placed on the agenda for public hearing at the discretion of the staff. Based on the size of the
agenda, your application may be scheduled to a later date.
All public hearings will be opened and testimony given by applicants and interested citizenry. Public
hearings may be continued to the next public hearing. Public hearings will not be tabled.
Any changes to a site plan (no matter how minor or major) approved with a conditional use or a
special use permit can only be approved by city council through the public hearing process.
Any application for a change in zoning or for an amendment to the zoning ordinance shall have,
from the date of submittal, a period of four months to request and be scheduled on an agenda
before the Planning and Zoning Commission and City Council. if after said period of four months an
application has not been scheduled before the Commission and Council said application shall be
considered withdrawn, with forfeiture of all filing fees. The application, along with the required
filing fee may be resubmitted any time thereafter for reconsideration. Delays in scheduling
applications before the Planning and Zoning Commission and City Council created by city staff
shall not be considered a part of the four month period.

HERITAGE CROSSING- POLE SIGN
1. Please add a site data chart to the site plan (please see site plan
SP00-06). Please add case number CU10-36, the case name and
address to the signature block shown below.
2. An illumination plan (photometric study) is required to insure that
that light levels at the property line, including the proposed sign, do
not exceed 3.0 footcandles. The photometric study which was
submitted was not readable.
3. Please add the following notes to the site plan:
a) Conditional use request CU10-36 is a request to amend the
previously approved site plan of SP00-06 to allow a 20 -foot
multi -tenant pole sign.
b) All requirements of the Grapevine Soil Erosion Control
Ordinance shall be met during the period of construction.
c) The proposed monument sign was included in the
determination of the illumination levels.
4. Please label the location(s) of the existing light standards. The
minimum required distance from the property line to the proposed
sign is ten (10) feet. Please dimension the distance of the
proposed sign from the property line adjacent to Hall Johnson Road
and provide a graphic scale in addition to the numeric scale.
5. Please provide a location/vicinity map and add the following
adjacent zoning and uses to the site plan: west "CC" Community
Commercial District/personal services; northwest "R-7.5" Single
Family District/single family detached; north "GU" Government Use
District/cemetery; and east "CC" Community Commercial
District/convenience store -gasoline services.
6. Please provide a landscape plan for the subject lot including the
location of the proposed sign.
7. Please include an internal traffic circulation plan on the site plan.
8. Please label all of the existing improvements including pedestrian
walkways.
9. Please include the public common access easement on the adjacent lot in
the open space to the west or remove the west lot from the site plan.
10. Please remove the previous proposed sign location for the site plan.

11. Please note the following preliminary requirements from Building
Inspections. Please direct all questions regarding the following
comments to Don Ellison — Plans Examiner at (817) 410-3160.
a) The pole sign shall designed in accordance with
Chapter 23 of the Grapevine Code and the installation
shall be engineered to facilitate a 90 mile per hour,
three second gust wind speed. The wind pressure
design for signs shall be 20 -Ib psf for signs less than
20 -feet in height.
b) The engineered footing detail shall be sealed by a
State Of Texas Registered Engineer and submitted to
the building inspection department at the time of permit
application.

a digital version of the same
two (2) folded blackline copies of each sheet, (minimum size 22" x 34")

punched, stapled and z -folded (fold the right edge to the left edge
and then fold the right edge in half to form a z -fold).
If these revisions are made and submitted at the correct time, you will be
scheduled for the next available agenda.

On Tuesday evening, February 15, 2011 at 7:30 P.M. in the City Council Chambers, 2nd
Floor, 200 South Main Street, Grapevine, Texas, the City Council and Planning and Zoning
Commission of the City of Grapevine will hold a public hearing to consider the following
items:
CU10-31 - Quick Fill - submitted by Michael Peeples Engineers for property located at 424
East Northwest Highway and proposed to be platted as Lot 1, Block 1, NWH Quickfill
Addition. The applicant is requesting a conditional use permit to amend the previously
approved site plan to demolish the existing structure and to allow gasoline sales and the
possession, storage and retail sales of off -premise consumption of alcoholic beverages
(beer and wine only) in conjunction with a new convenience store. The property is
currently zoned "HC" Highway Commercial and is owned by Ashraf Azziz.
CU10-36 - Heritage Crossing - submitted by B C Contractors for property located at 2140
Hall Johnson Road and platted as Lot 2, Block 1, Hall Johnson Addition. The applicant is
requesting a conditional use permit to allow a 20 foot pole sign. The property is currently
zoned "CC" Community Commercial and is owned by Heritage Crossing Dallas, TX.
Z11-01 & PD1 1-01 - Grapevine Texan Apartments - submitted by The Miles Foundation
for property located at 401 Boyd Drive and proposed to be platted as Lot 2R, Block 1, W R
Boyd Center Addition. The applicant is requesting to rezone 12.35 acres from "CC"
Community Commercial to "R -MF -2" Multifamily District for the development of a 319 unit
3 -story apartment complex. The applicant is also requesting a planned development to
include but not be limited to deviation from the height, dwelling units per acre, open space,
front yard setback, building separation, landscape and parking. The property is currently
zoned "CC" Community Commercial and is owned by The Miles Foundation.
CU11-01 - Murder Mystery Theater - submitted by Lagniappe Productions for property

plan, specifically to revise the floor plan. The property is currently zoned "CBD" Central

