the staff. Based on the size of the agenda, your application may be scheduled to a
later date.
All public hearings will be opened and testimony given by applicants and

Any application for a change in zoning or for an amendment to the zoning
ordinance shall have, from the date of submittal, a period of four months to
request and be scheduled on an agenda before the Planning and Zoning
Commission and City Council. If after said period of four months an application
has not been scheduled before the Commission and Council said application shall
be considered withdrawn, with forfeiture of all filing fees. The application, along
with the required filing fee may be resubmitted any time thereafter for
reconsideration. Delays in scheduling applications before the Planning and
Zoning Commission and City Council created by city staff shall not be considered
a part of the four month period.

Please add case number CU07-44, submittal date, vicinity map,
label each sheet in consecutive order (ex. Sheet 1 of 2), place the
address and lot/block legal description in the lower right hand
corner of each sheet.
2. Please contact Public Works at (817) 410-3135 regarding platting,
driveway spacing, curb and gutter and sidewalk requirements.
3. Please note in a chart format the following: current height and
proposed height in feet and stories, total building area existing and
proposed, total lot area, floor area ratio, total impervious area, total
open space (landscaped area), total building and paved area and
parking required/provided. Please include the square footage of the
second floor in the tabulations.
4. Please show a 25 -feet building setback line along West Wall Street
and along Pebble Brook Drive. Along the south and east property
lines, adjacent to the residentially zoned property, a 25 -feet buffer
area is required. Please ghost in the buffer area line adjacent to
the residentially zoned lots. Please provide a minimum distance of
ten feet between vehicle use areas and the property line and
dimension the distance accordingly. Please correct Pebble Brook
from street to drive.
5. Please label all rooms including the room on the second floor and
provide a seating plan for the great room and other seating areas
showing the number of seats proposed.
6. If a sign is planned for the site, please indicate the location of the
proposed sign, indicating the sign type. Also please dimension the
distance of the proposed sign to the nearest property line and
include the proposed sign location to the landscape plan. Signs
must be setback a minimum of 10 -feet from all property lines.
7. Please add a note to the site plan that cremation services will not
be conducted on-site.
8. Please provide a dimension of a 9'x18' for a typical parking space.
9. Please designate a refuse storage area. All users are required to
show the location and screening of a dumpster whether one is used
or not. Please provide the elevation and material used for the
dumpster enclosure and the gate.
10. The site is adjacent to residential zoning on the south and east
property lines. Please provide an illumination plan. Lighting levels
may not exceed 0.2 footcandles adjacent to the south and east
property lines.
11. Please dimension the distance of the proposed building addition
from the west property line.
12. Please add the following note; "All the requirements of the
Grapevine soil erosion control ordinance shall be met during the
period of construction".
13. Please label the exterior material used for the existing structure and
proposed addition.

which is due by Thursday, December 27 at 12:00 p.m. for the January
15, 2008 joint public hearing. Please submit the revised documents to
the Department of Development Services at 200 South Main Street.
The revised submittal shall include:
one (1) mylar of each sheet (minimum size 22" x 34")
two (2) folded blackline copies of each sheet, (minimum size 22" x 34")
forty (40) reduced sorted (collated sets) copies at 11" x 17" three hole
punched, stapled and z -folded (fold the right edge to the left edge
and then fold the right edge in half to form a z -fold).
If these revisions are made and submitted at the correct time, you will be
scheduled for the next available agenda.

