when filed and will be placed on the agenda for public hearing at the discretion of
the staff. Based on the size of the agenda, your application may be scheduled to a
later date.

Any changes to a site plan (no matter how minor or major) approved with a
conditional use or a special use permit can only be approved by city council

Any application for a change in zoning or for an amendment to the zoning
ordinance shall have, from the date of submittal, a period of four months to
request and be scheduled on an agenda before the Planning and Zoning
Commission and City Council. If after said period of four months an application
has not been scheduled before the Commission and Council said application shall
be considered withdrawn, with forfeiture of all filing fees. The application, along
with the required filing fee may be resubmitted any time thereafter for
reconsideration. Delays in scheduling applications before the Planning and
Zoning Commission and City Council created by city staff shall not be considered
a part of the four month period.

Request CU18-20 is a request to amend the previously
approved site plan of CU12-09 (Ordinance 2012-16) for an
existing automotive dealership with sales and service of new
and used vehicles, specifically to allow for the addition of a
shade structure adjacent to the existing car wash.
• Please revise the "second" scope box to only include the proposed
canopy.
• Please label the new car delivery as previously approved.
• In lieu of the "upgrade panel notes" for the signs, please label signs
as existing.
• The only sheet required for the final revision submission is A0.02.
Sheets A0.01, A1.11 and 1-1.00 are not required and may be
omitted.
For verification purposes please email a PDF of the final revisions

Staff recommends the Site Plan Review Committee consider the proposed changes to
Conditional Use Request CU12-09 (Ord. 2012-16) approved at the April 17, 2012
meeting for an automobile dealership with sales and service of new and used vehicles,
specifically for the addition of a shade structure, and take any other action necessary.
BACKGROUND INFORMATION
Conditional Use Request CU98-69 (Ord. 1999-09) was approved at the January 5, 1999
meeting to allow for the establishment of an automotive dealership (Park Place Lexus)
with sales and service of new and used vehicles. Conditional Use Request CU99-98
(Ord. 1999-98) was approved at the July 6, 1999 meeting granting an expansion to the
dealership. Conditional Use Request CU04-22 (Ord. 2004-46) was approved at the July
20, 2004 meeting to expand the sales and service areas. At the May 17, 2005 meeting
the City Council approved Conditional Use Request CU05-25 (Ord. 2005-40) on the
subject property which allowed for a 4.95 acre expansion for automobile inventory
storage. The Site Plan Review Committee at their August 24, 2005 meeting approved
Conditional Use Request CU05-40 which allowed for replacement of a 22 -foot pole sign
with a 36 -foot pole sign. Conditional Use Request CU07-42 was approved by the Site
Plan Review Committee at their January 30, 2008 meeting to allow for the addition of a
6,955 -square foot make ready building for new and used vehicles. Conditional use
Request CU12-09 (Ord. 2012-16) was approved at the April 17, 2012 Council meeting
to allow for an expansion to the service garage, car wash, pre -owned sales office and
service drive. Conditional Use Request CU14-17 was approved by the Site Plan
Review Committee at their May 7, 2014 meeting to allow for a 3,350 -square foot new
car delivery area, a 387 -square foot expansion to the previously approved 11,146 -
square foot service garage and elevation revisions to accommodate the proposed
expansions. On August 6, 2014 the Site Plan Review Committee approved Conditional
Use Request CU 14-37 to allow for temporary installation of two trailers (each 60 -feet by
12 -feet in size) that contained five desks to maintain business operations during the
renovation process. One temporary bathroom trailer (28 -feet by 9 -feet in size) was also
proposed. The temporary office trailers and bathroom trailer were scheduled to be
removed in July and October 2015, respectively.

With this request the applicant proposes to add a 613 square foot (28.50 feet by 21.50 -
feet in size) shade structure adjacent to the north side of the existing car wash. The
purpose of the shade structure is to provide a shaded area at the car wash entrance for
employees. Parking required for the dealership is 327 spaces -1,088 have been
provided. No additional changes are proposed to the site.

To Whom It May Concern,
This letter is to verify that your request for a conditional use permit located at 901 East
State Highway 114 and platted as Lot 1, Block 1, Park Place Lexus for an automobile
dealership with sales and service of new and used vehicles, specifically for the addition of
a shade structure was approved by the Site Plan Review Committee on August 8, 2018. A
copy of the approved site plan is enclosed.
Any changes to a site plan approved with a conditional use or a special use (no
matter how minor or major) can only be approved by city council through the public
hearing process.
No Conditional Use Permit shall be valid for a period longer than one (1) yearfrom the date
on which the City Council grants the Conditional Use, unless within such one (1) year
period: (1) a Building Permit is obtained and the erection or alteration of a structure is
started, or (2) an Occupancy Permit is obtained and a use commenced.
The City Council may grant one additional extension not exceeding one (1) year, upon
written application, without notice or hearing. No additional extension shall be granted
without complying with the notice and hearing requirements for an initial application for a
Conditional Use Permit.
