Green, Inc. J.A. Green owns the property where the proposed telecommunications use is being requested. They do constitute an excess of 20% of the surrounding property. Therefore, a3/4vote is required in order to approve this request. Box 95104 Grapevine, Texas 76099 rh`Fr,FIVED AUG 3 i 2000 We protest for the following reasons: The erection of an above -ground equipment building on the subject tract by Voicestream Wireless would significantly impair the appearance of the subject tract and may adversely affect our ability to Lease the buildings located thereon. We have recently incurred significant expense with respect to landscaping and other site improvements in compliance with approved building plans for the subject tract; and 2. Voicestream Wireless has not obtained our consent to the construction of either an above- ground or underground structure on the subject tract, apparently relying upon rights obtained from TXU Electric under its aerial easement recorded in Volume 5351 Page 182 (although we have not received evidence from either Voicestream Wireless or TXU Electric that such rights have been transferred). However, we have been advised that, under the terms of such easement, TXU Electric's right to erect structures on the subject tract is expressly limited to the right to construct only one equipment pole, so that the construction of an equipment building by Voicestream Wireless would arguably constitute a violation of the easement by TXU Electric and trespass by Voicestream Wireless. t,� A 6V-O/V-,-
