HomeMy WebLinkAboutItem 08 - Hanover Drive and Municipal Way ITEM # 6q MEMO TO: HONORABLE MAYOR AND MEMBERS OF THE CITY COUNCIL FROM: BRUNO RUMBELOW, CITY MANAGER MEETING DATE: SEPTEMBER 21, 2010 SUBJECT: REMOVAL OF PARKING RESTRICTIONS ON PORTIONS OF HANOVER DRIVE AND MUNICIPAL WAY RECOMMENDATION City Council consider adopting an ordinance amending Chapter 23,Traffic, Section 23-63, No Parking Zones of the Code of Ordinances to modify existing parking restrictions to allow parallel parking and prohibiting truck parking on: • Hanover Drive from Main Street to 200 feet east of Municipal Way (south side), • Hanover Drive from Main Street to Municipal Way (north side), and • Municipal Way from Hanover Drive to Capitol Street (east and west side), prohibit parking on: * Municipal Way from Capitol Street to State Highway 114 Westbound Frontage Road and take any necessary action. BACKGROUND: Steve Hartnett, the developer of Bob's Steak&Chop House at 1255 South Main Street has requested that parallel parking be permitted on the two City streets bordering that property to accommodate additional patrons. The property on which the restaurant is located also includes Fireside Pies and pad sites for two additional restaurants. Staff has reviewed the request and the existing conditions on the three streets. Since the existing streets are wide and carry relatively low traffic volumes, the requested parallel parking can be accommodated on these street segments without creating a detrimental impact on traffic safety or flow. Hanover Drive, from Main Street to Minter's Chapel Road, is presently marked for two travel lanes in each direction. The proposed modification would remove one eastbound travel lane from Main Street to 200 feet east of Municipal Way and one westbound travel lane from Municipal Way to Main Street. Municipal Way, from Hanover Drive to Capitol Street, is wide enough for four lanes but is presently marked for one travel lane in each direction with a center two-way left-turn lane. The proposed modification would restripe this segment with one lane in each direction, remove the unnecessary center turn lane and provide adequate space along the east and west sides of the street for parallel parking. R:IAGENDA 109-21-101AGMEMO.Municipal Way parking.092110.doc The proposed ordinance also includes a prohibition of truck parking in the three segments where parallel parking would otherwise now be permitted.Appropriate signing changes will be made to inform drivers of the parking restrictions. The proposed ordinance also prohibits parking along both sides of Municipal Way from Capitol Street to the State Highway 114 Westbound Frontage Road. This segment was previously not included in the Code of Ordinances because this segment was not initially a public street, but it has since been dedicated to the City. The roadway currently has "No Parking" signs in place. Staff recommends approval. RC/MP 0:1AGENDA12010109-21-101AGMEMb.Municipal Way parking.092110.doc ORDINANCE NO. � 1l" AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS, AMENDING THE GRAPEVINE CODE OF ORDINANCES BY AMENDING CHAPTER 23 TRAFFIC, SECTION 23-63 RELATIVE TO NO PARKING ZONES, RESTRICTED PARKING ZONES; AUTHORIZING THE ERECTION OF TRAFFIC REGULATION SIGNS; REPEALING CONFLICTING ORDINANCES; PROVIDING A PENALTY OF FINE NOT TO EXCEED THE SUM OF TWO HUNDRED DOLLARS ($200.00) FOR EACH OFFENSE AND A SEPARATE OFFENSE SHALL BE DEEMED COMMITTED EACH DAY DURING OR ON WHICH AN OFFENSE OCCURS OR CONTINUES; PROVIDING A SEVERABILITY CLAUSE; DECLARING AN EMERGENCY AND PROVIDING AN EFFECTIVE DATE NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS: Section 1. That Chapter 23, Section 23-63, No Parking Zones, Restricted Parking Zones of the Grapevine Code of Ordinances is hereby amended to read as follows: Deleted in its entirety "Hanover Drive, north and south sides, no parking, from Main Street to Minter's Chapel Road Municipal Way, east and west sides, no parking from the intersection with Nash Street to the intersection with Capitol Drive" Added "Hanover Drive, north side, no parking from Municipal Wayto Minter's Chapel Road. Hanover Drive, north side, no truck parking from Main Street to Municipal Way. Hanover Drive, south side, no truck parking from Main Street to a point 200 feet east of Municipal Way. Hanover Drive, south side, no parking from a point 200 feet east of Municipal Way to Minter's Chapel Road. Municipal Way, east and west side, no truck parking from Hanover Drive to Capitol Street. Municipal Way, east and west sides, no parking from Capitol Street to State Highway 114 Westbound Frontage Road." Section 2. That the City Manager, or his designee, is hereby authorized to have the proper traffic signs erected, constructed, and placed at such points along said highways, streets or alleys, or portions hereof under construction, maintenance or repair so that travelers will be reasonably notified of said traffic regulations. Section 3. That all ordinances or any parts thereof in conflict with the terms of this ordinance shall be and hereby are deemed repealed and of no force or effect; provided, however, that the ordinance or ordinances under which the cases currently filed and pending in the Municipal Court of the City of Grapevine,Texas, shall be deemed repealed only when all such cases filed and pending under such ordinance or ordinances have been disposed of by a final conviction or a finding not guilty or nolo contendere, or dismissal. Section 4. That any person violating any of the provisions of this ordinance shall be deemed guilty of a misdemeanor and upon conviction thereof shall be fined in a sum not to exceed Two Hundred Dollars ($200.00) and a separate offense shall be deemed committed upon each day during or on which a violation occurs or continues_ Section 5. That if any section, article, paragraph, sentence, clause, phrase or word in this ordinance, or application thereto any person or circumstances is held invalid or unconstitutional by a Court of competent jurisdiction, such holding shall not affect the validity of the remaining portions of this ordinance; and the City Council hereby declares it would have passed such remaining portions of the ordinance despite such invalidity,which remaining portions shall remain in full force and effect. Section 6. That the fact that the present ordinances and regulations of the City of Grapevine, Texas are inadequate to properly safeguard the health, safety, morals, peace and general welfare of the public creates an emergency which requires that this ordinance become effective from and after the date of its passage, and it is accordingly so ordained.
