when filed and will be placed on the agenda for public hearing at the discretion of
the staff. Based on the size of the agenda, your application may be scheduled to a
later date.
All public hearings will be opened and testimony given by applicants and
interested citizenry. Public hearings may be continued to the next public hearing.
Public hearings will not be tabled.
Any changes to a site plan (no matter how minor or major) approved with a
conditional use or a special use permit can only be approved by city council
through the public hearing process.
Any application for a change in zoning or for an amendment to the zoning
ordinance shall have, from the date of submittal, a period of four months to
request and be scheduled on an agenda before the Planning and Zoning
Commission and City Council. If after said period of four months an application
has not been scheduled before the Commission and Council said application shall
be considered withdrawn, with forfeiture of all filing fees. The application, along
with the required filing fee may be resubmitted any time thereafter for
reconsideration. Delays in scheduling applications before the Planning and
Zoning Commission and City Council created by city staff shall not be considered
a part of the four month period.

2. On the site plan sheet please dimension the distance of the proposed
outdoor dining area to the north and east property lines.
3. Please add the following note to the site plan stating the purpose of the
conditional use and special use requests:
a) Conditional use request CU09-01 is a request to amend the
previously approved site plan of CU03-17, CU03-12 (Ord.03-31) for
a planned commercial center with the possession, storage, retail
sale and on -premise consumptions of alcoholic beverages (beer,
wine and mixed drinks), specifically for the addition of an 890
square outdoor covered patio. Special use permit request SU09-01
is a request to allow one pool table and two arcade games in
conjunction with a restaurant.
b) The entire site is the premises.
4. The proposed covered patio will require a fire sprinkler system. Please
contact Craig Reed at (817) 410-8100 for questions regarding sprinkler
systems.
5. Please add the traffic circulation plan to the site plan and revise the
proposed pavement on the master site plan to existing.
6. The required parking based upon the occupancy is 106 spaces. Please
revise the project data table, site data table and the description letter
accordingly.
7. Please label the location of the two arcade games on the floor plan. As
requested below, the final submittal will require an 11 "x17" reduction of all
the sheets. Please send a preliminary reduction of the floor plan in order
to verify that the labeling on the floor plan will be legible.
8. Please provide a menu.
9. Please note on the site plan that all the requirements of the Grapevine Soil
Erosion Control Ordinance shall be met.
10. Please include a table on the landscape plan sheet which details required
and provided interior, perimeter and non -vehicular open space
requirements. Please see Section 53.H.1. and 2. and 53.1 of the Zoning
Ordinance for the landscape requirements. Please label the State
Highway 114 access road and Crossroads Drive on the landscape plan.
11. Please remove the date from the signature block.
The above comments must be reflected in the revised submittal,
which is due by Thursday, January 29th at 12:00 p.m. for the
February 17th joint public hearing. Please submit the revised
documents to the Department of Development Services at 200 South Main
Street.
The revised submittal shall include:
one (1) Mylar of each sheet (minimum size 22" x 34")
two (2) folded blackline copies of each sheet, (minimum size 22" x 34")
forty (40) reduced sorted (collated sets) copies at 11" x 17" three hole
punched, stapled and z -folded (fold the right edge to the left edge
and then fold the right edge in half to form a z -fold).
one (1) colored version of the landscape plan that removes the
details/charts and contours.

Regional Airport LP.
CU09-02, PD09-01 GRAPEVINE BLUFFS PERSONAL CARE FACILITY - submitted by
Hart, Gaugler & Associates for property located at 2451 West Grapevine Mills Circle and
platted as Lot 3, Block 1, Landmark at Grapevine Addition. The applicant is requesting a
conditional use permit to allow the development of a personal care facility. The applicant is
also requesting a planned development overlay to allow deviation from but not limited to
front yard setback. The property is currently zoned "CC" Community Commercial and is
owned by Grapevine Bluffs LP.
After all parties have been given an opportunity to speak, the public hearing will be closed

