IN ACCORDANCE WITH TEXAS GOVERNMENTCODE,A . 551.001 - • ACTS OF THE 1993 TEXAS LEGISLATURE, THE BOARD OF ZONING ADJUSTMENT MEETING AGENDA WAS PREPARED AND POSTED ON THIS THE 22ND DAY OF 11, AT 5:00 1\/;3, cli' tDIRECTOR DEVELOPMENT STATE OF TEXAS COUNTY OF TARRANT CITY OF GRAPEVINE The Board of Zoning Adjustment for the City of Grapevine, Texas, met in regular session, Monday evening, July 2, 2001, at 6:00 P.M., in the Council Chambers, 200 South Main Street, Grapevine, Texas with the following members present: Carl Hecht Chairman Dennis Luers Vice -Chairman Ron Cook Secretary Kip Bruner Member Debbie Holt 1 st Alternate Carl Tomerlin 2nd Alternate constituting a quorum with Member Jim Kelso absent. Also present were City Council Representative Sharron Spencer and the following City Staff: Ron Stombaugh Planner II Gerrie Anderson Development Services Assistant CALL TO -D • Chairman Carl Hecht called the meeting to order at approximately 6:02 P.M. Councilman Roy Stewart announced that Sharron Spencer would be the Board of Zoning Adjustment's new liaison. He thanked the Board for the excellent work they had done. Chairman Carl Hecht announced that on behalf of the Board, that they appreciated the job the City Council and Staff were doing. NEW BUSINESS :i�•� iiiIIIII07 • '� : �1 • '' •• e The first item for the Board of Zoning Adjustment to consider was BZA01-16, submitted by Frank Rolfe for property located at 1225 Lipscomb Street, legally described as Lot 5, Block 6, Grapevine Estates. The following request was from Grapevine Comprehensive Zoning Ordinance 82-73: Section 15.G.3, "R-7.5" Single Family District, Area Regulations, requires a side yard setback of six feet. Board of Zoning Adjustment 07/02/2001 The applicant requested a variance of two feet to this requirement along the west property line and a variance of four feet to this requirement along the east property line. If approved, it would allow a side yard setback of four feet along the west property line and a side yard of two feet along the east property line for an existing residence. Mr. Stombaugh explained that Staff found that there was a special condition for the requested variance, specifically, the existing house, built circa 1950, was constructed prior to the development of any zoning regulations within the City. Mr. Stombaugh explained that at their June 19, 2001 meeting, the City Council approved on the first reading of an ordinance, a zone change on the site rezoning .192 acres from "R -MH" Manufactured Home District to "R-7.5" Single Family District. He explained that the 2nd reading of the ordinance would be held Tuesday, July 3, 2001. Mr. Frank Rolfe, applicant, P.O. Box 515233, Dallas, Texas, took the Oath of Truth and explained that the only part being rezoned was where the house was located. With no one else to speak regarding the case, Kip Bruner made a motion to close the public hearing. Ron Cook seconded the motion which prevailed by the following vote: Ayes: Hecht, Luers, Cook, Bruner, Holt Nays: None Absent: Kelso Dennis Luers then made a motion that there was a special condition, specifically the existing house built circa 1950 was constructed prior to the development of any zoning regulations within the City. Kip Bruner seconded the motion which prevailed by the following vote: Ayes: Hecht, Luers, Cook, Bruner, Holt Nays: None Absent: Kelso Dennis Luers made a motion to grant the variance to Section 15.G.3, allowing a side yard setback of four feet along the west property line and a side yard of two feet along the east property line for an existing residence. Kip Bruner seconded the motion which prevailed by the following vote: Ayes: Hecht, Luers, Cook, Bruner, Holt Nays: None Absent: Kelso Board of Zoning Adjustment 07/0212001 BOARD OF ZONING ADJUSTMENT CASE BZA01-18 DAVID AND ELIZABETH STOWS 1020 W. GLADE ROAD The next item was for the Board of Zoning Adjustment to consider Board of Zoning Adjustment Case BZA01-18, submitted by David and Elizabeth Stowe for property located at 1020 W. Glade Road, legally described as Tracts 2A3A, 2A3B, and 2A3C, Abstract 440. The following request was from Grapevine Comprehensive Zoning Ordinance 82-73: Section 15.G.5, "R-7.5" Single Family District, Area Regulations, requires a minimum lot depth of 100 -feet. The applicant requested a variance of five feet to this requirement and if approved would allow a lot depth of 95 feet. Mr. Stombaugh explained that staff found a special condition, specifically, the subject site was constricted on all sides leaving no options for expansion to meet the requirements of the zoning ordinance. He explained that the City Council approved on the first reading of an ordinance, a zone change to rezone the subject site from "CN" Neighborhood Commercial District to "R-7.5", Single Family District in