This letter confirms on January 8, 2018, the Board of Zoning Adjustment withdrew BZA1 7-04
at Staffs request:
During the review process staff determined that the special exception request for the subject
site was not needed due to the approval of BZA86-19 on April 3, 1986, allowing for two (2)
variances—a rear yard encroachment and a front yard encroachment for an existing
residential structure.

minimum lot size of 10,000 square feet. The Board approved a variance allowing a lot
size of 8,913 square feet for an existing lot.
Section 27.6.I., "PO" Professional office District, Area Regulations, requires a
minimum lot width of eighty -feet (80'). The Board approved a variance allowing a lot
width of sixty-three feet (63') for an existing lot.
Section 43.E.3., Nonconforming Uses and Structures allows the Board of Zoning
Adjustment to approve the remodeling and/or enlargement of a nonconforming
use. The Board approved a special exception allow the existing non-residential
structure to remain as developed in addition to site improvements as shown on the site
plan.

We desire to replat a portion of the subdivision and abandon a portion of Red Bird Lane
adjoining subject property. By replatting these lots, we can increase the impervious area and
open space of the lot. Lot 9 (proposed Lot 1, Block A) will increase in impervious area and open
space area by 2,994 Sq. Ft. & 6,048 Sq. Ft., respectively.

Lane. \Neare very much against this proposal. |n1991abuilder proposed neplatting 3lots and
connecting Red Bird Lane (west -Placid Peninsula) and Red Bird Lane (East -Grapevine Lake Estates). The
rep|atvxas rejected and instead the city council voted for Ordinance No. 91-21which created a
Pedestrian, Utility & Drainage Easement on a portion of Red Bird Lane East.
This easement has not been maintained by the Parks department for the last 4 years and adjoining
owners have encroached on the area by planting shrubs, digging ditches and parking boats on the
easement.
There are 29homes located in Placid Peninsula east of Peninsula/Red Bird intersection with only one
way inand one way out. Red Bird Lane isadead-end street with aninadequate turn radius for
emergency vehicles.

I wanted to follow up with you in regard to the illegal subdivision of Block 2 Lot 2 of Grapevine Lake Estates. We
purchase a house on lots Block 2 Lot 1 and Block 2 Lot 2A in 2015. We were not aware that Lot 2 was subdivided into Lot
2A and Lot 213 until we started this ROA application. It's our understanding that the illegal subdivision happen a long
time ago.
During this process we discovered this issue. By working with you and Cristin we proposed to combine the two
lots (Block 2 Lot 1 and Block 2 Lot 2A) to eliminate some of the issue that the illegal subdivision caused. I was able to do
this because we had control and ownership of these properties.
In regard to the other half of the illegal subdivision (Block 2 Lot 213) 1 can provide no help. I do not have a relationship
with the owner of that property nor do I have any legal or other responsibilities of this property.

Albert,
It's been about three weeks since you notified me that the BZA for 3548 Red Bird Lane has been denied. I'm still unclear
as to the reason, but moving forward I will like to discuss with you and Cristin a few option to still make the ROA work
without involving the illegal subdivision at 3548 Red Bird. I have spend a lot of time and money trying to the best thing
for the city and for us, so I'm not ready to give up.
In this meeting I would like to discuss two options:
1. Continuing with the BZA, ROA and replotting the two lots (Lot 9 Block 1 and Lot 1 Block 2) without the illegal
subdivision lot (Lot 2A Block 2).
2. Continue with the original plan by getting the other illegal subdivision lot (Lot 2B Block 2) repotted with Lot 3
Block 2. The owner of this property may not be the person that is occupying it. I still have some research to do.
But before I make contact with the owners, I need to know the benefits to this owners, cost, and process.
I'm available most any time until 7/28.

I hope everything is going well with you.
Just wanted to follow up with you on our status and confirm our next step. I put this on hold for a couple of months due
to being out of town and other issues, but wanted to get this process completed soon.
As we meet last, I will abandon doing anything with the two properties on the south end (Block 2 Lot 1 and Lot 2A). But
before I do I just want to confirm that to move the area in the small "triangle" (between and including the pedestrian
walkway and the north property from Block 2 Lot 1(South) to Block 1 Lot 9 (North)) will require a zoning change. If this
is the case, we will not proceed with this change. Please confirm if this will require a zoning change.
Also I will include the current pedestrian walkway as an pedestrian easement. Question — why 20 feet? That seams like a
lot of feet ... can it be 10 feet? Any news with the Parks and Wildlife on this walkway?
Finally do we need to start the process over with new fees and procedures or just make changes the current
applications. What happens to the application fees for the BZA of the South property that we are abandoning?

When you first emailed me and Albert this last go around, Scott was in Europe. Scott and I went out together to look at
your property late last week. From that meeting, Scott wants the path nailed down that people currently travel. Once
that information is obtained from your surveyor, we will go talk with Parks and Rec about a 10' pedestrian easement
with a 5' paved path that they will put in place, own and maintain.
