RE: Zoning Application Z04-12, filed by Landmark Condominiums, and listed as item 11 on the
Agenda for the Regular Joint City Council and Planning and Zoning Commission Meeting of
November 16, 2004.
Dear Chairman Oliver:
Please allow me to address the referenced zoning change requested. The applicant is planning to
build a 39-unit luxury condominium complex approximately 1/3rd mile from the extended centerline
of Runway 36R. The Dallas/Fort Worth International Airport views with concern the proposed
residential use of this property, given the noise levels, aircraft activity and related public policy
described below.
The 8.69 acres of concern lies well within the Airport's official noise contour, proximate to the
75DNL contour. According to Federal Aviation Administration guidelines, development of
residential use within the 65 & 70DNL contours is considered incompatible land usage, however
where the community determines that the development must be allowed, mitigation measures may
be taken to render the inside of the units compatible. Outside noise remains unchanged. According
to these same FAA guidelines, residential construction within the 75DNL "should be prohibited".
There are no mitigation measures that will render the unit compatible by federal standards.
The site is located approximately 3.6 statute miles from the end of Runway 36R. During South Flow,
the residents of the proposed complex should expect to hear approximately 420 arrivals passing
within 0.5 statute mile to the west of the complex at altitudes of 800- 1100' above the ground
(AGL). During North Flow, the residents should expect to hear approximately 175 departures
passing within 0.5 statute mile of the complex at altitudes of 900-4100'AGL.
The concerns listed above were discussed with Mr. Jerry Stone of Duke, Inc. in regard to a 14.3-acre
track that includes the 8.69 acres of concern here. The discussion occurred in April 2004, and was
recorded in a letter to Mr. Stone (copy to Mr. Tommy Hardy) in May. A copy is enclosed.
The Airport encourages the City to consider the facts above in its decision. In the event that the
City determines the proposed conditional use permit is in its best interest, the Airport Board
recommends the following:
1. An avigation easement be dedicated to the Grapevine, the Dallas/Fort Worth
International Airport Board, the City of Dallas, and the City of Fort Worth, and
2. the 30dB Noise Level Reduction recommended by the FAA for residential
construction in the 70DNt noise contour be mandated and confirmed.
