" FA Amf ` .#'017 WILLIAMS)ING OFFICIAL/ASSISTANT DIRECTOR DEVELOPMENT STATE OF TEXAS COUNTY OF TARRANT CITY OF GRAPEVINE The Board of Zoning Adjustment for the City of Grapevine, Texas, met in regular session, Monday evening, June 4, 2001, at 6:00 P.M., in the Council Chambers, 200 South Main Street, Grapevine, Texas with the following members present: Carl Hecht Ron Cook Kip Bruner Jim Kelso Debbie Holt Carl Tomerlin Chairman Secretary Member Member 1 st Alternate 2nd Alternate constituting a quorum with Vice -Chairman Dennis Luers absent. Also present were City Council Representative Roy Stewart and the following City Staff: Scott Williams Ron Stombaugh Gerrie Anderson Building Official Planner II Development Services Assistant Chairman Carl Hecht called the meeting to order at approximately 6:00 P.M. NEW BUSINESS BOARD OF ZONING ADJUSTMENT CASE BZA01-10 GRAPEVINE RELIEF AND COMMUNITY EXCHANGE INC. 203 W. NASH STREET The first item for the Board of Zoning Adjustment to consider was BZA01-10, submitted by Grapevine Relief and Community Exchange, Inc., for property located at 203 W. Nash Street, legally described as Tract 7, Abstract 422, Grapevine. The following requests were from Grapevine Comprehensive Zoning Ordinance 82-73: Section 27.G, PO, Professional Office District Regulations, requires a 25 -foot rear yard. The applicant addition to an property line. requested a six-foot variance and if approved, would allow an existing building to be constructed within 19 feet of the rear Section 27.H., PO, Professional Office District Regulations, requires a buffer area Board of Zoning Adjustment 06/04/2001 - of 25 feet or twice the height of the building, whichever is greater, whenever a structure is built on property abutting a residential district. The applicant requested a maximum 11 -foot variance to this requirement, and if approved, would allow an addition to an existing building to be placed approximately 14 feet from the side property line and 19 feet from the rear property line. Section 43.E.3., Nonconforming Uses and Structures The applicant requested a special exception to allow the expansion of a nonconforming use. Mr. Williams explained that Staff found there was a special condition for Section 27.G., specifically the lot was only .59 acres (minimum lot size for residential multi -family is two acres) with limited area for an accessory building. He explained that Staff's recommendation was based on no opposition from neighbors. Mr. Williams then explained that Staff's recommendation of approval for Section 27.H., was conditional based on no opposition from neighbors. Mr. Williams explained that Staff found there was a special condition for Section 43.E.3, specifically the main structure and site were existing nonconforming, and that Staff's recommendation was based on no opposition from neighbors. Larry Lyons of 408 Smith Street, Grapevine, representing the case, took the Oath of Truth. Mr. Lyons explained about the addition and stated that the existing shed would be removed. With no one else to speak for or against the request, Kip Bruner made a motion to close the public hearing. Ron Cook seconded the motion, which prevailed by the following vote: Ayes: Hecht, Cook, Bruner, Kelso, Holt Nays: None Absent: Luers Kip Bruner then made a motion that there were special conditions for the following: Section 27.G., specifically the lot was only .59 acres with limited area for an accessory building. Section 27.H,, was conditional based on no opposition from neighbors. K Board of Zoning Adjustment 06/04/2001 Section 43.E.3., specifically the main structure and site was existing nonconforming. Ron Cook seconded the motion, which prevailed by the following vote: Ayes: Hecht, Cook, Bruner, Kelso Nays: None Abstain: Holt Absent: Luers Kip Bruner made a motion to approve the variances to Section 27.G., allowing an addition to an existing building to be constructed within 19 feet of the rear property line; Section 27.H., allowing an addition to an existing building to be placed approximately 14 feet from the side property line and 19 feet from the rear property line; Section 43.E.3., allowing the expansion of a nonconforming use. Jim Kelso seconded the motion, which prevailed by the following vote: Ayes: Hecht, Cook, Bruner, Kelso Nays: None Abstain: Holt Absent: Luers BOARD OF ZONING ADJUSTMENT CASE BZA01-14 DAVID GLENN 216 W. WALL STREET The next item was for the Board of Zoning Adjustment to consider Board of Zoning Adjustment Case BZA01-14, submitted