The traffic on Old Mill Run is currently very high. But that appears to be tied to activity at the surrounding schools. I can't imagine anyone taking Old Mill Run (who isn't already doing so) just to patronize a retail establishment. A very small, but vocal minority suctessfinlly kept us from having a new AlbertWWs nearby. instead we got a Krispy KMne and a CVS which I submit is the source of at least an equal amount of increassed traffic... on Pool Road. If a secret ballot were to be taken of the residents most likely to be affected, we'd have a mwby supermarket. I emphasize secs because the majority in favor are not likely to want to be branded as traitors and would rather no create any waves with neighbors and are not meeting goers. I don't think I would have taken the time to send this were it not for the fact that I am on vacation today and the notices taped to the dons of the people in this area indicate that the anti -neighborhood shopping group is at it again. MOV -18-02 12:53 PM GEORGEHAU"I To: Planning and Zoning Hoard City of Ofvevhw Re: GMM im►esttMAts coon Z-07,1,9 pool-, fid, PLANNING ro aElf As an interested citizen X protest the request to rezone this property and hart the following comments: The requests to rezone property at the southwest comer Of pool Road and Highway 26 was denied u the City Council in the fall of 1998 and again in the fail of 2008. i4ow the same developers are back with a request for a zona -,change that wauld allow them to da that which hes Lig [d tda Jz the Citi coma . Consider the following: 1. Two Previous Requests denied L Environmental Damage: To rezone this property from its present category to agow more intense development would result in a substantial increase in the environmental damage to Bear Creek and its flood plain. The increase in contaminated runoff from parking areas would include greater amounts of oil and anti -freeze due to increased use. There would be an increase in air pollution to add to that already occurring as a result of our proximity to DFW Airport and the ever increasing high trdf'ic counts due to additional residential and commercial development in the area that has occurred since the two previous denials. The noise and tight pollution that follow$ a retail/commercial operation would disturb nearby residents constantly. 3. Safety of School Children: The three schools in the immediate area (one of which is just across pool Road from the subject property) is a primary concern. There is more trarne congestion in the area now than there was on the two previous occasions a change was requested and denied. The danger to school children will only increase going forward. Pool Road is already heavily congested due to the high number of vehicles from both Colleyville and Southlake. as well as the increased traffic on Hiighhway 26 from Grapevine Aral surrounding anal. The Reel depots and ready mix concrete plants, flit of which are across Highway 26 from the subject peopertY, pose additional danger to children walking to school, as do passenger cars and delivery trucks already using this route. Valves would surely 4. Negative impact on the Quality of Life and Decline in property follow were this zoning change request be granted. Grapevine prides itself on providing a high quality of life, promotes itself as providing such, and is one of the primary reasons we chose it as our bome2O years ago. With the approval of this change, there is greatly increased potential for a higher crime rate as well as an increase in the already high non-residerrt traffic count. Most importantly, to allow this cbange would pose a great safetyu conoant, notwithstanding the inconvenience to the residents and the negative impact on quality of life issues. Change to the present zoning designation is strongly opposed by the most residents of the sub -division. Further, it is well documented that propertyvalues decline and quality of life suffers in residential areas adjacent to commercial and/or retail development. ro. for the vrovamLagf am( Jamie and George Hight 3852 Ridgeview Drive Grapevine, Texas 76051-6307 File:CU02-47 r, AUTO M N LEAVES WRITTEN COMMENTS MUST BE RECEIVED BY THIS OFFICE NO LATER 1 THAN 5 PM ON MONDAY, NOVEMBER 18, 2002 £ f V1 Procedure to Respond:"I V 18 20o _ PLAN erty Owner within 200 feet of the subject tract) or (an interested ci i r ' I (approve) protest) and/or (have the following comments) Print Name and Address, or Lot, Block and Subdivision: . - GrA t -r- . CU02-47 is on the Planning and Zoning Commission's agenda for November 19, 2002. The requested conditional use permit pertains to a tract of land at the southwest corner of the intersection of Mustang Drive and Southwest Grapevine Parkway. The proposed new use is for a personal care facility. The Dallas/Fort Worth International Airport views the proposed conditional use with concern, given the noise levels and known aircraft activity. The tract of concern lies well within the 65DNL contour of the Airport's official noise map. According to Federal Aviation Administration guidelines, development of nursing homes within the 65DNL contour is considered jacompatible land usage. The site is located 1.3 miles from the end of Runway 13R/31 L at approximately /2 mile from the runway's extended centerline. The site is subject to routine and regular air traffic by all types of aircraft operating at DFW International Airport. Historical flight data indicates that these aircraft operate adjacent to the property as low as 250 feet above the ground. The Airport encourages the City to consider the facts above in its decision. In the event that the City determines the proposed conditional use permit is in its best interest, the Airport Board recommends the following: 1. An avigation easement be dedicated to the Dallas/Fort Worth International Airport Board, the City of Dallas, and the City of Fort Worth, and 2. the 25clB Noise Level Reduction recommended by the FAA be established as a mandatory condition of approval. If granted, this request would permit the construction of personal care facilities (assisted living and independent living units for the elderly) within the 