will be placed on the agenda for public hearing at the discretion of the staff. Based on the size
of the agenda, your application may be scheduled to a later date.

Public hearings may be continued to the next public hearing. Public hearings is be

Any changes to a site plan (no matter how minor or major) approved with a conditional use or
a special use permit can only be approved by city council through the public hearing process.
Any application for a change in zoning or for an amendment to the zoning ordinance shall
have, from the date of submittal, a period of four months to request and be scheduled on an
agenda before the Planning and Zoning Commission and City Council. If after said period of
four months an application has not been scheduled before the Commission and Council said
application shall be considered withdrawn, with forfeiture of all riling fees. The application,
along with the required riling fee may be resubmitted any time thereafter for reconsideration.
Delays in scheduling applications before the Planning and Zoning Commission and City
Council created by city staff shall not be considered a part of the four month period

DFW International Airport cannot support Mr. DiGiovanni's request submitted
under SU05-03. If granted, this request would permit the construction of
church facilities within the 65 LdN and the 75 LcIN noise contours of the Airport.
Current Federal Administration (FAA) indicate that such facilities are compatible
only if constructed to achieve 25-30 dBA Noise Level Reduction between the
exterior and the interior of the proposed structure. See DFW Noise
Compatibility Office Report attached hereto as Exhibit "B".
However, in the event the City determines that this project and its location are
in the City's best interest, the Airport strongly recommends officials take the
following actions:
+ Require that the building's shells be designed to yield a minimum noise
reduction of 25 — 30 dB, and that a professional engineer licensed in the
State of Texas certify design plans to that affect.
+ The applicant grant an avigation easement over the property naming
DFW International Airport Board, the Cities of Dallas and Fort Worth and
the City of Grapevine as grantees as a condition of approval of the
Special Use Permit.
+ City of Grapevine inform all parties that the site would not be eligible for
any noise mitigation assistance from DFW now or in the future.
+ Contact the Federal Aviation Administration for the purpose of Air Space
Regulations regarding planned use.

NOTES FOR TABLE 1
(1) Where the community determines that residen-
tial or school uses must be allowed, measures to
achieve outdoor to indoor Noise Level Reduction
(NLR) of at least 25 dB and 30 dB should be in-
corporated into building codes and be considered
in individual approvals. Normal residential con-
struction can be expected to provide a NLR of 20
dB, thus, the reduction requirements are often
stated as 5,10 or 15 dB over standard construc-
tion and normally assume mechanical ventilation
and closed windows year round. However, the
use of NLR criteria will not eliminate outdoor
noise problems.
(2) Measures to achieve NLR of 25 dB must be in-
corporated into the design and construction of
portions of these buildings where the public is
received, office areas, noise sensitive areas or
where the normal noise level is low.
(3) Measures to achieve NLR of 30 dB must be in-
corporated into the design and construction of
portions of these buildings where the public is
received, office areas, noise sensitive areas or
where the normal noise level is low.
(4) Measures to achieve NLR of 35 dB must be in-
corporated into the design and construction of
portions of these buildings where the public is
received, office areas, noise sensitive areas or
where the normal noise level is low.
(5) Land use compatible provided special sound
reinforcement systems are installed.
(6) Residential buildings require an NLR of 25.
(7) Residential buildings require an NLR of 30.

$ A150.103 Use of computer prediction model.
(a) The airport operator shall acquire the avia-
tion operations data necessary to develop noise
exposure contours using an FAA approved meth-
odology or computer program, such as the In-
tegrated Noise Model (ROI). In considering
approval of a methodology or computer program,
key factors ln&ude the demonstrated capability
to produce the required output and the public
availability of the program or methodology to
provide interested parties the opportunity to
substantiate the results.
(b) The following information must be ob-
tained for inpft to the calculation of noise ex-
posure contows:
(1) A map of the airport and its environs at
an adequately detailed scale (not less than 1
inch to 8,000 feet) indicating runway length,
alignments, landing thresholds, takeoff start -
of -roll points, airport boundary, and flight

tracks out to at least 30,000 feet from the, end
of each runway.
(2) Airport activity levels and operational
data which will indicate, on an annual average -
daily -basis, the number of aircraft, by type of
aircraft, which utilize each flight track, in both
the standard daytime (0700- 2200 hours local)
and nighttime (2200-0700 hours local) periods
for both landings and takeoffs.
(3) For landings—glide slopes, glide slope in-
tercept altitudes, and other pertinent informa-
tion needed to establish approach profiles
along with the engine power levels needed to
fly that approach profile.
(4) For takeoffs—the flight profile which is
the relationship of altitude to distance from
start -of -roll along with the engine power levels
needed to fly that takeoff profile; these data
must reflect the use of noise abatement depar-
ture procedures and, if applicable, the takeoff
weight of the aircraft or some proxy for weight
such as stage length.
(5) Existing topographical or airspace
restrictions which preclude the utilization of
alternative flight tracks.
(6) The government furnished data depict-
ing aircraft noise characteristics (if not already
a part of the computer program's stored data
bank).
(7) Airport elevation and average tempera-
ture.
§ A150.105 Identification of public agencies
and planning agencies.
(a) The airport proprietor shall identify each
public agency and planning agency whose
jurisdiction or responsibility is either wholly or
partially contained within the Ldn 65 dB bound-
p'y.
(b) For those agencies identified in (a) that
have land use planning and control authority, the
supporting documentation shall identify their
geographic area of jurisdiction.