Dear Susan Batte,
My name is Hayden Gilbert. My wife, Lisa, and I have two young children. We live in Coppell, but we attend
First Baptist Grapevine. I would just like to say that it troubles me to know that you are considering opening
an establishment such as Tilted Kilt in a family-oriented community such as Grapevine. Is the city of
Grapevine so desperate for money that they're willing to exploit the daughters of their community? I always
saw Grapevine as being unique, a community unlike the other franchise -laden suburbs covered in strip malls.
But it appears that the city council of Grapevine no longer desires for Grapevine to be unique. Instead, you
propose bringing in a lowest common denominator -type franchise where grown men can ogle and demean
teenage women while they pay money for the `right" to do so. That sounds kind of like an area just Southeast
of Grapevine, off Northwest Highway.
I urge you to please re -consider what it is you're really doing to the city of Grapevine. I realize money is tight.
But that doesn't mean your morals have to be loose.

learned today that the restaurant Tilted Kilt is trying to acquire the old TGIF building on William D. Tate. I have
been a citizen of Grapevine for 16 years.
Tilted Kilt is not the type of establishment I would like to be in my city. We already have two establishements
similar to this one, Hooters and Bone Daddy's. Both of these places, I will never set my foot inside their door. I do
not appreciate their exploitaiton of women.
Please make the right choice for the citizens of Grapevine and say "No" to this restaurant.

As Grapevine residents, we respectfully ask you to oppose the request for the Tilted Kilt to become a
place of business in the former TGIF building. Between Hooters, Bone Daddy's, and Cutie Pies,
Grapevine seems to be leaning toward establishments that include very scantilly clad young ladies. This
is not the type of job we would want for our children, and these are not the type of establishments meant
to draw in families. Please do not allow another restaurant with this kind of dress code for waitresses
open in Grapevine.

this type of "pub" is another exploitation of women and adds to the difficulties many men face in
pornography and sexual addictions. Please do the right thing and deny their request. I've read the
"blotter" section of the newspaper, Grapevine does not need to offer additional incentives for sexual
misconduct in our city.

I am writing to express my concern and opposition to the business application by the Tilted Kilt restaurant
under consideration tonight. As a Grapevine resident since 1998 and father of 3 children, I do not believe
our community needs another restaurant similar to Hooter's and Bone Daddy's. These businesses cater
to a specific type of customer and are blatently anti -family in their exploitation of women. The values they
display and promote are not the ones Grapevine has been known for over the years.
We have a great community with distinct shopping and tourist business areas that attract everyone without
resorting to enticing and less desirable values in the public marketplace. As a city, we should enhance our
excellent image as a quality destination, rather than welcoming another business that primarily markets
eye -candy to a specific customer profile. Although it is true that sex sells, I believe more people will begin
to pass by Grapevine if restaurants like the Tilted Kilt are added to our city. We can do better than the
Tilted Kilt, and I urge you to deny their application.

increasingly concerned with the direction of the establishments being permitted in our city
limits. As a family we enjoy eating out on occasion, but we feel that it is getting harder and
harder to find restaurants that provide that down home, small town feel. I am in strong
opposition to establishments such as Hooters, Bone Daddy's, Cutie Pies, and the current
possible addition of the Tilted Kilt (in the old TGIF location). Can't Grapevine provide a family
atmosphere without compromising it's principles?? Our children deserve better than that!

Dear City Council and Planning and Zoning Commission:
I would like to voice my opposition to allowing The Tilted Kilt restaurant and bar to open an
establishment in the city of Grapevine. I have looked at their webpage, and it is easy to see that this is
another company trying to make money through sexual exploitation of young women and by appealing
to the baser things within human nature. I do not think that these are the kinds of things that we want to
promote in our city. From the uniforms of the waitresses, to the t -shirts and underwear advertised on
line, to the Kilt Girl Calendars... the entire persona of this restaurant is wrong for Grapevine.
Through the years our City Council has helped Grapevine to maintain its historic and unique identity
without being reactionary to the progress that comes with being a part of the Dallas -Fort Worth
Metroplex. I recognize that this is not an easy task, and I appreciate the excellence with which our city's
infrastructure and image has been crafted. This same commitment to what's best for our city requires
that the Tilted Kilt be denied.
By allowing these kinds of restaurants and bars in our city, we give our endorsement to an environment
that endorses casual sexual relationships, promotes women as objects for men's lusts, and creates
disillusionment for young girls in how they feel about their own appearance. As a pastor, I can tell you
that these things create an enormous amount of suffering.
The entire atmosphere that The Tilted Kilt will create will be detrimental to the health of our community
and to the long term quality of life here. It will send the wrong message to our daughters because it will
communicate that it is acceptable to use their sexuality to secure a job; it will send the wrong message to
our sons because it will say to them that there is nothing wrong with sexually exploiting women; and it
will send the wrong message about Grapevine because it will say that we accept no responsibility for the
moral environment of our region.
This city has a noble history and seems destined for an equally distinguished future, so please do not
allow Grapevine be tarnished by an establishment like The Tilted Kilt..

REQUESTED CONDITIONAL USE, SPECIAL USE AND COMMENTS:
The applicant is requesting a conditional use permit to amend the previously approved site
plan of CU03-12 (Ord. 03-31) for a planned commercial center in conjunction with a
restaurant with the possession, storage retail sale and on -premise consumption of
alcoholic beverages (beer, wine and mixed beverages) specifically to modify the floor plan
to include outside dining and a new 40 -foot pole sign The applicant is also requestinq a
special use permit to allow for the use of one billiard table
The applicant proposes to revise the floor plan to accommodate a new restaurant (The
Tilted Kilt). The proposed changes include adding an 855 -square foot outdoor dining area
and revising the existing floor plan by removing booth seating in the main dining and bar
area and creating a banquette room and one large group seating area (captain's table).
These changes will decrease the available seating including the patio from 290 seats to
246 seats. The mix of indoor and outdoor seating includes 59 patio seats and 187 indoor
seats. The proposed outdoor patio reduces available parking by eight spaces but ample
parking remains (106 spaces required vs. 124 provided) on the site to accommodate the
proposed seating. One billiard table and two video game tables are included in the floor
plan.
A portion of the bar is accessible from the outdoor patio by way of a controlled access
overhead door feature. Addition of the patio doorway, replacement of awnings, new accent
brick and wall signage located on the east, north and west sides of the building sum up the
exterior changes.
The applicant also requests a 40 -foot pole sign on the subject property. The previous
operator (TGI Friday's) had a 40 -foot pole sign on site. When the restaurant closed, the
cabinet for the sign was removed but the pole remained. The current request is for a 197 -
square feet, 40 -foot pole sign, in the same location as the previous sign.
PRESENT ZONING AND USE:
The property is currently zoned "CC", Community Commercial District with conditional use
permits for a planned commercial center and on -premise alcoholic beverage sales and
consumption.
HISTORY OF TRACT AND SURROUNDING AREA:
The subject and surrounding property was zoned 1-1" Light Industrial District prior to the
1984 City Rezoning. The subject property was rezoned from "GU" Governmental Use
District and "PID" Planned Industrial Development District to "CC" Community Commercial
District with a master site plan for a Planned Commercial Center in conjunction with an
Outback Steakhouse (Z92-04 and CU92-14). TGI Fridays amended the approved site plan
(CU92-20) at the December 15, 1992 joint public hearing and developed a restaurant with
on -premise consumption of alcoholic beverages and a 40 -foot pole sign. California Pizza
Kitchen was approved at the January 18, 1994 joint public hearing (CU93-14) which also
allowed for a restaurant with on -premise consumption of alcoholic beverages and a 40 -foot
pole sign. CU94-03 was approved by Council on March 22, 1994 and allowed TGI Fridays
to consolidate two smoking areas into one area with an approved floor plan. CU94-10 was
approved by Council on May 17, 1994 and allowed for the development of a Don Pablo's
Restaurant with on -premise consumption of alcoholic beverages and a 40 -foot pole sign.
CU94-11 was also approved at the May 17, 1994 joint public hearing which established a
Boston Chicken Restaurant with a 40 -foot pole sign within the planned commercial center.
CU94-25 and CU94-26 were heard and approved at the September 20, 1994 joint public
hearing—CU94-25 established a Red Robin Restaurant with on -premise consumption of
alcoholic beverages and CU94-26 allowed changes to the floor plan for Don Pablo's
restaurant. CU94-36 was approved at the December 20, 1994 joint public hearing and
allowed for additional wall signage for the California Pizza Kitchen. CU95-07 established
Denny's Restaurant with a 40 -foot pole sign and was approved at the May 16, 1995 joint
public hearing. CU95-18 was approved at the August 15, 1995 joint public hearing which
allowed for a 40 -foot pole sign and a 20 -foot pole sign for Red Robin Restaurant. CU98-08

