ACKNOWLEDGEMENT

when riled and will be placed on the agenda for public hearing at the discretion of
the staff. Based on the size of the agenda, your application may be scheduled to a
later date.
All public hearings will be opened and testimony given by applicants and
interested citizenry. Public hearings may be continued to the next public hearing.
Public hearings will not be tabled.
Any changes to a site plan (no matter how minor or major) approved with a
conditional use or a special use permit can only be approved by city council
through the public hearing process.
Any application for a change in zoning or for an amendment to the zoning
ordinance shall have, from the date of submittal, a period of four months to
request and be scheduled on an agenda before the Planning and Zoning
Commission and City Council. If after said period of four months an application
has not been scheduled before the Commission and Council said application shall
be considered withdrawn, with forfeiture of all filing fees. The application, along
with the required filing fee may be resubmitted any time thereafter for
reconsideration. Delays in scheduling applications before the Planning and
Zoning Commission and City Council created by city staff shall not be considered
a part of the four month period.

1. Please add case number CU10-05 to the signature block, label the
existing overhead doors and label the outside storage area and chain
link fence found on front and rear elevations.
2. Please add the adjacent zoning of "LI" Light Industrial District west and east
and "GU" Governmental Use District north of the subject site.
3. Please label the surface of the proposed outdoor storage area and provide an
expanded view of the screening material.
4. Please add the following notes to the site plan:
Conditional use request, CU10-05 is a request to allow sales, service,
outdoor display and outside storage of lawn equipment.
The outside storage area will be used to store lawn equipment.
Please note the manner in which refuse will be disposed.
Any proposed outdoor lighting my not exceed 3.0 footcandles at the
property lines.
5. For verification purposes please email a PDF of the final site/floor plan prior
to producing the final copies.
The above comments must be reflected in the revised submittal, which
is due on Monday, March 29th by 12:00 p.m. for the April 20 joint public
hearing. Please submit the revised documents to the Department of
Development Services at 200 South Main Street.
The revised submittal shall include:
one (1) Mylar of each sheet (minimum size 22" x 34")
two (2) folded blackline copies of each sheet, (minimum size 22" x 34")
forty (40) reduced sorted (collated sets) copies at 11" x 17" three hole
punched, stapled and z -folded (fold the riqht edqe to the left edae and
then fold the right edge in half to form a z -fold).
If these revisions are made and submitted at the correct time, you will be scheduled
for the next available agenda.

On Tuesday evening, April 20, 2010 at 7:30 P.M. in the City Council Chambers, 2nd Floor,
200 South Main Street, Grapevine, Texas, the City Council and Planning and Zoning
Commission of the City of Grapevine will hold a public hearing to consider the following
items:
CU10-04 - Blooming Colors Nursery - submitted by Vilbig and Associates for property
located at 2221 Ira E Woods Avenue and platted as Lot 7, Block 1, DFW Business Park.
The applicant is requesting a conditional use permit to amend the previously approved site
plan to allow a 20 -foot pole sign. The property is currently zoned "CC" Community
Commercial and is owned by Blooming Colors Nursery and Landscaping.
CU10-05 - Grapevine Lawn Equipment Center - submitted by Michael Cantrell for
property located at 204 West Dallas Road and platted as Lot 48, Lipscomb & Daniel
Addition. The applicant is requesting a conditional use permit to allow the sales, service
and outside storage of lawn equipment. The property is currently zoned "LI" Light Industrial
and is owned by John Horobec.
PD10-02 - Stone Bridge Oaks - submitted by Grenadier Homes for property located at
4632 Trevor Trail and platted as Stone Bridge Oaks Addition. The applicant is requesting a
planned development overlay to amend the previously approved site plan to allow the
development of 66 single family lots. The property is currently zoned "R-TH" Townhouse
District and is owned by Lifestyle Grapevine 360, LP.
HL10-01 & HL10-02 - 609 & 613 East Texas Street - submitted by Mark Born for property
located at 609 & 613 East Texas Street and platted as Lots 3 & 4, Block 105, College
Heights Addition. The applicant is requesting designation as a historical landmark sub-
district. Such sub -district may include buildings, land, areas, or districts or historical,
architectural, archaeological or cultural importance or value that merit protection,
enhancement, and preservation in the interest of the culture, prosperity, education, and
welfare of the people. The property is owned by Mark Born.
After all parties have been given an opportunity to speak, the public hearing will be closed

Purpose of Request:
The public hearing is to consider an application submitted by Michael Cantrell for property
located at 204 West Dallas Road and platted as Lot 4B, Lipscomb & Daniel Addition. The
applicant is requesting a conditional use permit to allow the sales, service and outside
storage of lawn equipment. The property is currently zoned "LI" Light Industrial and is
owned by John Horobec. A copy of the site plan is on file with the Development Services
Department.

