TRIPLETT, JR, PLANNER II DATE: MAY 8, 2019 SUBJECT: CONDITIONAL USE REQUEST CU19-11, LOT 1R2A, BLOCK 1R1, CLASSIC HUMMER ADDITION RECOMMENDATION Staff recommends the Site Plan Review Committee consider the proposed changes to Conditional Use Request CU18-16 (Ord. 2018-53) approved at the June 19, 2018 meeting for a planned commercial center for an automotive dealership with the sale and repair of new and used vehicles, specifically to allow the addition of a shade structure and take any other action necessary. BACKGROUND INFORMATION The original Conditional Use Request CU01-27 establishing the automotive dealership was approved by Council on June 19, 2001. A subsequent amendment occurred at the February 19, 2002 meeting (CU02-03) which allowed for an expansion of the former Hummer dealership main structure and the relocation of the Classic Chevrolet used truck operation to the site. Another amendment to the site plan was approved by Council at their November 19, 2002 meeting (CU02-49) which allowed for a 5.3 -acre addition to the site for a lube and tune center, a vehicle washing area, and an employee parking lot. The Site Plan Review Committee at their July 23, 2003 meeting (CU03-25) allowed an increase from 20 -feet to a height of a 30 -foot for a pole sign on the site for the Hummer dealership. Conditional Use Request CU03-34, approved at the September 16, 2003 meeting allowed for the addition of an automotive reconditioning/detail shop to the Hummer dealership. The Site Plan Review Committee at their September 8, 2004 meeting approved Conditional Use Request CU04-30 to allow for the erection of shade structures over the bulk of the vehicle display area to reduce heat in the vehicles and protect the vehicles from hail damage. The Site Plan Review Committee at their March 12, 2008 meeting approved Conditional Use Request CU08-05 to allow for the construction of an E-85 vehicle fueling station. The vehicle fueling station is open to the public but is an alternative fuel, used by vehicles whose engines have been modified to use the fuel. Conditional Use Request CU08-05A for a proposed expansion was tabled and later withdrawn to allow more time to prepare a comprehensive development plan for the site. Conditional Use Request CU08-23 (Ord. 2008-55) approved at the October 21, 2008 joint public hearing included expansion of the site by adding acreage, allow the development of a fleet sales building, O:\ZCU\C U 19-11.4sprc increase the square footage of an existing parts and distribution facility and to establish a planned commercial center to allow a pole sign 40 -feet in height. At the October 20, 2009 meeting Council approved a one-year extension to Conditional Use Request CU08-23. Conditional Use Request CU10-01 (Ord. 2010-04) approved at the February 16, 2010 joint public hearing allowed for a 1,300 square foot addition to an existing parts distribution facility totaling 23,581 square feet. The Site Plan Review Committee at their May 5, 2010 meeting approved CU10-07 to allow the addition of 157 parking spaces, revise the parking configuration and exterior elevations for the fleet sales building, and relocate a previously approved pole sign. Conditional Use Request CU18-16 (Ord. 2018-53) approved at the June 19, 2018 public hearing allowed for a 5,760 square foot medium duty truck facility. The facility replaced a 2,950 square foot lube/car wash. With this request the applicant proposes to add a 1,782 square foot, approximately eleven feet in height, shade structure atop eleven existing parking spaces adjacent to the south side of an existing detail shop. The purpose of the shade structure is to provide a shaded area for customer vehicles. No additional changes are proposed to the site. /at O:\ZCU\CU 19-11.4sprc GENERAL NOTES 1. ALL MATERIALS AND WORKMANSHIP SHALL BE SUBJECT TO INSPECTION BY THE CITY. THE CITY RESERVES THE RIGHT TO ACCEPT OR REJECT ANY MATERIALS AND WORKMANSHIP THAT DOES NOT CONFORM TO ITS STANDARDS AND SPECIFICATIONS. 2. IT IS THE DESIGN ENGINEER'S RESPONSIBILITY TO ACCURATELY SHOW EXISTING CONDITIONS, BOTH ONSITE AND OFF-SITE, ON THE CONSTRUCTION PLANS, ANY MODIFICATIONS NEEDED DUE TO CONFLICTS, OMISSIONS, OR CHANGED CONDITIONS EITHER ON-SITE OR OFF-SITE, THAT ARISE IN THE FIELD, WILL BE ENTIRELY THE DEVELOPER'S RESPONSIBILITY. THE COST TO RECTIFY ANY ADVERSE SITUATION TO MEET THE CITY STANDARDS AND SPECIFICATIONS SHALL BE BORNE SOLELY BY THE DEVELOPER. 3. THE CONTRACTOR SHALL NOT DEVIATE FROM THE PLANS WITHOUT FIRST OBTAINING WRITTEN APPROVAL FROM THE OWNER AND THE DESIGN ENGINEER. THE CONTRACTOR SHALL CONTACT THE DESIGN ENGINEER IMMEDIATELY UPON DISCOVERY OF ANY ERRORS OR INCONSISTENCIES. 4. THE LIMITS OF CONSTRUCTION SHALL REMAIN WITHIN THE PROPERTY LINE UNLESS OTHERWISE NOTED. THE OWNERIDEVELOPER MUST OBTAIN THE WRITTEN PERMISSION OF THE ADJACENT PROPERTY OWNER(S) PRIOR TO ANY OFF-SITE GRADING OR CONSTRUCTION. 5.
