the staff. Based on the size of the agenda, your application may be scheduled to a

Any application for a change in zoning or for an amendment to the zoning
ordinance shall have, from the date of submittal, a period of four months to
request and be scheduled on an agenda before the Planning and Zoning
Commission and City Council. If after said period of four months an application
has not been scheduled before the Commission and Council said application shall
be considered withdrawn, with forfeiture of all filing fees. The application, along
with the required filing fee may be resubmitted any time thereafter for
reconsideration. Delays in scheduling applications before the Planning and
Zoning Commission and City Council created by city staff shall not be considered
a part of the four month period.

CITY OF GRAPEVINE, TEXAS
On Tuesday evening, January 20, 2009 at 7:30 P.M. in the City Council Chambers, 2nd
Floor, 200 South Main Street, Grapevine, Texas, the City Council and Planning and Zoning
Commission of the City of Grapevine will hold a public hearing to consider the following
items:
Z08-13 - RESIDENCE AT GRAPEVINE STATION - submitted by Westwood Group for
property located at 1020, 1022, 1024, 1028, 1030 Texan Trail and proposed to be platted
as Lots 1 RA, 2R, Block 3 and Lots 2R, 3, 4 and 5, Block 4, Grapevine Station Addition.
The applicant is requesting to rezone 15.98 acres from "BP" Business Park and "CC"
Community Commercial to "MXU" Mixed Use Development for the development of a 368
unit apartment complex, 39,113 square foot of office space and 41,200 square foot of
retail/office space. The property is owned by owned by Triple T Farms, Ltd.
CU08-35 - GRAPEVINE STATION - submitted by Westwood Group for property located at
1026, 1034, 1038, 1044, 1046, 1048, 1050, 1052, 1054, 1056 Texan Trail and platted as
Lots 1-7, Block 1, Lots 1 RA and 2A, Block 2A, Lot 3, Block 3, Grapevine Station Addition.
The applicant is requesting a conditional use permit to amend the previously approved site
plan specifically to reduce the planned business park from 23.2 acres to 17.34 acres for
the development of a multifamily complex. The property is currently zoned "BP" Business
Park and is owned by Triple T Farms, Ltd.
SU08-06 — CHESAPEAKE ENERGY - submitted by Chesapeake Operating, Inc. for
property located at 2720 North Grapevine Mills Boulevard and proposed to be platted as
Lot 1, Block 1, Grapevine Mills Wells Addition. The applicant is requesting a special use
permit to allow gas well drilling and production in a nonresidential district. The property is
currently zoned "HCO" Hotel and Corporate Office and is owned by North Texas
Acquisition, LLC.
HL08-10 - LOVE CHAPEL - submitted by City of Grapevine for property located at 300
Turner Road and platted as Lot 22R1, North Side Addition. The applicant is requesting
designation as a historical landmark sub -district. Such sub -district may include buildings,
land, areas, or districts or historical, architectural, archaeological or cultural importance or
value that merit protection, enhancement, and preservation in the interest of the culture,
prosperity, education, and welfare of the people. The property is owned by Love Chapel
Church of God in Christ.

AM08-03 - AMENDMENTS TO COMPREHENSIVE ZONING ORDINANCE 82-73 - The
City Council and the Commission will consider amendments and changes to the
Comprehensive Zoning Ordinance, No. 82-73, same being Appendix D of the Code of
Ordinances as follows: Section 23, "LB" Limited Business, Section 23A, " GV" Grapevine
Vintage, Section 24, "CN" Neighborhood Commercial, Section 25, "CC" Community
Commercial, Section 26, "HC" Highway Commercial, Section 27, "PO" Professional Office,
Section 28, "CBD" Central Business District, Section 28A, "HGT" Historic Grapevine
Township, Section 29, "HCO" Hotel/Corporate Office, Section 30, "RA"
Recreation/Amusement, Section 31, "LI" Light Industrial, Section 32, "BP" Business Park,
Section 38, "GU" Governmental Use, Section 40 "MXU" Mixed Use and Section 55,
Performance Standards relative to outdoor speakers. Section 53, Landscape Regulations
relative to automatic irrigation systems and Section 60, Sign Standards relative to 40 foot
pylon signs, and any other additions, deletions, or changes to various sections, articles and
provisions contained in said Ordinance No. 82-73.
After all parties have been given an opportunity to speak, the public hearing will be closed
and the Commission and the City Council will deliberate the pending matters. Please