In response to the notice provided by the City of Grapevine regarding an application for a Special
Use Permit to allow the development of the 121 Community Church, I offer the following concerns
and comments for inclusion in your response:
The proposed use, a church facility, is requested to be located at 830 Mustang Drive. This area is
inside the 65-75 DNL (also referred to as Zone B) as shown on the Airport's official noise contour,
and on Grapevine's GIS maps. The site is shown on the attached excerpts from the City's and
Airport's GIS databases. According to the Federal Aviation Administration's (FAA's) Land Use
Compatibility Guidelines, a church is considered compatible in the 65-75 DNL only if it has been
designed and built to achieve an outdoor to indoor Noise Level Reduction (NLR) of 25-30 dB.
The site is located just over 1/z mile from the end of Runway 13R/31 L, the west diagonal runway and
at less than 1/z mile from the Runway's extended centerline. The site is also less than 2 miles from
the thresholds of the two primary western runways and is subject to overflights by non jet aircraft
departing from those runways. The site is subject to routine and regular air traffic by all types of
aircraft operating at DFW International Airport. Historical flight data indicates that jet aircraft
arriving at Runway 13R operate adjacent to the property as low as 150 feet above the ground.
The City should consider these facts in its decision making process. If it is decided that it is in the
best interest of the City to approve this project, I recommend that the City take the following
actions:
1. Require that the building shell be designed to yield a minimum noise reduction of 25-30 dB, and
that a professional engineer licensed in the State of Texas certify the plans to that effect;
2. Require the applicant to grant an avigation easement over the property naming the City of
Grapevine, the Dallas -Fort Worth International Airport Board, and the Cities of Dallas and Fort
Worth; and
3. Require that the applicant contact the FAA for the purpose of determining height restrictions or
other limitations in accordance with Air Space Regulations.

The subject property is located at 830, 840, and 860
Mustang Drive and is platted as Lot 10A, Block 6,

8.0534 acres and has approximately 786 feet of
frontage along Mustang Drive
REQUESTED SPECIAL USE AND COMMENTS:
The applicant is requesting a special use permit to allow a church facility in a nonresidential
zoning district.
The 121 Community Church proposes to lease the subject site as the new location for its
church services and programs. With a congregation/sanctuary of approximately 750
persons, parking requirements will be 250 spaces. There are currently 236 spaces on site,
but with church services taking place at off-peak times for the area, coupled with the
permission of the adjacent property owner to the east, Mr. Rick Stacy, to utilize up to 100
spaces if necessary, all parking requirements for the church have been met. See the
attached letters.
PRESENT ZONING AND USE:
The property is currently zoned "BP" Business Park District and is under development.

HISTORY OF TRACT AND SURROUNDING AREA:
The subject property and adjacent areas were rezoned in the 1984 City Rezoning from "I-1"
Industrial District to "PID" Planned Industrial Development District. The property at the
southwest comer of South Main Street and the frontage road of State Highway 114 West
was rezoned in 1985 to "CC" Community Commercial. The five lots to the east, between
this property and Main Street, have received conditional use permits for the Planned
Commercial Center of Metroplace, Second Installment to allow alcoholic beverages sales
in conjunction with restaurant developments: EI Fenix Mexican Restaurant (CU93-16),
Tony Roma's (CU94-12), China Coast (CU94-23), Olive Garden (CU94-24) and Landry's
Crab Shack (CU95-19). A special use permit was approved for the Cinemark Theater for
video games (SU94-02). The property to the east was has a conditional use permit (CU97-
08, Ord. 97-84) for an auto dealership with new and used car sales and a thirty-two (32)
foot pole sign. Conditional Use Permit CU97-54 was approved allowing the amendment
of the approved site plan of CU97-08 (Ord. 97-84) for an auto dealership with new and
used car sales and a thirty-two (32) foot pole sign, specifically to reconfigure and relocate
buildings, the addition of off-street and display parking; the site was again modified by
CU99-07 approved at the March 16, 1999 meeting. Conditional Use Request CU01-06
was approved at the March 20, 2001 meeting and allowed for an automotive sale and
service business dedicated to the Corvette automobile. At their June 19, 2001 meeting the
City Council approved a rezoning of the subject site (Z01-10) rezoning the property from
"CC" Community Commercial District to "BP" Business Park District for warehouse
development. At Council's August 17, 2004 meeting, a conditional use permit was
approved for an indoor commercial amusement developed as a concept called "Pump It
Up'—a children -based indoor facility for parties by appointment only.

such as auditoriums, churches, schools, hospitals, and theaters. The applicant's proposal