REQUESTED CONDITIONAL USE AND COMMENTS:
The applicant is requesting a conditional use permit to allow sales service and outside
storage of lawn equipment in the "LI" Light Industrial District within an existing structure.
The applicant's intent is to utilize the existing single story wood building for lawn equipment
sales, service and repair. An existing paved area on the east side of the building is
proposed as an outdoor storage area for repaired lawn equipment. The storage area will
be screened by a solid six-foot wooden fence. An outdoor area adjacent to the showroom
is proposed for mower display during business hours of 8:00 a.m. to 6:00 p.m. Monday
through Friday and 8:00 a.m. to 12:00 p.m. Saturday.
If approved this will be the first reading of an ordinance given the subject site requires
approval of variances and a special exception respectively, relative to lot depth and area,

and encroachments into building setbacks, parking within the landscape setback area and
required parking. These items will be heard before the Board of Zoning Adjustment at their
May 3, 2010 meeting. If approved by the Board the second reading will occur at the
Council's May 16, 2010 meeting.
PRESENT ZONING AND USE:
The property is currently zoned "LI" Light Industrial District and has an existing structure
proposed to be occupied as a lawn mower sales and repair shop.
HISTORY OF TRACT AND SURROUNDING AREA:
The subject property and the adjacent sites to the north, east and west were rezoned in the
1984 City Rezoning from "LI" Limited Industrial District to "LI" Light Industrial District. The
site to north was rezoned from "LI" Light Industrial District to "GU" Governmental Use
District with the approval of a Zone Change Request (Z07-08) at the June 23, 2008
meeting to rezone properties owned by the City of Grapevine.
SURROUNDING ZONING AND EXISTING LAND USE:
NORTH: "GU" Governmental Use District – Original Town of Grapevine
SOUTH: "PO" Professional Office District – Original Town of Grapevine
EAST: "LI" Light Industrial District – Lipscomb and Daniel Subdivision
WEST: "LI" Light Industrial District – Lipscomb and Daniel Subdivision
The subject tract is not located within any "Zone" as defined on the "Aircraft Sound
Exposure: Dallas/Fort Worth Regional Airport Environs" map.
MASTER PLAN APPLICATION:
The Master Plan designates the subject property Central Business. This request is not
compliance with the Master Plan.
THOROUGHFARE PLAN APPLICATION:
The Thoroughfare Plan designates this segment of West Dallas Road a Type C, Minor
Arterial requiring 80 feet of right-of-way developed as four lanes with a turn lane.

RECOMMENDATION:
Staff recommends the City Council approve Conditional Use Application CU 10-05 on the
second reading of an ordinance, and take any other action necessary.
BACKGROUND:
Conditional Use Request CU10-05 was submitted by Michael T. Cantrell and was
approved on the first reading of an ordinance by Council at the April 20, 2010 meeting.
The request was to allow sales, service and outside storage of lawn equipment in the
"LI" Light Industrial District within an existing structure. The applicant sought approval of
two variances and a special exception respectively, relative to lot depth and area, and
encroachments into building setbacks, parking within the landscape setback area and
required parking. The subject lot was part of Lots 1-4 of the Lipscomb & Daniel
Subdivision originally platted in 1948, predating the City's first zoning ordinance. The
site is an existing developed lot, and the existing structure was built in 1967 prior to the
rezoning of the site in the 1984 City Rezoning. Platted and developed lots exist adjacent
to the subject site, eliminating the possibility to expand the site. The Board approved the
variances and special exception requests at their May 3, 2010 meeting.

Dear Mr. Cantrell,
This letter is to verify that your request for a conditional use permit to allow sales, service
and outside storage of lawn equipment in the "LI" Light Industrial District within an existing
structure on property located at 204 West Dallas Road and platted as Lot 413, Lipscomb &
Daniel Addition was approved by City Council on May 18, 2010. A copy of Ordinance
2010-18 is enclosed.
On April 20, 2010, the Planning and Zoning Commission recommended the City Council
approve the request.
Any changes to a site plan approved with a conditional use or a special use (no matter how
minor or major) can only be approved by city council through the public hearing process.
No Conditional Use Permit shall be valid for a period longer than one (1) year from the date
on which the City Council grants the Conditional Use, unless within such one (1) year
period: (1) a Building Permit is obtained and the erection or alteration of a structure is
started, or (2) an Occupancy Permit is obtained and a use commenced.
The City Council may grant one additional extension not exceeding one (1) year, upon
written application, without notice or hearing. No additional extension shall be granted
without complying with the notice and hearing requirements for an initial application for a
Conditional Use Permit.

Dear Mr. Stombaugh:
Please accept this letter and the enclosed documentation as the conditional use
permit application of Grapevine Lawn Equipment Center, LLC ("GLEC") for the use of
the real property and improvements physically located at 204 W. Dallas Rd., Grapevine,
TX 76051 (the "Property"). You will find a completed conditional use application, a site
plan application, acknowledgement, platting verification, 4 folded blueline copies of
complete site plan submittal, 3 folded blueline copies of the site plan only enclosed with
this letter, which describes the proposed use of the Property. I respectfully request that
this letter and the enclosed documentation be submitted for review, that notice be
given, and that this application be brought to the city council and zoning commission
joint public hearing at the earliest possible date for consideration and approval of the
issuance of a use permit to GLEC for the following intended use of the Property.
Grapevine Lawn Equipment Center, LLC proposes to operate a retail lawn
equipment dealership and service center on the Property, which is nearly 11,000 square
feet of land with a fully enclosed structure of approximately 2,543 square feet upon it.
The Property is within a Light Industrial Zoning District. Under Section 31 of the City
of Grapevine's Zoning Ordinances, the proposed use of the Property is a permitted use
under sections A.6, A.12, and C.11 specifically or by reasonable implication of the plain
and ordinary meaning of the uses contemplated by those sections. It is GLECs
intention to offer high-quality lawn equipment for retail sale on the Property and
service lawn equipment on site as well. GLEC believes that its proposed use of the

in alignment with the uses contemplated for the zoning district in which the Property is
located. As a long-standing resident of the City of Grapevine and as a retired
Grapevine fireman, it is my desire to obtain a Permit to conduct the proposed business
on the Property to enhance and serve the comnumity that I have called home and
served for many years.
I appreciate your consideration of this application, and request that you grant me
a permit to conduct the proposed business on the Property.
