Rick,
It's a pretty crazy morning so I'll try to answer your questions over email.
1) Correct. If the BZA determines there is a special condition that would require a special exception then we can
replat Lot 9, Lot 1, and the abandoned ROW.
2) 1 believe we get the BZA to determine if a special exception exists on the lots as they are laid out right now. How
I understand it is that the BZA looks at the lots as they are right now and gives special exception to them, and
once that has been determined we can go forth with the replat and keep the zoning the BZA has decided it can
keep, i.e. no rear yard setback and a 20' front yard setback for Lot 9.
3) In my opinion, it would be best to submit both the ROW Abandonment documents and the BZA variance request
simultaneously. That way the project can move forward as one, with the city having all the info needed to make
a decision about the replat.
4) 1 guess you mean the minimum setbacks for Zone R-7.5? I believe the requirement is 30' front yard setback, a
25' rear yard setback and a 6' setback for side yards. I'll have to double check that a little later. I'm swamped
right now but if memory serves, those numbers are correct.
I'll give you a call as soon as I get a free moment.

Albert,
I wanted to follow up with you in regard to the illegal subdivision of Block 2 Lot 2 of Grapevine Lake Estates. We
purchase a house on lots Block 2 Lot 1 and Block 2 Lot 2A in 2015. We were not aware that Lot 2 was subdivided into Lot
2A and Lot 213 until we started this ROA application. It's our understanding that the illegal subdivision happen a long
time ago.
During this process we discovered this issue. By working with you and Cristin we proposed to combine the two
lots (Block 2 Lot 1 and Block 2 Lot 2A) to eliminate some of the issue that the illegal subdivision caused. I was able to do
this because we had control and ownership of these properties.
In regard to the other half of the illegal subdivision (Block 2 Lot 2B) I can provide no help. I do not have a relationship
with the owner of that property nor do I have any legal or other responsibilities of this property.
