The Board of Zoning Adjustment for the City of Grapevine, Texas, met in regular
session, Monday evening, April 2, 2001, at 6:00 P.M., in the Council Chambers,
200 South Main Street, Grapevine, Texas with the following members present:

absent. Also present were City Council Representative Roy Stewart and the
following City Staff:

Chairman Carl Hecht called the meeting to order at approximately 6:02 P.M.
NEW BUSINESS
BOARD OF ZONING ADJUSTMENT CASE BZA01-05 GEORGE DALTON SR.
609 INDUSTRIAL BOULEVARD
The first item for the Board of Zoning Adjustment to consider was BZA01-05,
submitted by George Dalton, Sr., for property located at 609 Industrial Boulevard,
platted as Lot 5, Grapevine Industrial Park. The following requests were from
Grapevine Comprehensive Zoning Ordinance 82 -73 -
Section 31.G.4 Area Regulations requires a fifteen -foot side yard setback.
The applicant requested a variance of seven feet - six inches to this requirement
and if approved would allow the existing structure to remain, as shown on the site
plan.
Section 54, Masonry Requirements, requires all principal buildings and structures
located in the "LI" Light Industrial Zoning District to have at least seventy percent
of the total exterior walls, excluding doors and windows, constructed of brick,
stone, fiber reinforced cementitious board or other masonry.

The applicant requested a variance of 100 percent to this requirement and if
approved would allow no masonry coverage for the existing structure, as shown
on the site plan
Mr. Stombaugh explained that there were special conditions for all requests, as
the site was existing. He explained that the existing structure was built before
the current zoning regulations.
Jean Dalton of 1206 Ashmore Court, Southlake, took the Oath of Truth and
explained that she was representing her husband who was out of town. Ms.
Dalton explained that there would be landscaping in the front of the building and
that all parking would be between the current building and the proposed building.
She explained that the new structure would look similar to the present building.
She explained that the new building would comply with all the current
requirements.
With no one else to speak regarding the case, Jim Kelso made a motion to close
the public hearing. Debbie Holt seconded the motion which prevailed by the
following vote'.
Ayes: Hecht, Luers, Cook, Kelso, Holt
Nays: None
Absent: Bruner, Tomerlin
Next, Dennis Luers made a motion that there were special conditions, specifically
the site was existing and was built before the current zoning regulations. Ron
Cook seconded the motion which prevailed by the following vote:
Ayes- Hecht, Luers, Cook, Kelso, Holt
Nays: None
Absent: Bruner, Tomerlin
Dennis Luers then made a motion to approve the variances to Section 31.G.4.,
Area Regulations, allowing the existing structure to remain, as shown on the site
plan, and to Section 54, Masonry Requirements, allowing no masonry coverage
for the existing structure as shown on the site plan. Debbie Holt seconded the
motion which prevailed by the following vote:
Ayes: Hecht, Luers, Cook, Kelso, Holt

The next item for the Board of Zoning Adjustment to consider was BZA01-07,
submitted by Michael D. Addison for property located at 420 Lucas Drive, platted
as Lot 1, Block 3, W. C. Lucas Addition. The following request was from
Grapevine Comprehensive Zoning Ordinance 82-73:
Section 43.E., Nonconforming Uses and Structures, allows the Board of Zoning
Adjustment to approve the remodeling of a nonconforming use.
The applicant requested to allow an addition to a nonconforming residence that
did not comply with the side yard setback and accessory building regulations.
Mr. Stombaugh explained that Staff found there was a special condition,
specifically the residence and accessory buildings were existing.
Michael Addison of 420 Lucas Drive, Grapevine, and applicant, took the Oath of
Truth and explained that he wished to add-on to the back of his residence and
that the additions would be built within the zoning regulations.
After some discussion, Dennis Luers made a motion to close the public hearing.
Debbie Holt seconded the motion which prevailed by the following vote:
Ayes: Hecht, Luers, Cook, Kelso, Halt
Nays: None
Absent: Bruner, Tomerlin
Jim Kelso made a motion that there was a special condition, specifically the
residence and accessory building were existing. Dennis Luers seconded the
motion which prevailed by the following vote:
Ayes: Hecht, Luers, Cook, Kelso, Holt
Nays: None
Absent: Bruner, Tomerlin
Jim Kelso then made a motion to approve the special exception to Section 43.E.,
Nonconforming Uses and Structures, allowing an addition to a nonconforming
residence that does not comply with the side yard setback and accessory
building regulations. Dennis Luers seconded the motion which prevailed by the
following vote:

Mr. Stombaugh explained that the City Attorney determined that no variances
were required and recommended the Board accept Staff's recommendation to
withdraw the case. He explained that if the applicant constructed any buildings in
the future, he would have to request a variance.
Dennis Luers made a motion to accept Staff's recommendation to withdraw the
case. Ron Cook seconded the motion which prevailed by the following vote:
Ayes: Hecht, Luers, Cook, Kelso, Holt

BOARD OF ZONING ADJUSTMENT CASE BZA01-09, CIRRUS -GRAPEVINE
III, L.P. C/O W. L. HUTCHISON, 3400 WILLIAM D. TATE AVENUE
Next, the Board of Zoning Adjustment considered BZA01-09, submitted by
Cirrus -Grapevine III, L.P., c/o W. L. Hutchison for property located at 3400
William D. Tate Avenue, platted as Lot 1, Block 1, Grapevine III Addition. The
following request was from Grapevine Comprehensive Zoning Ordinance 82 -73. -
Section 25.M.4., CC, Community Commercial District Regulations, Design
Requirements states that whenever a "CC" Community Commercial District is
adjacent to any residentially zoned district, a buffer strip, at least 20 -feet in width
shall be provided between the two districts. A wall, fence, or berm at least six -
feet in height shall be erected to effectively screen the "CC" Community
Commercial District from the residential area and no streets, alley, vehicular
storage or use shall be permitted in the required buffer strip.
The applicant requested a complete variance to the requirement for a wall, fence,
or berm at least six -feet in height to screen the "CC" Community Commercial
District from the "R-20" Single Family District to the north. If approved by the
Board, there would be no screening provided by a wall, fence, or berm between
the two properties.
Mr. Stombaugh explained that Staff found that a special condition existed,
specifically the topography of the site and the lot configuration with the heavily
wooded creek along the northern property line adjacent to the "R-20" Single
Family District property made the screening fence inconsequential. He explained
that Staff's recommendation for approval was conditional based on input from
property owners within the 200 -foot notification zone.
Gary McCollough, representing the applicant, Cirrus — Grapevine 11, L.P., 1700
Pacific Avenue, Suite 2730, Dallas, Texas, took the Oath of Truth. He explained

the location of the flood area and the location of existing trees on both sides of
the creek line, which they did not want to remove. Mr. McCollough explained that
there would be a security issue if a fence were constructed around the site.
Mr. Stombaugh explained that the building would have a basement and may
resemble a two-story, but would not be classified as a two-story.
Phala Helm of 2701 Wooded Trail Court, Grapevine, took the Oath of Truth and
explained that she had owned the 10 acres that abutted the property for 10
years. She explained that she had no objection to the variance for the south
portion of the land.
Johnny McDonald of 2600 Pinon Court, Grapevine, took the Oath of Truth and
asked about the location of the property line and location of the fence.
With no one else to speak either for or against the request, Ron Cook made a
motion to close the public hearing. Debbie Holt seconded the motion which
prevailed by the following vote:
Ayes: Hecht, Luers, Cook, Kelso, Holt
Nays: None
Absent: Bruner, Tomerlin
Debbie Holt then made a motion that there was a special condition, specifically
the topography of the site formed a natural barrier along the northern property
line, adjacent to the R-20, Single Family District. Dennis Luers seconded the
motion which prevailed by the following vote:
Ayes: Hecht, Luers, Cook, Kelso, Holt
Nays: None
Absent: Bruner, Tomerlin
Debbie Holt made a motion to grant the variance to Section 25.M.4., allowing no
screening provided by a wall, fence, or berm between the R-20, Single Family
District Regulations and the CC, Community Commercial District. Dennis Luers
seconded the motion which prevailed by the following vote:
Ayes: Hecht, Luers, Cook, Kelso, Holt

Ron Cook made a motion to approve the minutes of the March 5, 2001, meeting.
Dennis Luers seconded the motion, which prevailed by the following vote:

STAFF REPORTS
Mr. Stombaugh informed the Board that Opryland would have 1,508 rooms and
301,000 square feet of conference room space, and that the Cowboy Golf
Course was scheduled to open April 18, 2001 if the landscaping issue was
resolved.
Ron Cook made a motion to adjourn. Kip Bruner seconded the motion, which
prevailed by the following vote:
Ayes- Hecht, Luers, Cook, Kelso, Holt
Nays: None
Absent: Bruner, Tomerlin