by David Glenn for property located at 216 W. Wall Street. The following requests were from Grapevine Comprehensive Zoning Ordinance 82-73: Section 26.G.3 "HC" Highway Commercial District, Area Regulations, requires a 25 -foot front yard setback. The applicant requested a variance of 4 -feet to this requirement and if approved would allow a front yard setback of 21 -feet for an existing structure. Section 42.C.3 Supplementary District Regulations, Accessory Structures, mandates a minimum 6 -foot setback for accessory structures from the rear property line. The applicant requested a variance of 3 -feet to this requirement and if approved would allow a setback of 3 -feet from the rear property line for an existing accessory building. Section 53.H.2.b Landscaping Regulations, Perimeter Landscaping, requires a minimum 10 -foot landscaping buffer between the edge of a parking area and an 3 Board of Zoning Adjustment 06/04/2001 adjacent property line. The applicant requested a complete variance to this requirement along the east property line and if approved would allow no landscape buffer between the edge of the parking area and the adjacent property line to the east. Section 54, Masonry Requirements requires a minimum 70 percent masonry or material of equal characteristics, exclusive of doors and windows, on all buildings and structures within the "HC" Highway Commercial District. The applicant requested a complete variance to this requirement and if approved would allow the existing structure to remain without any masonry. Mr. Stombaugh explained that Staff found that there were special conditions for all requested variances, specifically, the main building, accessory structure, and parking area were all existing and that the site falls within the Historic Grapevine Township District boundary. Mr. Stombaugh explained that the Historic Preservation Commission had strongly encouraged that all structures within the area maintain their original appearance, and that the addition of a masonry product would severely detract from the historic significance of the structures. David Glenn, applicant of 1020 S. Main Street, Grapevine, took the Oath of Truth and added that he wanted to convert a nonconforming residence to a conforming use of the Highway Commercial Zoning District. With no one else to speak regarding the case, Kip Bruner made a motion to close the public hearing. Jim Kelso seconded the motion, which prevailed by the following vote: Ayes: Hecht, Cook, Bruner, Kelso, Holt Nays: None Absent: Luers Ron Cook made a motion that there were special conditions, specifically the main building, accessory structure, and parking area were all existing, and that the site fell within the Historic Grapevine Township District boundary. Kip Bruner seconded the motion, which prevailed by the following vote: Ayes: Hecht, Cook, Bruner, Kelso, Holt Nays: None Absent: Luers Ron Cook then made a motion to approve the variances to Section 26.G.3., allowing a front yard setback of 21 feet for an existing structure; Section 42.C.3., allowing a setback of three feet from the rear property line for an existing accessory building; Section 53.H.2.b., allowing no landscape buffer between the rd Board of Zoning Adjustment 06/04/2001 edge of the parking area and the adjacent property line to the east; and to Section 54, allowing the existing structure to remain without any masonry. Kip Bruner seconded the motion, which prevailed by the following vote: Ayes: Hecht, Cook, Bruner, Kelso, Holt Nays: None Absent: Luers BOARD OF ZONING ADJUSTMENT CASE BZA01-15 C. PAT DIFONZO 3539 RED BIRD LANE Next, the Board of Zoning Adjustment considered BZA01-15, submitted by C. Pat Difonzo for property located at 3539 Red Bird Lane, platted as Lot 2R, Block 1, Placid Peninsula. The following requests were from Grapevine Comprehensive Zoning Ordinance 82-73: Section 42.C.3 Supplementary District Regulations, Accessory Structures requires that an accessory building in a residential district be located on the rear one-half of the lot. The applicant requested a complete variance to this requirement and if approved would allow an existing accessory structure to remain and allow an expansion to the accessory structure within the front one-half of the lot. Mr. Stombaugh explained that Staff found that there was a special condition, specifically the topography of the site precluded the placement of the accessory structure within the rear one-half of the lot. Pat Difonzo, applicant, of 3539 Red Bird