Also present were City Council Representative Sharron Spencer and the following City Staff: Scott Williams Building Official Ron Stombaugh Planner 11 John Robertson Civil Engineer Gerrie Anderson Development Services Assistant CALL TO ORDER Chairman Carl Hecht called the Briefing Session of the Board of Zoning Adjustment to order at approximately 6:00 P.M. NEW BUSINESS BRIEFING SESSION Mr. Williams and Mr. Stombaugh briefed the Board of Zoning Adjustment regarding the items scheduled to be heard in the regular public hearing. ADJOURNMENT After further discussion Jim Kelso made a motion to adjourn. ROLL CALL Chairman Hecht held roll call and announced that all members were present. NEW BUSINESS BOARD OF ZONING ADJUSTMENT CASE BZA01-29 JAMES P. KOESTERS 3911 W. T. PARR ROAD The first item was for the Board of Zoning Adjustment to consider BZA01-29, submitted by Mr. James Koesters, for property located at 3911 W. T. Parr Road and platted as Lot 5, Block 1, Woodland Estates. Mr. Stombaugh explained that Staff recommended the Board accept Staff's request to withdraw the variance requests. Mr. Stombaugh explained that after Board of Zoning Adjustment 12/03/2001 the request was advertised to the public it was determined that the variances were not needed. Dennis Luers made a motion to accept Staff's recommendation to withdraw the variance requests. Kip Bruner seconded the motion which prevailed by the following vote: Ayes: Hecht, Luers, Cook, Bruner, Kelso Nays: None Absent: None BOARD OF ZONING ADJUSTMENT CASE BZA01-30 PACESETTER POOLS (BOB HARDY), 3911 W. T. PARR ROAD The next item for the Board of Zoning Adjustment to consider was BZA01-30, submitted by Pacesetter Pools for property located at 2837 Placid Circle, platted as Lot 40R, Block 4, Placid Peninsula. The following request was from Grapevine Comprehensive Zoning Ordinance 82-73: Section 15.13; "R-7.5" Single Family District, Accessory Uses, requires that any accessory use detached from the principal single family dwelling shall be set back not less than 45 -feet from the front lot line. The applicant requested a variance of 34 -feet to this requirement for an in - ground spa and 33 -feet to this requirement for an attached in -ground swimming pool. If approved, it would allow a setback from the front lot line of 11 -feet for an in -ground spa, and a setback of 12 -feet for an in -ground swimming pool. Mr. Stombaugh explained that Staff recommended denial of the request. He explained that although the applicant submitted a letter from a professional engineer suggesting that the pool be allowed where it is presently located, it was Staff's opinion that no compelling data supported that suggestion. Mr. Stombaugh also explained that a review by a registered professional engineer employed by the City indicated that there were other locations on the lot where the pool could be located outside of the setback area. Mr. Bob Hardy of 455 Love Henry Court, Southlake, Texas, and applicant, took the Oath of Truth. He explained that the pool plan indicated that the pool was being located in the side yard on the additional lot that Mr and Mrs. Harroun owned and has been platted together. He explained that he was not aware of the problem because the building permit had been approved. Mr. Hardy also explained that the location of the culvert on the property and the slope of the land hindered the pool from being constructed somewhere else on the property. There was discussion that the original plot plan that was submitted with the building permit showed the pool being located in the rear yard. It was noted that 4 Board of Zoning Adjustment 12/03/2001 the plans did not show any indication of the pool being placed where it was actually constructed. Mr. Hardy explained that the pool was drawn on the plot plan by his permit runner who did not know the exact location of the pool. Melissa Harroun of 2837 Placid Circle and property owner, took the Oath of Truth. Ms. Harroun explained that she platted two lots into one so she could build the pool in the side yard. She explained that there was not enough room in the back yard due to a utility easement. She explained that she thought the pool would add to the beauty and uniqueness of the neighborhood. Joe Kerlee of 2821 Placid Circle, Grapevine, took the Oath of Truth and explained that the neighborhood was appealing because of its uniqueness. He explained that he approved of the request and felt that it would add to the value of the neighborhood. Rick Shultz of 2157 Steeplewood Drive, Grapevine, took the Oath of Truth. He explained that he wanted to give credibility to the