CU11-02 - Patty Cakes Bakery - submitted by Patty Wilson/Patty Cakes Bakery LLC for

Addition. The applicant is requesting a conditional use permit to allow the development of
a bakery in the Central Business District. The property is currently zoned "CBD" Central

HL10-14 - Howard -Duke House - submitted by Laurie Verver for property located at 617
East Worth Street and platted as Lot 5, Block 109, College Heights Addition. The applicant
is requesting designation as a historical landmark sub -district. Such sub -district may
include buildings, land, areas, or districts or historical, architectural, archaeological or

REQUESTED CONDITIONAL USE AND COMMENTS:
The applicant is requesting a conditional use permit to allow a 20 -foot multi -tenant pole
siqn in conjunction with an existing neighborhood shopping center.
The applicant proposes to erect a 108- square foot, 20 -foot pole sign adjacent to the west
side of the main entrance along Hall -Johnson Road. The original site plan for the subject
site, SP00-06 approved on June 7, 2000, approved a 20 -foot multi -tenant pole sign which
was never constructed. The previously approved location was approximately 100 -feet west
of the main entrance along Hall -Johnson Road.
PRESENT ZONING AND USE:
The property is currently zoned "CC", Community Commercial District and is developed
with a neighborhood shopping center.

HISTORY OF TRACT AND SURROUNDING AREA:
The subject property was rezoned in the 1984 City Rezoning from "R-1" Single Family
District to "CC", Community Commercial District. A site plan for a small commercial center
was administratively approved in June 2000 (SP00-06). The site is currently developed
with a neighborhood shopping center. C000-74, approved in January 2001, approved a
conditional use permit for the possession, storage, retail sale and on -premise consumption
of alcoholic beverages (beer, wine, and mixed drinks) in conjunction with Zuroma's
restaurant. Conditional Use Permit CU01-44 (Ord. 2001-71) was approved at the
September 18, 2001 meeting which allowed for the possession, storage, retail sale and off -
premise consumption of alcoholic beverages (beer and wine only) in conjunction with a
gourmet and fine wine retail store (The Connoisseur).
The property located to the east of the subject site was rezoned in the 1984 City Rezoning
from "C-2", Community Business District to "CC", Community Commercial District.
Conditional Use Permit 96-23 allowing the possession, storage, retail sale and on -premise
consumption of alcoholic beverages possession, storage, retail sale and off -premise
consumption of alcoholic beverages (beer and wine), was approved by Council on
September 17, 1996 (Ord. No. 96-76). Randy's Chevron Station was subsequently
developed on the site. Conditional use Request CU02-20 approved at the May 29, 2002
Site Plan Review Committee meeting allowed for enclosing of a drive-thru canopy and
conversion to a storage area.
The land located to the northwest of the site was rezoned in the 1984 City Rezoning from
"R-1" Single Family District to "R-7.5", Single -Family District and was subsequently
developed as Belfort Estates. Parker Cemetery is located directly north of the site.
Zoning Case Z83-29, approved in August 1983, rezoned the property located to the south
from "R-1" Single Family District to "R -MF -2", Multifamily Residential District (Ord. No. 83-
47), however the site was not developed. In January 1986, Council approved Z86-01 (Ord.
No. 86-09), rezoning a 16.3 -acre piece of this site to "CC", Community Commercial District
for a mixed use retail concept that never developed. Case No. Z94-01 (Ord. No. 94-17)
revised the stipulations set forth in Ordinance 86-09 by eliminating a 30 -foot right-of-way
dedication for a proposed street that was to connect Heritage Avenue to the southbound
service road of William D. Tate Avenue/State Highway 121. Zoning Case Z97-18 (Ord.
No.97-134) and CU97-47 (Ord. No. 97-135) were approved by Council on December 2,
1997, changing the zoning of the entire site to "CC", Community Commercial District and
approving a conditional use permit for a Planned Commercial Center with the Possession,
storage, retail sale, and off -premise consumption of alcoholic beverages (beer and wine
only) in conjunction with a grocery store. Since that time, CU98-23 (Ord. No. 98-75)
allowing for the realignment of an interior drive aisle and subsequent reallocation of parking
spaces on Lot 1 was approved in June, 1998 and CU98-44 (Ord. No. 98-114) was
approved in September 1998 approving the addition of a monument sign to the site.
CU98-27 (Ord. No. 98-76) for a Wendy's Restaurant with a drive-through window was
approved in September 1998.

MASTER PLAN APPLICATION:
The Master Plan designates the subject property as Commercial. The proposed use
complies with this designation.
THOROUGHFARE PLAN APPLICATION:
The Thoroughfare Plan designates Hall -Johnson Road as a Type B Major Arterial with a
minimum of 80 feet of right-of-way developed as four lanes with a turn lane.

On February 15, 2011, the Planning and Zoning Commission, recommended the City
Council deny the request.
A waiting period of one (1) year between the date an application for amendment to the
zoning ordinance, or a requested change in zoning, is denied by the City Council and a
new application for such a change or amendment is accepted, is hereby established. The
one-year waiting period shall be applicable to all requested amendments and changes for
the same zoning district, or districts, on all or any portion of the property previously
considered for amendment or change in zoning; provided, however, said one-year waiting
period shall not be applicable to any proposed amendment or change instituted by the City
Council or Planning and Zoning Commission or to any proposed amendment or change
denied by the City Council without prejudice.