65 LdN and the 75 LdN noise contours of the Airport. Current Federal Administration guidelines indicate that such facilities can be likened to hospitals which are compatible only if constructed to achieve a 30 dBA Noise Level Reduction between the exterior and the interior of the proposed structure. However, in the event the City determines the project and its location are in the City's best interest, the Airport strongly recommends officials take the following actions: ■ The applicant grant an avigation easement over the property naming DFW International Airport Board, the Cities of Dallas and Fort Worth and the City of Grapevine as grantees. ■ City of Grapevine inform all parties that the site would not be eligible for any noise mitigation assistance from DFW now or in the future. ■ Contact the Federal Aviation Administration for the purpose of Air Space Regulations regarding planned use. t ..,.. • .. ra .,1 . ,,/ 4 CIO* .rxpiY 'e4i4 t! • * _ _ [t IKt ^ tri Ltd..panus .; Y ''?► t 16ir"i 16 a • _ 1/rlai 'le•111a11 ®MFlW!®O wMPi. 19 . Pr^—"_YA.!<R'rt p 0 C='' j • - qQ oQ a JO( •,,h a (j < 4) yUil t c OC=OOO... =CQl=Oc)=Or"" • Q l ° G'a C7"E 0 0 © oa 0 ° • a ' Air a— 9 • s :' Y SMOouuw Nvu + 9 aw g t 7'11Y? + !f +'g r i s'. ..i!m• ..3 gg1a' ® _nw a aft a•e ..._t i"- Arlt \"itiqi L"+ y p' I res° i am", ... %" r 0 s ! The designations contained this table do not constitute a Federal determination that any use of land covered by the program is acceptable or M.Oept"under Federal, State, or local law. The responsibility for determining the acceptable and permissible land uses and the relationship between specific properties and specific noise contours rests with the local authorities. FAA determinations under Part 150 are not intended to substitute federally determined land uses for those determined to be appropriate by local authorities in response to locally determined needs and values in achieving noise compatible land uses. KEY TO TABLE 1 SLUCM Standard Land Use Coding Manual. Y (Yes) Land Use and related structures compatible without restrictions. N (No) Land Use and related structures are not compatible and should be prohibited. NLR Noise Level Reduction (outdoor to indoor) to be achieved through incorporation of noise attenuation into the design and construction of the structure. 25, 30, or 35 Land used and related structures generally compatible; measures to achieve NLR or 25, 30, or 35 dB must be incorporated into design and construction of structure. tr- 12 AIRPORT NOISE COMPATIBILITY PLANNING PART' 150 NOTES FOR TABLE 1 (1) Where the community determines that residen- tial or school uses must be allowed, measures to achieve outdoor to indoor Noise Level Reduction (MR) of at least 25 dB and 30 dB should be in- corporated into budding codes and be considered in iadid approvals. Normal residential con- struction an be expected to provide a NLR of 20 dB, thus, the reduction requirements are often stated as 5,10 or 16 dB over standard construc- tion and normally assume mechanical ventilation and closed windows year round. However, the use of NLR criteria will not eliminate outdoor noise problems. (2) Measures to achieve NLR of 25 dB must be in- corporated into the design and construction of portions of these buildings where the public is received, office areas, noise sensitive areas or where the normal noise level is low. (3) Measures to achieve NLR of 30 dB must be in- corporated into the design and construction of portions of these buildings where the public is received, office cress, noise sensitive areas or where the normal noise level is low. (4) Measures to achieve NLR of 35 dB must be in- corporated into the design and construction of portions of these buildings where the public is received, office areas, noise sensitive are or where the normal noise level is low. (5) Land use compatible provided special sound reinforcement systems are installed. (6) Residential buildings require an NLR of 25. (7) Residential buildings require an NLR of 30. (8) Residential buildings not permitted. A150.103 Use of Computer Prediction mod*. (a) The airport operator shall acquire the avia- tion operations data necessary to develop noise exposure contours using an FAA approved meth- odology or computer program, such as the In- tegrated Noise Model RM. In considering approval of a methodology or computer program, key factors include the demonstrated capability to produce the required output and the public availability of the program or methodology to provide interested parties the opportunity to substantiate the results. (b) The following information must be ob- tained for iagat to the calculation of noise ex- posure contours: (1) A map of the airport and its environs at an adequately detailed scale (not less than 1 inch to 8,000 feet) indicating runway length, alignments, landing thresholds, takeoff start - of -roll points, airport boundary, and flight tracks out to at least 30,000 feet from the end of each runway. (2) Airport activity levels and operational data which will indicate, on an annual average - daily -basis, the number of aircraft, by type of aircraft, which utilize each flight track, in both the standard daytime (0700- 2200 hours local) and nighttime (2200-0700 hours local) periods for both landings and takeoffs. (3) For landings—glide slopes, glide slope in- tercept altitudes, and other pertinent informa- tion needed to establish approach profiles along with the engine power levels needed to fly that approach profile. (4) For takeoffs—the flight profile which is the relationship of altitude to distance from start -of -roll along with the engine power levels needed to fly that takeoff profile, these data must reflect the use of noise abatement depar- ture procedures and, if applicable, the takeoff weight of the aircraft or some proxy for weight such as stage length. (5) Existing topographical or airspace restrictions which preclude the utilization of alternative flight tracks. (6) The government furnished data depict- ing aircraft noise characteristics (if not already a part of the computer program's stored data bank). (7) Airport elevation and average tempera- ture.