was approved on April 21, 1998 at the joint public hearing, which allowed for a 781 square
foot expansion to the existing restaurant. CU98-29 was approved in July 1998, approving
a revision to the floor plan of TGI Friday's Restaurant. The Site Plan Review Committee
approved CU01-61 in October 2001 allowing interior and exterior renovations to TGI
Friday's. The work was not started and the Conditional Use permit expired. At the May 20,
2003 Council approved a conditional use permit (CU03-12) to modify the floor plan and
exterior elevations for TGI Friday's. Conditional Use Request CU04-18 was approved by
Council at the May 18, 2004 meeting which allowed for on -premise alcohol beverages
sales in conjunction with a restaurant (Buffalo Wild Wings) at the northeast corner of
Crossroads Drive and William D. Tate Avenue. Conditional Use request (CU04-36) and
Special Use (SU04-03) were approved by City Council at the October 19, 2004 meeting
which allowed for on -premise alcohol beverages sales and consumption and one pool table
in conjunction with a restaurant (Boston's The Pizza Gourmet). The Site Plan Review
Committee approved CU05-34 on May 25, 2005 allowed a 159 -square foot, 40 -foot pole
sign for Buffalo Wild Wings. The Site Plan Review Committee approved CU06-43 on
September 28, 2006 allowing a 603 square foot outdoor ding in area for Buffalo Wild
Wings. The Site Plan Review Committee approved CU06-57 on December 21, 2006
allowing a patio cover for Buffalo Wild Wings.
To the west, Classic Chevrolet has be granted numerous conditional use permits (CU91-
01, CU92-01, CU92-16, CU94-02) for a car dealership with automobile repair, 40 -foot pole
signs, a used car showroom with eight service bays, parts storage, sales offices and a
customer lounge area. CU95-15 was approved by Council on June 20, 1995 and allowed
Classic Chevrolet a 6.354 acre expansion to develop a paint and body shop, a used car
sales building, with display and inventory parking. CU96-31 was approved by Council on
November 19, 1996 and allowed for an additional pole sign and the revision of sign copy
on another. The City Council approved CU98-71 in January, 1999 permitting the
installation of shade structures over the display parking area. The Site Plan Review
Committee approved CU07-06 on February 28, 2007 permitting the installation of a 32 -foot
aluminum arched entry feature to the existing main showroom and additional wall signage.
The Hayley Addition to the north, another planned commercial center also has several
retail stores, 40 -foot pole signs and numerous conditional use permits for restaurants with
on -premise alcoholic beverage sales including Uncle Julio's which the City Council
approved CU06-08 on April 18, 2008 on the site of a former movie theatre.

AIRPORT IMPACT:
The subject tract is located within "Zone B" Middle Zone of Effect as defined on the
"Aircraft Sound Exposure: Dallas/Fort Worth Regional Airport Environs" map. In Zone B,
the following uses may be considered only if sound treatment is included in building design:
multi family apartments, motels, office buildings, movie theaters, restaurants, and personal
and business services. Single family residential and sound sensitive uses such as schools
and churches should avoid this zone. The proposed restaurant revision is an appropriate
use in this noise zone.
A portion of the planned commercial center at the southwest corner is located within "Zone
C' zone of greatest effect as defined on the "Aircraft Sound Exposure: Dallas/Fort Worth

Comment: Please add the following note to the site plan stating the purpose of the conditional
use and special use requests:
a) Conditional use request CU09-01 is a request to amend the previously approved site
plan of CU03-17, CU03-12 (Ord.03-31) for a planned commercial center with the
possession, storage, retail sale and on -premise consumptions of alcoholic beverages
(beer, wine and mixed drinks), specifically for the addition of an 890 square outdoor
covered patio. Special use permit request SU09-01 is a request to allow one pool table

attached. There are 132 existing parking spaces. Per code 106 spaces will be required and Tilted Kilt's modified
