Any application for a change in zoning or for an amendment to the zoning ordinance shall have, from the date of submittal, a period of four months to request and be scheduled on an agenda before the Planning and Zoning Commission and City Council. If after said period of four months an application has not been scheduled before the Commission and Council said application shall be considered withdrawn, with forfeiture of all filing fees. The application, along with the required filing fee may be resubmitted any time thereafter for reconsideration. Delays in scheduling applications before the Planning and Zoning Commission and City Council created by city staff shall not be considered a part of the four month period. Sheet 1: In place of the east building elevation insert the BZA request; Special Exception request for the plot plan as shown. Masonry requirement (min. 70%) Ord. 82-73, Section 54 The other 720 sq. ft of retail does not appear to be accounted for on the parking analysis. In addition to labeling the point of sale "POS" please add storage/bottling area to the production area. Add - The entire site is premise to the request. Sheet 2: Remove the Board of Adjustment signature block. Replace the Board request rectangle with the special exception request from page one. Add - The entire site is premise to the request. BACKGROUND We got our start in the wine business 7 years ago in Oregon's Rogue Valley, where we produce small lots of 'boutique wines'. In 2011 we produced more than 24,000 cases of wines for over 25 local vineyards. One of the key lessons we've learned along the way is to focus on 'Sustainability', in both the business sense, as well as environmentally. In addition to seeking out vineyard partners who share this goal, we will make many of our wines available in returnable kegs for 'on -premise' restaurant customers, and in re-useable/returnable bottles sold to in our tasting room. Based upon the objections raised by members of the neighboring businesses and the concerns raised by council members, we would propose the following substantial modifications to our application and would intend to re -submit our application for consideration at the June 15 meeting: • Change of Business Hours: o From 11am-9pm to 11am-5:30pm • Removal of outdoor seating and in -door tables, and ONLY provide a tasting bar area. It was clear that the issues raised by the council members and business community were related to both a lack of parking availability, generally, as well as that the proposed hours of operation, which seemed to indicate a business type that was more of a 'wine bar', rather than a winery operation with a small retail tasting room, as is our true intention. It's important to note that all winery business plans must include retail/tasting room sales capability, because it is a requirement of the United States Alcohol and Tobacco Tax Trade Bureau (TTB) for getting a winery permit. While removing the evening hours of operation will not have any significant impact on our business plan, it should assuage any concerns over parking, noise and any other ancillary issues commonly associated with night time alcohol sales. By making these major changes and cutting back the hours of operation to regular 'business hours', and the removal of outdoor seating, we think these modifications should alleviate the legitimate concerns that were raised, without having any substantial impact on our ability to operate profitably. Please reconsider our submission and let us go before the board and explain our plans in further detail if deemed necessary. Thank you and I look forward to hearing from you.
