This letter confirms on November 6, 2017, the Board of Zoning Adjustment approved the
following request:
Section 43.E.3, Nonconforming Uses and Structures allows the Board of Zoning
Adjustment to approve the remodeling and/or enlargement of a nonconforming use.
The Board approved a special exception allowing the existing non-residential structure to
remain as developed in addition to site improvements as shown on the plot plan.

RECOMMENDATION:
Staff recommends the Board of Zoning Adjustment approve the following special
exception to the Grapevine Comprehensive Zoning Ordinance 82-73 for property located at
1250 William D. Tate Avenue, #350, platted as Lot 2, Block 1, Towne Center Addition No.2
as follows:
Section 43.E.3, Nonconforming Uses and Structures allows the Board of Zoning
Adjustment to approve the remodeling and/or enlargement of a nonconforming use.
The applicant is requesting a special exception to allow the existing non-residential
structure to remain as developed in addition to site improvements as shown on the site
plan.
SPECIAL CONDITION:
Staff finds that a special condition exists for the special exception request. Specifically, the
subject site is an existing developed lot, and the existing non-residential structure and site
was in complete compliance under the established guidelines at the time (Ord. 70-10).
Developed in 1980, the site is now noncompliant with the current zoning ordinance (82-73)
relative to open space, impervious coverage, front, rear and side yard setbacks and
landscaping requirements.
BACKGROUND INFORMATION:
The property is currently zoned "CC" Community Commercial District and is developed as
an 85,600 square foot multi -tenant structure. The proposed use of retail sales of second
hand goods in an enclosed building in excess of 3,000 square feet (Angel's Attic) and a
new 20 -foot pole sign necessitated a conditional use application and a special exception
request. Angel's Attic is proposing to relocate from their current site located at 1635 West
Northwest Highway. The applicant also proposes removal of an existing pole sign from the
subject site and replacing it with a multi -tenant pole sign 20 -feet in height. Additional

improvements to the site include removing existing asphalt and adding approximately
2,800 square feet of open space in the form of ground cover adjacent to William D. Tate
Avenue.
On October 17, 2017 the City Council approved on first reading of an ordinance, the
conditional use application to allow retail sales of secondhand goods in an enclosed
building where the size of the space exceeds 3,000 square feet and a 20 -foot pole sign.
The second reading of the ordinance for the subject site is scheduled to be considered by
the Council of November 21, 2017. The application was submitted by Robert Pruett.

E. CHANGING NONCONFORMING USES:
Any nonconforming use may be changed to a conforming use, and once
such change is made, the use shall not thereafter be changed back to a
nonconforming use.
2. The Board of Adjustment may grant a change of use from one
nonconforming use to another nonconforming use provided such change is
to a use permitted in a zoning district where the original nonconforming use
would be permitted, or provided that such change is to a use permitted in a
more restrictive classification. However, such change of use and occupancy
shall not tend to prolong the life of a nonconforming use. Upon review of the
facts in accordance with Section 67A, the Board of Adjustment may establish
a specific period of time for the return of the occupancy to a conforming use.
• 3. The Board of Adjustment may approve the remodeling or enlargement of a
nonconforming use when such an enlargement would not tend to prolong the
life of the nonconforming use. Upon review of the facts, the Board of
Adjustment may establish a specific period of time for the return of the
occupancy to a conforming use.
F. LIMITATIONS ON CHANGING NONCONFORMING USES: No nonconforming use
shall be changed to another nonconforming use, which requires more off-street
parking spaces or off-street loading space than the original nonconforming use,
unless additional off-street parking and loading space is provided so as to comply
with the requirements of Sections 55 and 56.
The number of dwelling units or rooms in a nonconforming residential use shall not
be increased so as to exceed the number of dwelling units or rooms existing on the
effective date of this Ordinance.
No nonconforming use may be expanded or increased beyond the lot or tract upon
which such nonconforming use is located as of the effective date of this ordinance
except to provide off-street loading or off-street parking space upon approval of the
Board of Adjustment.
All nonconforming uses being expanded underthe provisions of this Ordinance shall
comply with the other applicable provisions of this Ordinance.
G. TERMINATION OF NONCONFORMING STRUCTURES:
In the event of damage or destruction of a nonconforming structure to the
