RECOMMENDATION
Staff recommends the Site Plan Review Committee consider the proposed changes to
the previously approved site plan associated with C000-52 Silver Fox, approved by the
Site Plan Review Committee on September 26, 2000, and take any action necessary.
The original conditional use permit approved the possession, storage, retail sale, and on
premise consumption of alcoholic beverages (beer, wine, and mixed drinks) in
conjunction with a restaurant (Good Eats). Conditional Use permit CU99-05, later
amended the previously approved site plan, allowing the addition of an 8,838 square
foot retail building on the existing lot. Conditional Use permit C000-52 amended the
previously approved site plan to allow the revision of the building elevations, the
enclosure of two existing patios, and the rearrangement of the existing floor plan. The
Proposed amendment would alter the building elevations and allow for the
rearrangement of the previously approved floor plan.
The proposals are as follows:
Building Elevation Revisions:
• The applicant is proposing the deletion of a porte-cochere at the entrance of
the building.
• The applicant is proposing the deletion of the previously approved ornamental
dome.
The applicant is requesting revisions to the previously approved site plan that will
enlarge the bar and bar dining area.

Dear Mr. Vanover:
This letter is to verify that your request for a conditional use permit located 1235 William D. Tate Avenue and
platted as Lot 4R1, Block 1, Tate Street Plaza Revised, to amend the previously approved site plan of C000-52
specifically, to enlarge the bar area and to allow for building elevation revisions, as shown on the approved site
plan, was approved by the Site Plan Review Committee on March 22, 2001. A copy of the approved plans are
enclosed.
On March 22, 2001, the Planning and Zoning Commission, recommended the City Council approve the request.
Any changes to a site plan approved with a conditional use or a special use (no matter how minor or
major) can only be approved by city council through the public hearing process.
No Conditional Use Permit shall be valid for a period longer than one (1) year from the date on which the City
Council grants the Conditional Use, unless within such one (1) year period: (1) a Building Permit is obtained and
the erection or alteration of a structure is started, or (2) an Occupancy Permit is obtained and a use commenced.
The City Council may grant one additional extension not exceeding one (1) year, upon written application, without
notice or hearing. No additional extension shall be granted without complying with the notice and hearing
requirements for an initial application for a Conditional Use Permit.

Dear Stephen:
The purpose of this documentation is to adjust the Site Plan and Conditional Use
Permit to reflect changes proposed to the exterior structure and relocation of bar
from its previously proposed format.
The scope of this work will have no impact on the existing site. The project will
have no impact on the use or enjoyment of any adjacent properties. There are
no changes to the site, vehicular circulation, pedestrian circulation or parking
other than to reconfigure the existing layout to meet current requirements for
handicapped parking. This proposed redevelopment of this facility would
increase the investment in the property and raise the level of quality to the overall
center and the local area.