accordance with the surrounding zoning. Mr. Stombaugh explained that he would speak on behalf of the applicant, since this was a City initiated zone change. He explained that the property would have access to a cul-de-sac street which would be constructed by the property owner to the east. With no one else to speak regarding the request, Kip Bruner made a motion to close the public hearing. Dennis Luers seconded the motion which prevailed by the following vote: Ayes: Hecht, Luers, Cook, Bruner, Holt Nays: None Absent: Kelso Kip Bruner then made a motion that there was a special condition, specifically the subject site was constricted on all sides leaving no options for expansion to meet the requirements of the zoning ordinance. Dennis Luers seconded the motion which prevailed by the following vote: Ayes: Hecht, Luers, Cook, Bruner, Holt Nays: None -- Absent: Kelso 3 Board of Zoning Adjustment 07/02/2001 Kip Bruner made a motion to approve the variance to Section 15.G.5., R-7.5, Single Family District, Area Regulations, allowing a lot depth of 95 feet. Dennis Luers seconded the motion which prevailed by the following vote: Ayes: Hecht, Luers, Cook, Bruner, Holt Nays: None Absent: Kelso Next, the Board of Zoning Adjustment considered BZA01-19, submitted by Vahid Kharrazi / Trent Petty for property located at 2115 Ira E. Woods Avenue, platted as Lot 2, Block 1, DFW Business Park. The following requests were from Grapevine Comprehensive Zoning Ordinance 82-73: Section 25.G.3 "CC" Community Commercial District, Area Regulations, requires a front yard setback of not less than 25 -feet that shall be utilized as a landscaped area. The applicant requested a variance of five feet to this requirement and if approved would allow a front yard landscaped setback of 20 -feet. Section 60.H.5.a., Sign Regulations, for the "CC" Community Commercial District, Required Setback, which requires a minimum setback of ten feet from all property lines for on -premise signs. The applicant requested a variance of four feet to this requirement and if approved would allow a setback of six feet for an on -premise monument sign. Mr. Stombaugh explained that Staff found that there were special conditions for both requested variances, specifically the site provided no option for meeting the landscape setback requirement or the sign setback requirement because of a 10 - foot right-of-way taking along Ira E. Woods Avenue coupled with the need to maintain alignment of the cross -access drive through. He explained that the site did meet the overall open space/landscaped area requirement of twenty percent. Mr. Stombaugh further explained that at their June 19, 2001, meeting, the City Council approved on the first reading of an ordinance, a conditional use permit for automotive repair on the subject site. He explained there would be a final reading on Tuesday night, July 3, 2001. Trent Petty of 1021 Simmons Drive, Keller, representing the applicant, Vahid Kharrazi, took the Oath of Truth and explained that in discussions with the Staff, it was clear that maintaining the cross access drive alignment was necessary. He explained that Staff recommended we pursue the variance. M Board of Zoning Adjustment 07/02/2001 Chairman Carl Hecht announced that one letter of approval had been received. With no one else to speak regarding the request, Kip Bruner made a motion to close the public hearing. Ron Cook seconded the motion which prevailed by the following vote: Ayes: Hecht, Luers, Cook, Bruner, Holt Nays: None Absent: Kelso Debbie Holt made a motion that there were special conditions, specifically a 10 - foot right-of-way taking along Ira E. Woods Avenue coupled with the need to maintain alignment of the cross -access drive through, the site provided no option for meeting the landscape setback requirement or the sign setback requirement. Kip Bruner seconded the motion which prevailed by the following vote: Ayes: Hecht, Luers, Cook, Bruner, Holt Nays: None Absent: Kelso Debbie Holt then made a motion to approve the requests to Section 25.G.3., CC, Community Commercial District, Area Requlations, allowing a front yard landscaped setback of 20 -feet, and to Section 60.H.5.a., Sign Regulations, for the CC, Community Commercial District, Required Setback, allowing a setback of six feet for an on -premise monument sign to the north, along Ira E. Woods Avenue. Ron Cook made a motion to approve the minutes, with corrections, of the June 4, 2001, meeting. Kip Bruner seconded the motion, which prevailed by the following vote: Ayes: Hecht, Luers, Cook, Bruner, Holt Nays: None Absent: Kelso 5 Board of Zoning Adjustment 07/02/2001 STAFF REPORTS City Council Representative, Sharron Spencer announced that she was delighted to be the liaison for the Board of Zoning Adjustment and looked forward to working with the Board.