Because you are a property owner within 200 feet of the subject tract of land as
shown by the last City -approved tax rolls, you received this notice. If you cannot or
do not wish to attend the hearing, the attached form is provided for your
convenience. If owners of more than 20% of the property within 200 feet of the

Purpose of Request:
The public hearing is to consider an application submitted by Westwood Group for property

Staff recommends the City Council and the Planning and Zoning Commission accept the
applicant's request to table zone change request Z08-13 and conditional use request
CU08-35 to the February 17, 2009 meeting, and take any other action necessary.
BACKGROUND:
An application for a zone change to rezone 15.98 acres from "BP" Business Park District
and "CC" Community Commercial District to "MXU" Mixed Use District for a mixed use
project that includes a four-story, 368 -unit apartment complex and approximately 80,000
square feet of office and retail space was submitted by Mr. Gary Hazlewood on property
located near the southwest intersection of East Wall Street and Texan Trail. In addition, a
conditional use request was also submitted to reduce the size of the existing planned
business park to accommodate that portion of the business park that is proposed to be
rezoned to "MXU" Mixed Use District. The applicant is requesting to table both requests to
the next scheduled joint public hearing date, February 17, 2009, due to changes
associated with the site plan for the mixed use project. See the attached email from Mr.

PROPERTY LOCATION AND SIZE:
The subject property is located at 1026, 1034, 1038,
1044, 1046, 1048, 1050, 1052, 1054, and 1056
Texan Trail and is platted as Lots 1-7 Block 1, Lots
1 RA, and 2A, Block 2A, and Lot 3, Block 3,
Grapevine Station Addition. The property contains 15
acres and has 352 feet of frontage along Texan Trail.
REQUESTED CONDITIONAL USE AND COMMENTS:
The applicant is requesting a conditional use permit to amend the previously approved site
plan of CU05-26 (Ord. 05-46) for a planned business park specifically to reduce the size of
the planned business park to accommodate the development of a mixed use project.
Originally developed as a planned business park approximately 23.74 acres in size, the
applicant intends to extract a 8.74 acre piece from the established business park that will
be rezoned to "MXU" Mixed Use District to accommodate the development of an apartment
complex and five stand-alone structures that will be utilized for office and combined
office/retail uses as part of an overall 15.98 acre mixed use project. There are no other
changes proposed with this request. If approved the business park will be reduced in size
from 23.74 acres to 15.00 acres.

PRESENT ZONING AND USE:
The subject property is currently zoned "BP" Business Park District and is under
development.
HISTORY OF TRACT AND SURROUNDING AREA:
The subject property was zoned "C-2" Community Business District along the East
Northwest Highway frontage and "R-3" Multiple Family District prior to the 1984 City
Rezoning. The property to the north was zoned "C-2" Community Business District and 1-
1" Light Industrial District prior to the 1984 City Rezoning. The property to the east was
zoned 1-1" Light Industrial District and the property to the south and west was zoned "R-1"
prior to the 1984 City Rezoning. A request to rezone this property to "BP", Business Park
District for the future development of a business park was denied by Council on August 15,
2000 (Z00-10). The site was later rezoned to "BP" Business Park District in December,
2003 (Z03-09). At the February 17, 2004 meeting Council approved a conditional use
permit to establish a 23 -acre Planned Business Park on the subject property. At Council's
June 25, 2005 meeting, two separate office project were approved on the subject property
(CU05-26) relative to development within the planned business park. A planned
commercial center (CU06-25) was established by Council at the July 18, 2006 meeting on
the "CC" Community Commercial zoned property along Texan Trail along with a bank with
drive-through service (Northstar Bank). Conditional use request CU08-21 was considered
and denied at Council's October 21, 2008 meeting relative to a reduction in the size of the
planned business park (6.4 acres) to accommodate an apartment project.

NORTH: "CC" Community Commercial District—Northstar Bank
SOUTH: "BP" Business Park District—Grapevine Station planned business

EAST: "CC" Community Development District—vacant
WEST: "R-12.5" Single Family District—D.E. Box single family subdivision

The subject tract is located within "Zone B" Middle Zone of Effect as defined on the
"Aircraft Sound Exposure: Dallas/Fort Worth Regional Airport Environs" Map. In "Zone B"
the following uses may be considered only if sound treatment is included in building design:
multifamily apartments, motels, office buildings, movie theaters, restaurants, personal and
business services. Single family residential and sound sensitive uses such as schools and
churches should avoid this zone. The applicant's proposal is an appropriate use in this
noise zone.

request is not in compliance with the Master Plan.
