Since there are no cases for the October 1, 2001, meeting, the dinner and
workshop will begin at 6:00 P.M. in the Planning and Zoning Conference Room.
Please note that this meeting is very important and is mandatory for all members
to attend.

CITY OF GRAPEVINE
The Board of Zoning Adjustment for the City of Grapevine, Texas, met on Monday evening,
October 1, 2001, at 6:00 P.M. in the Planning and Zoning Conference Room, 2nd Floor, 200
South Main Street, Grapevine, Texas, for a workshop with the following members present to
wit:

Constituting a quorum. Also present were City Council Representative Sharron Spencer,
Matthew Boyle, City Attorney and the following City Staff:
Scott Williams Building Official
Gerrie Anderson Development Services Assistant
Chairman Carl Hecht called the Workshop of the Board of Zoning Adjustment to order at
approximately 6:00 P.M.
NEW BUSINESS
WORKSHOP CONDUCTED BY MATTHEW BOYLE CITY ATTORNEY REGARDING
RULES AND PROCEDURES FOR THE BOARD OF ZONING ADJUSTMENT
Matthew Boyle, City Attorney, met with the Board of Zoning Adjustment regarding the Rules
and Procedures of the Board. Mr. Boyle passed out an Overview of Laws, Rules and
Regulations handout which included the following topics: Conflicts of Interest, Gifts to Public
Servants, Powers of the Board of Adjustment, Voting Procedures and Board Membership,
Variances, Four Elements to a Variance, Form of Motion to Approve or Deny a Variance,
Special Exceptions, and Non -Conforming Use. Mr. Boyle also passed out handouts on the
Duties of the Board of Zoning Adjustment and Findings -Variance.
Mr. Boyle elaborated on the following items:
Mr. Boyle recommended that if a Board member had a conflict of interest in a particular case,
that he not participate in the discussion of the case nor participate in any of the other cases
listed on the agenda. This would allow an alternate member to sit as a voting member for the
entire meeting. He recommended that the alternates not participate in any of the discussion
unless they were a voting member. Mr. Boyle encouraged members to drive by the property
but recommended that they not get out of their cars. He explained that if a board member
entered the property, they could have contact with the property owner or applicant which
would not be appropriate. Mr. Boyle also explained that a Board member should not accept a

call from anyone associated with the case because it could violate the sanctity of the public
hearing.
Council Liaison Sharron Spencer recommended that the Rules of Procedure be amended to
reflect Mr. Boyle's recommendation regarding the role of the alternates. She also addressed
the issue of conflict of interest, stating that it was important that board members avoid any
situation that even hinted at the appearance of being unethical.
Ms. Spencer told the Board that the Council was very proud of the great job they were doing.
ADJOURNMENT
After further discussion Jim Kelso made a motion to adjourn. Dennis Luers seconded the
motion which prevailed by the following vote:
Ayes: Hecht, Luers, Cook, Bruner, Kelso
Nays: None
Absent: None
The workshop was adjourned at 7:55 P.M.
