MEMO TO: HONORABLE MAYOR AND MEMBERS OF THE CITY COUNCIL FROM: BRUNO RUMBELOW, CITY MANAGER MEETING DATE: NOVEMBER 6, 2012 SUBJECT: PARKING RESTRICTIONS ON SOUTHWEST GRAPEVINE PARKWAY AND GRAYSON DRIVE RECOMMENDATION: City Council to consider approval of an ordinance amending the Grapevine Code of Ordinances Chapter 23 Traffic, Section 23-63, No Parking Zones, prohibiting parking at various locations on Southwest Grapevine Parkway and Grayson Drive, and take any necessary action. BACKGROUND: Approximately 18 months ago, the City restriped portions of Southwest Grapevine Parkway and Grayson Drive to eliminate the second travel lane and provide areas marked for on-street parallel parking. These changes were made at the request of GameStop to accommodate an increase in the number of employees at their facility at the north corner of William D. Tate Avenue and Southwest Grapevine Parkway. Parking areas were marked to provide adequate sight distance for turning vehicles and to allow for turning movements by the large trucks that frequent that area. Designated parking areas were not striped in areas where parking was not appropriate, such as close to driveways and through the intersection at Grayson Drive. At the time the striping changes were made, it was hoped that the controlled audience of drivers using this parking would voluntarily comply with markings and that enforcement would not be needed. Unfortunately, those utilizing the on-street parking have been consistently disregarding the limits of the parking areas, which results in blocked sight distance and obstructed traffic at several driveways and at the Grayson Drive intersection. The proposed ordinance adds formal restrictions to match the existing markings and allow for police enforcement at the following locations (also see attached exhibit): • Southwest Grapevine Parkway, east side, no parking from William D. Tate Avenue to 273 feet north of William D. Tate Avenue; November 1,2012(8:54AM) • Southwest Grapevine Parkway, east side, no parking from 124 feet south of Grayson Drive to the second driveway north of Grayson Drive; • Southwest Grapevine Parkway, west side, no parking from 100 feet north of Grayson Drive to 50 feet south of Grayson Drive; • Southwest Grapevine Parkway, west side, no parking from 40 feet north to 43 feet south of the first driveway south of Grayson Drive; • Southwest Grapevine Parkway, west side, no parking from 35 feet north to 30 feet south of the second driveway south of Grayson Drive; • Southwest Grapevine Parkway, west side, no parking from 90 feet north of William D. Tate Avenue to William D. Tate Avenue; • Grayson Drive, north side, no parking from Southwest Grapevine Parkway to 1,310 feet west of Southwest Grapevine Parkway; • Grayson Drive, south side, no parking from 45 feet west to 52 feet east of the first driveway west of Southwest Grapevine Parkway; and • Grayson Drive, south side, no parking from 163 feet west of Southwest Grapevine Parkway to Southwest Grapevine Parkway. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS, AMENDING THE GRAPEVINE CODE OF ORDINANCES BY AMENDING CHAPTER 23 TRAFFIC, SECTION 23-63 RELATIVE TO NO PARKING ZONES, RESTRICTED PARKING ZONES; AUTHORIZING THE ERECTION OF TRAFFIC REGULATION SIGNS; REPEALING CONFLICTING ORDINANCES; PROVIDING A PENALTY OF FINE NOT TO EXCEED THE SUM OF TWO HUNDRED DOLLARS ($200.00) FOR EACH OFFENSE AND A SEPARATE OFFENSE SHALL BE DEEMED COMMITTED EACH DAY DURING OR ON WHICH AN OFFENSE OCCURS OR CONTINUES; PROVIDING A SEVERABILITY CLAUSE; DECLARING AN EMERGENCY AND PROVIDING AN EFFECTIVE DATE BE IIT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS: Section 1. li that Chapter 23, Section 23-63, No Parking Zones, Restricted Parking Zones of the Grapevine Code of Ordinances is hereby amended by adding the following: "Grayson Drive, north side, no parking from Southwest Grapevine Parkway to 1,310 feet west of Southwest Grapevine Parkway, Grayson Drive, south side, no parking from 45 feet west to 52 feet east of the first driveway west of Southwest Grapevine Parkway. Grayson Drive, south side, no parking from 163 feet west of Southwest Grapevine Parkway to Southwest Grapevine Parkway. Southwest Grapevine Parkway, east side, no parking from William D. Tate Avenue to 273 feet north of William D. Tate Avenue. Southwest Grapevine Parkway, east side, no parking from 124 feet south of Grayson Drive to the second driveway north of Grayson Drive. Southwest Grapevine Parkway, west side, no parking from 100 feet north of Grayson Drive to 50 feet south of Grayson Drive. Southwest Grapevine Parkway, west side, no parking from 40 feet north to 43 feet south of the first driveway south of Grayson Drive. °1 Southwest Grapevine Parkway, west side, no parking from 35 feet north to 30 feet south of the second driveway south of Grayson Drive. That the City Manager, or his designee, is hereby authorized to have the proper traffic signs erected, constructed, and placed at such points along said highways, streets or alleys, or portions hereof under construction, maintenance or repair so that travelers will be reasonably notified of said traffic regulations. Section 3. That all ordinances or any parts thereof in conflict with the terms of this ordinance shall be and hereby are deemed repealed and of no force or effect; provided, however, that the ordinance or ordinances under which the cases currently filed and pending in the Municipal Court of the City of Grapevine, Texas, shall be deemed repealed only when all such cases filed and pending under such ordinance or ordinances have been disposed of by a final conviction or a finding not guilty or nolo contenders, or dismissal. Section 4. That any person violating any of the provisions of this ordinance shall be deemed guilty of a misdemeanor and upon conviction thereof shall be fined in a sum not to exceed Two Hundred Dollars ($200.00) and a separate offense shall be deemed committed upon each day during or on which a violation occurs or continues. Section 5. That if any section, article, paragraph, sentence, clause, phrase or word in this ordinance, or application thereto any person or circumstances is held invalid or unconstitutional by a Court of competent jurisdiction, such holding shall not affect the validity of the remaining portions of this ordinance; and the City Council hereby declares it would have passed such remaining portions of the ordinance despite such invalidity,which remaining portions shall remain in full force and effect. . Section 6. That the fact that the present ordinances and regulations of the City of Grapevine, Texas are inadequate to properly safeguard the health, safety, morals, peace and general welfare of the public creates an emergency which requires that this ordinance become effective from and after the date of its passage, and it is accordingly so ordained.
