The Board of Zoning Adjustment for the City of Grapevine, Texas, met in regular
session, Monday evening, May 7, 2001, at 6:00 P.M., in the Council Chambers,
200 South Main Street, Grapevine, Texas with the following members present:

Chairman Carl Hecht called the meeting to order at approximately 6:03 P.M.
NEW BUSINESS
The first item for the Board of Zoning Adjustment to consider was BZA01-06 and
BZA01-06A, submitted by Martin W. Schelling for property located at 120
Sycamore Drive, platted as Lot 1, Block 1, Silver Lake Estates and 200
Sycamore Drive, platted as future Lot 1, Block 5, Silver Lake Estates. The
following requests were from Grapevine Comprehensive Zoning Ordinance 82-
73 -
Section 42.C.3., Supplementary District Regulations, requires detached
accessory structures to be at least six feet from the rear property line.
The applicant requested accessory structures to be constructed within the six
foot rear setback.

Section 42.C.3., Supplementary District Regulations also requires accessory
structures to have the same sideyard setback as the main structure.
The applicant requested detached accessory structures to be built within the
required 15 foot sideyard.
Mr. Stombaugh explained that Staff found there were special conditions,
specifically the structures benefited the entire subdivision, and not any individual
property owner. He further explained that the structures, while on private
property, were not really "accessory' to the main residence on the lot.
Martin Schelling of 601 W. Wall Street, Grapevine, and applicant, took the Oath
of Truth and explained that the proposed subdivision entry features would be the
same design as the subdivision entry features that were located across the street
for the Silver Lake Addition. He explained that the structures would be
maintained by the homeowner's association.
With no one else to speak for or against the request, Dennis Luers made a
motion to close the public hearing. Kip Bruner seconded the motion which
prevailed by the following vote:

Hecht, Luers, Cook, Bruner, Kelso
Nays:

After further discussion, Dennis Luers made a motion that there were special
conditions, specifically the structures would benefit the entire subdivision, and not
any individual property owner. Kip Bruner seconded the motion which prevailed
by the following vote:

Dennis Luers then made a motion to grant the variances for 120 and 200
Sycamore Drive to Section 42.C.3., allowing accessory structures to be
constructed within the six foot rear setback and allowing detached accessory
structures to be built within the required 15 foot sideyard. Kip Bruner seconded
the motion which prevailed by the following vote:

Mr. Stombaugh explained that Staff recommended that the Board table BZA01-
10 to the June 4, 2001, meeting, due to an error in advertising.
Ron Cook made a motion to table BZA01-10 to the June 4, 2001, meeting. Kip
Bruner seconded the motion which prevailed by the following vote:

Hecht, Luers, Cook, Bruner, Kelso

BOARD OF ZONING ADJUSTMENT CASE BZA01-12 DANIEL M. AND LISA M.
GOODWIN 2412 LOS ROBLES DRIVE
The next item for the Board of Zoning Adjustment to consider was BZA01-12,
submitted by Daniel M. and Lisa M. Goodwin for property located at 2412 Los
Robles Drive, platted as Lot 1, Block 1, Rockbridge Addition. The following
request was from Grapevine Comprehensive Zoning Ordinance 82-73:
Section 13.A., Single Family District Regulations, Permitted Uses, which does
not permit fences as a primary use on the property.
The applicant requested to permit a fence to be constructed as a primary use on
a property.
Mr. Stombaugh explained that Staff found there were special conditions,
specifically the property was under the same ownership as the adjacent
residential use, and would function as a single property.
Matt Goodwin of 6000 Ridge Tree, Fort Worth, Texas and applicant, took the
Oath of Truth and showed the Board a plan of the property. He explained that
Memorial Baptist was on the south side of his property and the west side was
unprotected where he was getting heavy pedestrian traffic through his property.
Mr. Cook asked if it would be to Mr. Goodwin's advantage to fence off just east of
where the future Heritage Avenue would be constructed.
Mr. Goodwin explained that he wanted to fence off that part of the property to
keep pedestrian traffic off and to keep the property clean. He explained that he
would move the fence back when Heritage Avenue was constructed. Mr.
Goodwin also explained the different types of materials he would use for the
construction of the fence.

Chairman Hecht explained that two letters of approval and two letter of protest
had been received.
With no one else to speak regarding the case, Kip Bruner made a motion to close
the public hearing. Ron Cook seconded the motion which prevailed by the
following vote:
Ayes:
Hecht, Luers, Cook, Bruner, Kelso
Nays:
None
Absent:
None
After further discussion regarding the height of the fence, Kip Bruner made a
motion that there was a special condition, specifically the property was under the
same ownership as the adjacent residential use and would function as a single
property. Dennis Luers seconded the motion which prevailed by the following
vote:
Ayes: Hecht, Luers, Cook, Bruner
Nays: Kelso
Absent: None
Kip ~Bruner then made a motion to grant the variance to Section 13.A, allowing a
fence to be constructed as a primary use on a property. Dennis Luers seconded
the motion which prevailed by the following vote:
Ayes: Hecht, Luers, Cook, Bruner
Nays: Kelso
Absent: None
MINUTES
Next the Board of Zoning Adjustment considered the minutes of the April 2, 2001,
meeting.
Dennis Luers made a motion to approve the minutes of the April 2, 2001,
meeting. Ron Cook seconded the motion, which prevailed by the following vote:
Ayes:
Hecht, Luers, Cook, Bruner, Kelso
Nays:
None
Absent:
None
STAFF REPORTS
Mr. Williams informed the Board that footings had been poured and part of the
site work had been completed at the Opryland site.

prevailed by the following vote:
