NEW BUSINESS Mr. Stombaugh briefed the Board of Zoning Adjustment regarding the item scheduled to be heard in the regular public hearing. ADJOURNMENT With no further discussion, Ken White made a motion to adjourn. John Sheppard seconded the motion which prevailed by the following vote: Ayes. PUBLIC HEARING BOARD OF ZONING ADJUSTMENT CASE BZA17-13, ROBERT PRUETT, 1250 WILLIAM Q. TATE AVENUE #350 The first item for the Board of Zoning Adjustment to consider was BZA1 7-13 submitted by Robert Pruett for property located at 1250 William D. Tate Avenue, platted as Lot 2, Block 1, Towne Center Addition No.2. Section 43.E.3, Nonconforming Uses and Structures allows the Board of Zoning Adjustment to approve the remodeling and/or enlargement of a nonconforming use. The applicant requested a special exception allowing the existing non-residential structure to remain as developed in addition to site improvements as shown on the site plan. Mr. Stambaugh explained that Staff found a special condition existed for the special exception request. Specifically, the subject site was an existing developed lot, and the existing non-residential structure and site was in complete compliance under the established guidelines at the time (Ord. 70-10). Developed in 1980, the site was now noncompliant with the current zoning ordinance (82-73) relative to open space, impervious coverage, front, rear and side yard setbacks and landscaping requirements. Mr. Stombaugh stated that a conditional use requested for a second hands goods store that occupied less than 10,000 square feet went before City Council on October 17, 2017 and approved on first reading, and if approved by this Board would be taken back to Council for a second reading on November 21, 2017. To make improvements to the site, the applicant had agreed to remove the existing non-conforming pole sign and replace it with a conforming pole sign of 20 feet in height and 108 square feet in size, and removal of approximately 2,800 square feet of asphalt and replace with landscaping. With no questions for Mr, Stombaugh, Robert Pruett of 14800 Quorum Drive #200, Callas, Texas, took the Oath of Truth; he gave a brief presentation to the Board and requested favorahle consideration of his request and offered to answer any questions of the Board. -1 - Y With no questions for Mr. Pruett, and no additional speakers, Ken White made a motion to close the public hearing. Tracey Dierolf seconded the motion which prevailed by the following vote: Ayes: Holt, White, Dierolf, Sheppard Nays: None Absent- Dalton Ken White made a motion that a special condition existed for the requested special exception. Tracey Dierolf seconded the motion which prevailed by the following vote: Ayes: Holt, White, Dierolf, Sheppard Nays: None Absent: Dalton NEW BUSINESS Next the Board of Zoning Adjustment considered the approval of the 2018 Meeting Agenda Schedule. 2 Board of Zoning Adjustment 11/6/17 John Sheppard made a motion to accept the 2018 Meeting Agenda Schedule with September meeting date changed to September 10th due to holiday. Ken White seconded the motion which prevailed by the following vote: Ayes: Holt, White, Dierolf, Sheppard Nays: None Absent: Dalton MINUTES Next the Board of Zoning Adjustment considered the minutes of the October 2, 2017, Briefing Session and Public Hearing, Tracey Dierolf made a motion to accept the minutes of the October 2, 2017, Briefing Session. Ken White seconded the motion, Ayes: Holt, White, Dierolf, Sheppard Nays: None Absent: Dalton Tracey Dierolf made a motion to accept the minutes of the October 2, 2017, Public Hearing.