On Tuesday evening, January 15, 2008 at 7:30 P.M. in the City Council Chambers, 2nd
Floor, 200 South Main Street, Grapevine, Texas, the City Council and Planning and Zoning
Commission of the City of Grapevine will hold a public hearing to consider the following
items:
CU07-34 - BAJA MEXICAN GRILL - submitted by Gloisa Inc for property located at 1212
William D Tate Avenue and platted as Parcel E, Towne Center Addition. The applicant is
requesting a conditional use permit to amend the previously approved site plan, specifically
to add additional square footage to the restaurant. The property is zoned "CC" Community
Commercial and is owned by Greenway -Grapevine Ltd.
CU07-43 - GREAT WOLF LODGE - submitted by Great Wolf Lodge for property located at
1400 State Highway 26 and platted as Lot 1, Block 1, Great Wolf of Grapevine Addition.
The applicant is requesting a conditional use permit to amend the previously approved site
plan, specifically to allow the addition of a miniature golf course and revise the entry porte-
cochere. The property is zoned "CC" Community Commercial and is owned by Great Wolf
Lodge of Grapevine LLC.
CU07-44 - LUCAS FUNERAL HOME - submitted by JNL Texas Holdings for property
located at 1331 West Wall Street and platted as Block 1, Dellwood Acres Addition. The
applicant is requesting a conditional use permit to allow a funeral home. The property is
zoned "PO" Professional Office and is owned by Grapevine -Wall Street Partners 1.
SU07-03 - ONCOR ELECTRIC DELIVERY - submitted by Oncor Electric Delivery
Company for property located at 3201 State Highway 360 and proposed to be platted as
Lot 2, Block 1, Grapevine SH 360 Substation Addition. The applicant is requesting a
special use permit to allow the development of a public utility distribution facility and
equipment. The property is zoned "PID" Planned Industrial Development and "R-TH"
Townhouse District and is owned by Robert Schlegel.
FUTURE LAND USE MAP II UPDATE MP07-02 - amending the Official City of Grapevine
Future Land Use Map II for property currently zoned "R -MF -2" Multifamily District located
east of Wood Street between East Wall Street and East Worth Street.
AMENDMENTS TO COMPREHENSIVE ZONING ORDINANCE 82-73 - The City Council
and the Commission will consider amendments and changes to the Comprehensive Zoning
Ordinance, No. 82-73, same being Appendix D of the Code of Ordinances as follows:
Section 28, "CBD" Central Business District relative to restaurants as a conditional use and

any other additions, deletions, or changes to various sections, articles and provisions
contained in said Ordinance No. 82-73.
After all parties have been given an opportunity to speak, the public hearing will be closed
and the Commission and the City Council will deliberate the pending matters. Please

Some of my thoughts about the Lucas family establishing their
Grapevine facility in my neighborhood:
1. The property will be beautifully maintained. Can you honestly say
you've ever seen a poorly maintained and/or neglected funeral parlor
property? The other Lucas properties are varied in style and
appearance but are all attractive and assets to their respective
neighborhoods.
z. The majority of activity taking place at a funeral parlor is not during
peak traffic times. Most viewings are in the evening (usually 6-8
p.m.). Funerals are typically late morning or early afternoon. Huge
funerals are most often conducted at a church and not at the funeral
home's property.
3. Funeral home properties, like church properties, are rarely
properties chosen by teens, party -animals and vagrants as hang-outs
or meeting places. Out of respect for their clients and the bereaved,
facilities are impeccably maintained. The same cannot be said for
parks, playgrounds, commercial offices, strip -mall -like businesses
and other professional/commercial businesses.
4. The state and OSHA have strict regulations to ensure the proper
care of materials related to funeral business.
5. Restoring, preserving and maintaining the long standing structure
properly on this property will be extremely expensive and nit
requirements most businessmen would want to accept when
relocating. This business has a personal reputation and stake in
preserving the history of the city we have all chosen as our home. If I
understand the history of the property, many of our homes stand on
or abut,property which was once part of the Yancy farm. Historic
properties are considered assets to an area and its desirability.

