SPECIFIC NATURE OF APPEAL:
Requesting permission to build a 4 foot fence in front of our home with a drive gate.
STATE JUSTIFICATION FOR THE APPEAL AND EXPLAIN HOW A HARDSHIP WOULD RF CREATED IF THE
APPEAL IS NOT GRANTED_ EXPLAIN HOW YOUR SITUATION IS PECULIAR TO THE CIRCUMSTANCES
CONTEMPLATED BY THE ORDINANCE AND ATTACH DRAWINGS NECESSARY TO HELP EXPLAIN THE CASE
TO THE BOARD. (YOU DO NOT NEED TO ATTACH THE SAME DRAWINGS AS ATTACHED TO YOUR

Dear Ms. Cook,
Per your request, I am sending a letter officially withdrawing our Building Board of
Appeals action regarding our fencing. After your review of our request and getting
written assurances that the building inspector determined that neither the fence posts nor
the gate going across the driveway exceeding 48" would be a problem, we feel no need to
continue with our appeal. We do understand that the fencing itself will not be allowed to
exceed 48"but we appreciate the understanding that due to the grade of our property, we
did need to adjust the gate slightly to maintain a level top and a 4 ft. section on the short
side of the gate.
Thank you again for helping us determine if our request needed a variance or not, and
ultimately saving city staff and elected/appointed officials' time. We look forward to
getting our new fence installed per the documentation that our contractor has provided
over the last 24 hours. He has assured me that he will file for a new permit under the
newly approved ordinance no later than May 7.

Nature of Agoeal
We are respectfully requesting permission to construct a 4 foot, wooden split rail fence
in front of our home with mesh backing and a drive gate, offering more than 50%
visibility and to be situated over 15 feet off of the street in our dead end cul-de-sac.
Justification for Appeal
We believe this ordinance was originally intended to ensure visibility in a planned
development as our town was booming with subdivisions. Further we believe that the
variance process was intended to pick up unusual circumstances such as ours. The City
Council has not yet heard the recent Building Board of Appeal's recommendation to
enact an exemption for large lots so we are seeking relief through this variance process.
1. Safety: Our circumstances are peculiar in that our home is surrounded by 3 acres,
but located just off the busy intersection of Pool Rd. and Hall Johnson. We also do not
have an HOA, so we must be responsible for our own security and a perimeter fence is
an important part of identifying the boundaries of our personal property. The height is
necessary to keep children and pets safely in their family's yard and ensure that visitors
come through the front gates with acknowledgment from the home owner.A perimeter
security fence was one of the underlying assumptions in the design of our house as
many windows were added to take advantage of one of the highest vista points in our
area.
2. Existing Ordinances: Due to owning 3 acres, we are eligible for livestock, but not a
secure fence that would contain them.
3. Property Value: As more companies relocate to DFW, their executives are looking to
move close to the airport. Grapevine would be an ideal place for those families, but
those executives would likely want a perimeter security fence of more than 3 feet. A
positive result from this appeal will ensure our home stays comparable to those in
Southlake, Colleyville, Keller, Euless, Flower Mound, Irving, Grand Prairie,Arlington and
Fort Worth, who allow security fencing of 4' or greater.
4. Privacy: Not having perimeter fencing has adversely affected our privacy. Our house
was designed with many windows and nestled near the back of the 3 acre lot for
privacy. Not having a secure perimeter has caused a hardship in that we have had to

spend far more than we anticipated in window coverings. We added additional security
features because we have people that walk right up to our home and look in. We will
need to add more if this appeal is not granted. In addition, despite having three dogs
that never get to run on our own property without a leash, several other residents have
found it perfectly acceptable to throw the frisbee for their dogs on our property.

Ms. Cook,
I just spoke with our contractor. The current design of the fence has standard posts and mesh
that comes in 48"sections, therefore the fence posts will rise above the actual fence by about
4", unless we add labor costs to cut the entire fence down. In addition, because of the slope of
our driveway, in order to have a level top of the fence, we would need to exceed 4 feet on one
side of the gate or again have to cut down the entire perimeter fencing to accommodate. In
that case we can go ahead and ask for a slightly tallergate than the fence which looks better
aesthetically. Because of this, we would like to go ahead and continue with our appeal. Our
contractor is working now on elevations for the fence and the gate for us to provide. I will
send them to you as soon as 1 receive them.

I am highly aware of the City of Grapevine final inspection officials and their "
measurements " of fence heights, I built a fence a few weeks ago that I made sure
was an Full inch ( 1" ) Below 8' tall ( at the highest fence point on that fence run
corner) and when the Inspector went to measure the fence height he placed his
tape into a small depression ( about the size of a coke can and 2-3" deep ) at the
corner of the fence where we demo'd some plants to make way for the new fence
and the owner had not finalized his landscaping and Failed Me on the Final. As
yards and grounds are not perfectly smooth or level there will Always we areas
where the final fence height may barely exceed the listed Height because of those
imperfections on the yards ( some places we will have to dig in the wire because of
those imperfections in a higher grade in the yard ) so it is a fine line balance to
meet height requirements and satisfy our customer needs of installing a clean line
fence.
We will be maintaining the final finish fence elevation to not exceed 48" but with
over 800' of fence to be installed there will be a few low area's in the yard and the
vacant lot that we will have to contend with.. I wish inspectors understood this and
were fair.
There is are places along a Kimball ( see pictures ) where fences exceed 8' tall, over
at 2980 Mesa Trail that horizontal fence is 8' 9" tall in places along a Kimball ( see
pictures ) as well as the Lake Park HOA fence at Kimball & Lake Park Dr. that well
exceed 8' tall that inspectors drive by daily but I have yet to see it being cut down
to height, maybe they went through the variance process to have a fence over 8'
tall " in places due to grade " or even the 9' tall fence at Mesa Tr. ( but I doubt it
knowing the process ).
Thanks for letting me vent, B&S Fence will install Mrs. Davis fence per requirements
and drawings.

The Building Official has indicated to me that the post exceeding the height was not a
problem, nor the gates going across the driveway. It is only an issue with the actual
fence sections exceeding the 48".
You indicated on your plans that the fence sections would be 48" plus or
minus. However, if you can maintain your fence sections not to exceed 48" in height
a variance would not be required.
Please let me know what you want to do. If you cannot maintain the 48" height in the
fence sections you will need to proceed with your variance request and provide
exact numbers of heights that a variance is being requested for. You will need to
show an overall elevation drawing showing all areas that are exceeding the 48" of the
fence sections and what that height would be.

Please find attached the requested scope of work as listed in my proposal
to Mrs. Davis along with a newly marked up site plan showing fence & gate
locations, footages for each fence run, and a note on the site plan to
reference attached fence detail drawings for the Fencing and gates. I am
also attaching a cut sheet for the Liftmaster gate operator we will be
using. As the Builder has ran the wiring conduit to the gate opener area

during the home construction the power will be provided to the gate from a
dedicated circuit already in place. Access control keypad mounted to the
gooseneck pedistal for the driveway gate will be a simple wireless unit.
Please let me know if there is anything else you need from me for the
variance process.

together what I think you are putting up based on what you wrote on your