Lane, Grapevine, took the Oath of Truth and explained that he proposed to extend an addition onto the existing garage which would be used for storage and cars. With no one else to speak regarding the case, Jim Kelso made a motion to close the public hearing. Kip Bruner seconded the motion, which prevailed by the following vote: Ayes: Hecht, Cook, Bruner, Kelso, Holt Nays: None Absent: Luers Jim Kelso made a motion that there was a special condition, because a variance was required to alleviate the accessory structure on the rear half of the property. Kip Bruner made a motion to amend Jim Kelso's motion stating that there was a special condition, specifically because the topography of the site precluded the GV Board of Zoning Adjustment 06/04/2001 placement of the accessory structure within the rear one-half of the lot. Ron Cook seconded the motion, which prevailed by the following vote: Ayes: Hecht, Cook, Bruner, Kelso, Holt Nays: None Absent: Luers Jim Kelso then made a motion to grant the variance to Section 42.C.3., Supplementary District Regulations, allowing an existing accessory structure to remain and allow an expansion to the accessory structure within the front one- half of the lot. Ron Cook seconded the motion, which prevailed by the following vote: Ayes: Hecht, Cook, Bruner, Kelso, Holt Nays: None Absent: Luers BOARD OF ZONING ADJUSTMENT CASE BZA01-17 PACESETTER POOLS 308 APPLING DRIVE The last item of business for the Board of Zoning Adjustment to consider was BZA01-17, submitted by Pacesetter Pools for property located at 308 Appling Drive, platted as Lot 22R, Block 1, Banyan Place. The following request was from Grapevine Comprehensive Zoning Ordinance 82-73: Section 42.C.4 Supplementary District Regulations, Accessory Buildings, requires that a swimming pool be subject to the same side yard requirements as the principal structure. The applicant requested a variance of five feet to this requirement and if approved would allow a swimming pool within six feet of the side property line to the north. Mr. Stombaugh explained that Staff found that there were special conditions, specifically the size of the lot and the location of the existing single family residence precluded the placement of the pool in any other location other than the side yard to the north. He explained that the property was zoned "R-5.0" Zero -Lot -Line District and required an 11 -foot side yard to the north. He further explained that the side yard to the north had a depth of approximately 31 -feet at its narrowest point, and the six-foot access easement along the northern property line would be maintained. Vicki Wood, homeowner of 308 Appling Drive, Grapevine, took the Oath of Truth and explained that the pool would not encroach within the side yard easement. X Board of Zoning Adjustment 06/04/2001 -- With no one else to speak regarding the case, Debbie Holt made a motion to close the public hearing. Kip Bruner seconded the motion, which prevailed by the following vote: Ayes: Hecht, Cook, Bruner, Kelso, Holt Nays: None Absent: Luers Chairman Hecht announced that one letter of approval had been received. Debbie Holt made a motion that there were special conditions, specifically the size of the lot and the location of the existing single family residence precluded the placement of the pool in any other location other than the side yard to the north, and that the utility easements be maintained. Kip Bruner seconded the motion, which prevailed by the following vote; Ayes: Hecht, Bruner, Kelso, Holt Nays: Cook Absent: Luers Debbie Holt then made a motion to grant the variance to Section 42.C.4., allowing a swimming pool within six feet of the side property line to the north. Kip Bruner seconded the motion, which prevailed by the following vote: Ayes: Hecht, Bruner, Kelso, Holt Nays: Cook Absent: Luers MINUTES Next the Board of Zoning Adjustment considered the minutes of the May 7, 2001, meeting. Kip Bruner made a motion to approve the minutes, with corrections, of the May 7, 2001, meeting. Ron Cook seconded the motion, which prevailed by the following vote: Ayes: Hecht, Cook, Bruner, Kelso, Holt Nays: None Absent: Luers I Board of Zoning Adjustment 06/04/2001 STAFF REPORTS Mr. Williams informed the Board that Opryland was Ruth Wall would be closed down when Gaylord Trial was finished and a signal up. Then Ruth Wall will be rebuilt. Gaylord Trial would be main entrance into project. updated the Board regarding the Opryland project. ADJOURNMENT Kip Bruner made a motion to adjourn.