As home owners and long time residents of Grapevine, we are opposed to the building of Lucus
Funeral Home. We know that the traffic that would result from a funeral home at that location
would cause many problems for our neighborhood. The most common times for funerals are
10am and 2pm. Funerals at two would make leaving our neighborhood almost impossible.
Three would be approximately the time processions would start to leave the funeral home.
That, combined with Cannon Elementary dismissals starting at 2:15pm would shut the
neighborhood down.
More traffic in the area is not good for the children at Cannon either. More cars mean more
chances of accidents. The intersection at Wall and Dove is backed up almost every day during
rush hour, and this would only add to that with visitation times usually in the evening.
And......, who wants to live next to a funeral home??? Lucas needs to buy land around it's
present location and expand instead of lowering property values in our neighborhood.

REQUESTED ZONE CHANGE, CONDITIONAL USE AND COMMENTS:
The applicant is requesting a conditional use permit to allow a funeral home.
The applicant proposes to convert the Historic Yancy Farmhouse into a funeral home
building containing 5,665 square feet. The floor plan reveals a 48'x36' seating area
containing 150 seats. The applicant is providing 50 off-street parking spaces which meet
the minimum required parking spaces for the number of seats proposed.
On December 19, 2007 the Grapevine Historic Preservation Commission approved a
Certificate of Appropriateness (CA07-75) at the Historic Yancy Farmhouse located at 1331
West Wall Street which included a new parking lot and a 3,555 square foot addition. The
addition includes a new meeting room used for viewing, a new porte cochere and a
covered rear porch. On December 21, 2004 HL04-03 was approved on the subject site
designating the site a Historic Landmark.

The subject property and the property to the east were rezoned from "R-3" Multiple Family
to "PO" Professional Office District in the 1984 City-wide rezoning. The properties to the
north were rezoned from "C2" Community Business to "HC" Highway Commercial District in
the 1984 City-wide rezoning. The properties to the south were rezoned from "R1" Single
Family to "R-7.5" Single Family District in the 1984 City —wide rezoning. The properties to

BACKGROUND INFORMATION:
The applicant, Mr. James Lucas, submitted a conditional use request for property
addressed as 1331 West Wall Street to allow a funeral home. Due to neighborhood
opposition, the applicant has requested to withdraw his conditional use request. See the

apparent some of the neighbors do not want us to restore a beautiful old piece of
Grapevine and use it to serve future generations.
It seems a shaine to us since we have had so many people (neighbors) tend their full

staff and the office of David Klempin worked with us are a testament to the city and its

JNL Texas Holdings, LLC and Lucas Family Funeral Home of Grapevine wish to thank
you for your time and consideration of our Special Use Application.
Lucas Funeral Home has been operating in Grapevine since the late 1800s, and is
currently located at 2000 West College Street across from Baylor Hospital. In order to
better serve the citizens of Grapevine, we are in need of a new facility and have identified
the property at 1331 Wall St. as ideal for this purpose.
The property, located at the corner of Wall St. and Pebble Brook, was previously a
residence and professional office but has not been in use since for several years. Our
intention is to make substantial improvements to the existing building's interior and
exterior, as well as improve the parking and landscaping of the property. These
improvements will dramatically enhance the visual appeal of the property, which will
have a positive impact on the surrounding properties.
Improvements to the existing building will include a refacing of the exterior to look
original, and the addition of other elements to enhance the elevation. The landscape will
be improved through reseeding of grass areas as needed, pruning and reshaping of
existing shrubs and trees, as well as adding shrubs, trees and other landscape elements,
and the addition of an irrigation system. Although a parking area is essential to the
facility, landscaping will be used to minimize any negative impact the parking areas will
have on the overall visual appeal of the property.
A funeral home facility provides a good "buffer" between residential and commercial
property zones. Currently several of our other funeral homes are within or adjoining
residential areas. Our other facilities can be viewed online at www.familyowned.net.
Because funeral services are generally somber events, there is limited noise generated.
The name funeral home comes from older traditions when the remains of deceased
persons were placed for viewing within their residence. Safety and family needs
concerns caused the change to the modern tradition of viewings being held at a
commercial establishment—the funeral home. Our funeral homes, while being a
commercial operation, maintain the traditional elements of the past such that, as much as
possible, the interiors and exteriors more closely resemble a home rather than a business.
Approximately 60 percent of the families we service will select "traditional" funeral
services. A traditional funeral service typically involves a visitation or viewing at the
funeral home. Most visitations are scheduled for a two-hour time period during the early
evening hours and conclude by 8:OOpm. A funeral service is conducted either at the
funeral home's chapel, and larger services are typically held at the family's church,
followed by interment at a cemetery. f"ECEIVED