applicant, Ms. Harroun. He explained that Ms. Harroun had always said that she desired the pool to be in the side yard so trees would not have to be removed. Adele Clason of 1109 Winding Creek Drive, Grapevine, took the Oath of Truth and explained that she was a friend of the applicant. Ms. Hopkins explained that Ms. Harroun had always intended to place the pool in the side yard. She also explained that it would not be seen from the street. John Robertson, Civil Engineer with the City of Grapevine, 1237 Bellaire Drive, Grapevine, took the Oath of Truth. He explained that the original location of the pool that was submitted with the building permit would work, but some trees would have to be removed and a retaining wall built. Mr. Robertson explained that there was a drainage swale on the property but there were other locations on the property where the pool could be placed. After further discussion Kip Bruner made a motion to close the public hearing. Jim Kelso seconded the motion which prevailed by the following vote: Ayes: Hecht, Luers, Cook, Bruner, Kelso Nays: None Absent: None There was discussion concerning the different plot plans submitted showing different locations of the pool. Chairman Hecht announced that three letters of approval had been received. 3 Board of Zoning Adjustment 12/03/2001 After further discussion, Kip Bruner made a motion that a special condition did not exist. Jim Kelso seconded the motion which prevailed by the following vote: Ayes: Hecht, Luers, Cook, Bruner, Kelso Nays: None Absent: None BOARD OF ZONING ADJUSTMENT CASE BZA01-31 G. RICHARD AND JO ANN GRANT 1833 SILVERSIDE DRIVE The next item for the Board of Zoning Adjustment to consider was BZA01-31, submitted by G. Richard and Jo Ann Grant for property located at 1833 Silverside Drive, platted as Lot 64, Shorecrest Acres. The following request was to Grapevine Comprehensive Zoning Ordinance 82-73: Section 15.G.5; "R-7.5" Single Family District Regulations requires the depth of a lot to be a minimum of 100 -feet. The applicant requested a variance of 15 -feet to this requirement and if approved would allow a lot depth of 85 -feet. Mr. Stombaugh explained that Staff found that a special condition did exist specifically, this lot was existing and was platted before the establishment of the current zoning regulations. Mr. G. Richard Grant, applicant of 2313 Aberdeen Drive, Bedford, Texas, took the Oath of Truth. He explained that he had been the property owner for 32 years and had a contract to sell the lot. He also expressed that the Board of Zoning Adjustment should have had the ability to waive the lot depth requirements for subdivisions that were non -conforming. Janet Chue of 1846 Anglers Plaza took the Oath of Truth and explained that she had put down earnest money in trying to buy the two lots. She explained that the lots did not meet current City zoning regulations. She explained that she had received wrong information and had started legal documentation asking for a refund of the earnest money. Chairman Hecht announced that three letters of protest and one letter of approval had been received. With no one else to speak regarding the case, Kip Bruner made a motion to close the public hearing. Ron Cook seconded the motion which prevailed by the following vote: Ayes: Hecht, Luers, Cook, Bruner, Kelso Nays: None Absent: None 112 Board of Zoning Adjustment 12/03/2001 Dennis Luers then made a motion that there was a special condition, specifically, the lot was existing and was platted before the establishment of the current zoning regulations. Kip Bruner seconded the motion which prevailed by the following vote: Ayes: Hecht, Luers, Cook, Bruner, Kelso Nays: None Absent: None Dennis Luers then made a motion to approve the variance to Section 15.G.5, R- 7.5, Single Family District Regulations, allowing a lot depth of 85 -feet. RICHARD AND JO ANN GRANT 1834 ANGLERS PLAZA The last item of New Business for the Board of Zoning Adjustment to consider was BZA01-32 submitted by G. Richard and Jo Ann Grant for property located at 1834 Anglers Plaza, platted as Lot 49, Shorecrest Acres, Grapevine. The following variance was to Grapevine Comprehensive Zoning Ordinance 82-73: Section 15.G.5; "R-7.5" Single Family District Regulations requires the depth of a lot to be a minimum of 100 -feet. The applicant requested a variance of 15 -feet to this requirement and if approved would allow a lot depth of 85 -feet. Mr. Stombaugh explained that Staff found that a special condition did exist specifically, this lot was existing and was platted before the establishment of the current zoning regulations. Mr. G.
