HARDY, DIRECTOR OF DEV4OPMENT SERVICESWi 4 i MEETING DATE: JULY 16, 1996 '1 SUBJECT: PROPOSED AMENDMENTS TO SECTION 49, SPECIAL URE PERMITS OF THE GRAPEVINE COMPREHENSIVE ZONING ORDINANCE 82-73 Staff recommends City Council and the Planning and Zoning Commission review and consider the proposed amendment relative to height of churches and take any action deemed necessary. The attached amendment to Section 49, Special Use Permits would allow churches who wish to exceed the maximum height of their specific zoning district to apply for a special use permit to be approved by City Council. At the request of the Board of Zoning Adjustment, Staff brought the issue of churches requesting variances to exceed the maximum height regulations to the Planning and Zoning Commission at the June 13, 1996 Workshop. The Board of Zoning Adjustment felt these requests were more land use oriented because they have no physical hardships to relate. The Planning and Zoning Commission authorized Staff to set a public hearing to review and consider the proposed amendments on July 16, 1996. 0:\ZCU\AM490716.96 July 3, 1996 4:27pm DRAFT COPY 06/25/96 SPECIAL USE PERMITS C, D, or E thoroughfare on the Grapevine Thoroughfare Plan. (b) The following minimum design requirements shall be required for Neighborhood Day Care Centers permitted as a Special Use. (1) Lots for Neighborhood Day Care Centers permitted as a special use shall have a minimum lot area of one (1) acre. (2) Width of lot, feet - 150. (3) Depth of lot, feet - 175. (4) A landscape plan, meeting the requirements of Section 53. (5) Required front yards shall be landscaped with grass, shrubbery, vines, or trees and no part shall be paved or surfaced except for minimum access, driveways, and sidewalks in accordance with Section 53 of this ordinance. (6) Garbage storage shall be screened on all four sides by a solid wooden or masonry fence and located on a concrete pad not less than fifty (50) feet to any adjoining property. ITIM MW Omni IMIMMAWK.6,111 C. APPLICATION: An application for a Special Use Permit may be filed by the owner of, or other person having a contractual or possessory interest in, the subject property. Any application filed by a person who is not the owner of the property for which the special use permit is sought shall be accompanied by evidence of the consent of the owner. D. CONTENTS OF APPLICATION. An application for a Special Use Permit shall be filed with the Director of Development Services, or such other official as he may designate. The application shall contain the following information as well as such additional information as may be prescribed by rule of the Commission or the Director of Development Services. 052196 10 Section 49
