KNOW ALL MEN BY THESE PRESENTS:
COUNTY OF TARRANT
That Mountainprize, Inc., hereinafter called ("Grantor'), for and in consideration
of the sum of TEN AND NO/100 DOLLAR ($10.00) and other good and valuable
consideration to Grantor in hand paid by the Town of Flower Mound, a Texas municipal
corporation ("Grantee"), the receipt and sufficiency of which are hereby acknowledged,
does hereby give, grant, and convey unto Grantee, subject to the terms and provisions
hereinafter stated, a non- exclusive,permanent, and perpetual Drainage Easement and right
to construct, reconstruct and perpetually maintain storm drainage and positive overflow
facilities (the "Facilities") in, on and under the following described property (the
Permanent Easement Area"):
A permanent 1.616 acre Drainage Easement, as more
particularly described and depicted in Exhibits "A" and "D",
attached hereto and made a part hereof.
The Grantee herein, its successors and assigns, shall have, and it is hereby granted,
the right of ingress and egress over that portion of the servant estate as is reasonably

necessary to and for the limited purpose of accessing the Easement Property herein
granted.
The foregoing easements are conditioned upon Grantee (i) exercising its rights in a
manner to minimize any interference with Grantor's property, and (ii) repairing any
damage it causes to Grantor's property or improvements including the monument sign
located (or to be located) on the Easement Property, which monument sign is consented to
by the Grantee.
Additionally, Grantor does hereby give, grant, and convey unto Grantee Temporary
Constriction Easements for the purpose of installing the Facilities in the above-described
Drainage Easement, together with the right of ingress and egress as necessary for the
installation of the Facilities, said Temporary Construction Easements to be in and over the
following described property (the"Temporary Easement Area"):
Temporary Construction Easements totally 1.153 acres
located immediately adjacent to the above described
permanent Drainage Easement, as more particularly
described and depicted in Exhibits `B", "C", and "D",
attached hereto and made a part hereof.
There are no liens, attachments, or other encumbrances which will affect the title or right
of the Grantor to convey this easement to the Grantee for the purposes as described herein.
If such condition does exist, a signat+ira with u:,;L .,wledgment shall be included and made
a part of this document conveying the rights and privileges contained herein, and
subordinating any such lien or encumbrance to the easement granted herein,
TO HAVE AND TO HOLD the Easement Property unto the Grantee for the
purposes herein set forth, Grantor hereby binds Grantor's successors / heirs, executors,
administrators and assigns, to warrant and forever defend the easement and rights granted
herein unto Grantee, its successors and assigns against every person whomsoever lawfully
claiming or to claim the same or any part thereof by, through or under Grantor but not
otherwise.

is still under review and not approved.
Wall sign: Location of Sign labeled E is on left side elevation, elevation drawing shows it will be on front elevation.
Canopy sign: Provide elevation of the canopy showing sign on it.
Monument sign: Monument sign shall not be constructed within easement, contact Paul Lee, Senior Engineer in Public
Works Department at 817-410-3136 for easement locations. Provide complete sign plan.
Changeable copy in the monument sign shall not exceed 30%of the sign area, proposed sign shows more than 30%
changeable copy, provide revised drawing to comply with CU 13-34 approved changeable copy.
Provide legible copy of page 39 and 40 detail drawings for changeable copy signs.
Foundation drawing submitted with the permit is sealed and signed by State of Georgia registered engineer.
Label grade level on the sign drawing.
Provide required information in two hard copies 11" x 17" size paper.
