Leonard Survey as follows: Section 16.G.2, "R-5.0" Zero -Lot -Line District, Area Regulations requires a minimum rear yard setback of 25 -feet. The applicant is requesting a variance of seven (7') feet to this requirement, and if approved by the Board would allow a rear yard setback of 18 -feet for a proposed lot. SPECIAL CONDITION: Staff finds that a special condition exists for the variances requested. Specifically, existing, platted and developed property exists to the east and west of the subject property along with right-of-way (Turner Road) to the south; attempts by the applicant to acquire additional property from the property owner to the north have been futile therefore eliminating the possibility of any type of expansion of the property boundaries needed to meet the ordinance requirements. BACKGROUND INFORMATION: The subject property is currently unplatted and it is the applicant's intent to plat the property into one lot for the development of a single family home. The applicant had attempted at the Board's February 5, 2018 meeting to gain variance approval for lot depth for two lots, however the Board denied the applicant's request since the hardship created by subdividing the property into two, separate lots was a self-imposed one which could not be 0A6ZA120181CaseslBZA18-04.41 supported by the Board. The variance for a seven foot encroachment into the rear yard setback is typical relative to the 21 foot reduction in lot depth. The Board in years past has granted variances for this type of encroached into the rear yard setback when lot depth has been less than the minimum required, (e.g. BZA08-03, a nine foot encroachment, BZA08- 05, an eight foot encroachment, BZA05-10, an eight foot encroachment). Lot Size: Lots for any permitted use shall have a minimum area of five thousand (5,000) square feet. 3.
