 5 Board of Zoning Adjustment 03/05/2001 STAFF REPORTS Mr. Williams informed the Board that Best Buy would open in another week, the grading had started at the Opryland site and that Opryland was projected to open in August, 2003. ADJOURNMENT Ron Cook made a motion to adjourn. Kip Bruner seconded the motion, which prevailed by the following vote: Ayes: Hecht, suers, Cook, Bruner, Holt Nays: None Absent: Kelso The meeting was adjourned at 6:50 P.M.
