1.Single Family residence above Retail business, The type of construction is existing
type VB, with a Recently installed Sprinkler system. The building is 2 story brick and
wood framed row building in the downtown CBD zoning district.
Issues; Zoning: Single family (R-3) not permitted by the Zoning Ordinance in the
"CBD" zoning district.
Issues; Building Code: The building, for its intended proposed purpose may be
considered as a Non separated Use with the most restrictive use classification of group
"M" with and increase of one story due to the sprinkler system.
The specific requirements for the "R-3" residential are as follows:
1. At least one exit 3'-0" min will be required,
2. The stairs are required to conform to the min rise and run as set forth in the 2006
IRC, ie... rise of 7 3/4" max and a run of 10" min. The stairwell width of 36" min,
with handrails and landings conforming to the IRC are required as well.
3. Each bedroom shall have at least one means of emergency egress, eg... window with
5.7sf of clear opening with the min dimensions of 20" wide by 24" high.
4. Doors with glazing shall be tempered and any glazing within 24" of the door swing
shall be tempered as well.
5. The floor shall be capable of sustaining a 40 lb per sf load.
6. All mechanical, electrical and plumbing shall conform to the provisions of the 2006
IRC, IPC, IMC, IFGC and the 2005 NEC were applicable.
7. If the rear stairs are required to be or intended to be used as a principle means of
egress they must comply with all provisions of the applicable codes. Eg... usable
space under egress stairs shall not be use. for any other purpose.
8. These comments are not intended to be all inclusive of the requirements associated

On Tuesday evening, March 24, 2009 at 7:30 P.M. in the City Council Chambers, 2nd
Floor, 200 South Main Street, Grapevine, Texas, the City Council and Planning and Zoning
Commission of the City of Grapevine will hold a public hearing to consider the following
items:
CU09-03 QUIKTRIP - submitted by QuikTrip Corporation for property located at 801 Ira E
Woods Avenue and proposed to be platted as Lot 18, Block 1, Towne Center Addition No.
2. The applicant is requesting a conditional use permit to allow gasoline services and the
possession, storage, retail sale and off -premise consumption of alcoholic beverages (beer
and wine) and a monument sign with more than thirty percent changeable copy in
conjunction with a convenience store. The property is zoned "CC" Community Commercial
and is owned by Grapevine Tate JV.
CU09-05 - HILL SCHOOL OF GRAPEVINE - submitted by Hill School of Grapevine for
property located at 204 North Dooley Street #200 and proposed to be platted as Lot 1 A,
Block 6, W R Boyd Center. The applicant is requesting a conditional use permit to allow an
expansion of an existing nonprofit institution. The property is zoned "CC" Community
Commercial and is owned by owned by Grapevine Dooley Partners LP.
PD09-02 - SONS ENTERPRISES - submitted by Sons Enterprises for property located at
412 South Main Street #200 and platted as Lot 4, Block 3, City of Grapevine. The
applicant is requesting a planned development overlay to allow a residence on the second
floor of an existing structure within the "CBD" Central Business District. The property is
owned by Sons Enterprises.
After all parties have been given an opportunity to speak, the public hearing will be closed
and the Commission and the City Council will deliberate the pending matters. Please

PROPERTY LOCATION AND SIZE:
The subject property is located at 412 South Main
Street and is platted as Lot 4, Block 3, Original Town
of Grapevine. The property contains approximately
2,788 square feet and has approximately 25 feet of
frontage along South Main Street and Barton Street.
REQUESTED PLANNED DEVELOPMENT OVERLAY AND COMMENTS:
The applicant is requesting a planned development overlay to allow a residence on the
second floor of an existing structure within the "CBD" Central Business District.
The applicant proposes to utilize the second floor of the property addressed at 412 South
Main Street as a residence. This second floor with its own separate entrances from both
Main Street and Barton Street comprises some 1,750 square feet. Two parking spaces at
the rear of the building accessed from Barton Street will be provided for the occupants.
Discounting the Wallis Hotel, Palace Theater, and Willhoites, only two structures north of
College Street (330 and 401 South Main Street) are possible candidates to also support
residential uses on the second floor, although they are currently occupied.
PRESENT ZONING AND USE:
The property is zoned "CBD" Central Business District and is currently used as a retail

shop and art gallery on the first floor (Blue Moon Gallery). The second floor is unoccupied.
HISTORY OF TRACT AND SURROUNDING AREA:
The subject property and surrounding areas were rezoned in the 1984 City Rezoning from
"C-2" Community Business District to "CBD" Central Business District. The subject
property is also located within a Historic Overlay District (1-11-92-03).
SURROUNDING ZONING AND EXISTING LAND USE:
NORTH: "CBD" Central Business District—various retail businesses
SOUTH: "CBD" Central Business District—various retail businesses
EAST: "CBD" Central Business District—various retail businesses
WEST: "CBD" Central Business District—various retail businesses
AIRPORT IMPACT:
The subject tract is located within "Zone A" zone of minimal effect as defined on the
"Aircraft Sound Exposure: Dallas/Fort Worth Regional Airport Environs" map. Few
activities will be affected by aircraft sounds in Zone A, except for sound sensitive activities
such as auditoriums, churches, schools, hospitals, and theaters. The applicant's proposal
is an appropriate use in this noise zone.
MASTER PLAN APPLICATION:
The Master Plan designates the subject property as a Central Business District land use.
The applicant's proposal is not in compliance with the Master Plan.

Dear Mr. Mundlin,
This letter is to verify that your request for a planned development overlay located at 412
South Main Street and platted as Lot 4, Block 3, City of Grapevine Addition to allow a
residence on the second floor of an existing structure within the "CBD" Central Business
District as shown on the site plan was approved by City Council on March 24, 2009.
Please find enclosed Ordinance 2009-09.
On March 24, 2009, the Planning and Zoning Commission, recommended the City Council
approve the request.
A waiting period of one (1) year between the date an application for amendment to the
zoning ordinance, or a requested change in zoning, is denied by the City Council and a
new application for such a change or amendment is accepted, is hereby established. The
one-year waiting period shall be applicable to all requested amendments and changes for
the same zoning district, or districts, on all or any portion of the property previously
considered for amendment or change in zoning; provided, however, said one-year waiting
period shall not be applicable to any proposed amendment or change instituted by the City
Council or Planning and Zoning Commission or to any proposed amendment or change
denied by the City Council without prejudice.

We are requesting a PD overlay for the upstairs (Suite 200) of 412 South Main Street. The first floor is
retail space, currently occupied by Blue Moon Gallery, and is not a part of this request.
The PD overlay would allow us to lease the upstairs space, approximately 1,800 sq. ft., for residential
use.. Q;—A the office tenant moved out in late November, we have had many residential inquiries and,
we have seen enormous demand for residential in
with the addition of the 925 South Main apartments,
downtown Grapevine.
We are able to provide parking behind the building, on our property for this tenant. As a matter of fact,
the demand for parking will be less with this space used as a residence versus the parking demand that
existed when it was used for offices.
This use will eau 0 harm to Main Street and/or to downtown Grapevine. We believe that it will be