Approximately 40 percent of the families we serve will select cremation over traditional
services. When cremation is selected, a visitation or viewing can be involved just as with
a traditional service. A funeral or memorial service may also be held. Smaller services
are typically held in the funeral home's chapel, while larger services are generally held at
the family's church. Approximately one-third to one-half of the families selecting
cremation services will also select visitations and/or funeral services. The actual process
of cremation of the remains will not be conducted at this site.
Our Grapevine location has historically conducted between 10 and 15 services per month,
and this is not expected to change following our relocation to the proposed new facility.
About one-half to three-fourths (5 to 12 per month) of these services will include a
visitation or viewing at the funeral home. One half of the services with a visitation will
also include a funeral or memorial service in the funeral home's chapel (3 to 6 per
month). The remainder will have funeral services at the family's church.
Typical services conducted at the funeral home will have minimal impact on the
surrounding residential properties. During visitations, the guests arrive at various times
during the visitation hours, pay their respects to the family, and depart. A typical
visitation will involve between 25 and 100 guests, with only 25 percent of the guests
occupying the facility at any given time. As a result, visitations will not produce a
significant impact to traffic flow on Wall St. and none onto Pebble Brook.
Funeral/memorial services conducted at the funeral home chapel typically have an
attendance of less than 100 people, with a typical ratio of 1 vehicle for every 2.5
attendees, or an average of 35 to 40 vehicles per funeral service. A procession from the
funeral home to the cemetery will include an average of three funeral vehicles, and is lead
by police escorts. The main parking entrance will be on Wall St. at the far northeast
corner of the property.
For funeral services followed by a procession to the cemetery, we "stage" vehicles in
rows for convenient egress from the parking lot. The police escorts will temporarily
block traffic on Wall St. to allow vehicles to exit the funeral home parking lot and
proceed to the cemetery. This process is usually completed within three to five minutes,
after which time traffic flow will return to normal. No part of Hilltop Drive will be used
as a processional route. Although the scheduling of services involves factors outside our
control, we make every effort to arrange service schedules so that any cemetery
procession is conducted at times with lower average traffic levels.
Our Grapevine location handles funeral arrangements and services, with only minimal
general office functions. Accounting and business operations are handled from our
location in Hurst, Texas. Therefore, daily staffing at the Grapevine location is minimal,
and will not impact the surrounding neighborhood.
In addition to meeting the requirements of the City of Grapevine for health, safety and
fire concerns, a funeral home falls under the rules and regulations of the Sta

Funeral Service Commission, which licenses funeral home establishments. The Funeral
Service Commission regulates and inspects funeral establishments at least annually.
JNL Texas Holdings, LLC. and Lucas Family Funeral Home are owned and operated by
Jim Lucas and his son, Jimmy. Another of Jim's sons, Bobby Lucas, is the manager of
the Grapevine location. The Lucas family has been operating funeral homes since the
1860s, when Joseph Thomas ("Joe") Lucas opened a general store in Grapevine, selling
groceries and caskets. Together with its employees, the Lucas family is dedicated to
serving families of Grapevine with warmth and care. Jim, Jimmy and Bobby Lucas are
4" and 5`h generation family members operating the funeral home, and we are the only
family funeral home in the Grapevine area.
We are also dedicated to the community, and are actively involved in several business
and civic organizations. Our roots are in Grapevine, and the proposed Special Use of this
property indicates our strong dedication and commitment to the community.
