AMENDMENTS TO COMPREHENSIVE ZONING ORDINANCE 82-73
The City Council and the Commission will consider amendments and changes to the
Comprehensive Zoning Ordinance, No. 82-73, same being Appendix D of the Code of
Ordinances as follows:
Sections 12 and 49 relative to paid off-street parking;
and any other additions, deletions, or changes to various sections, articles and provisions
contained in said Ordinance No. 82-73.

RECOMMENDATION
Staff recommends the Planning and Zoning Commission and the City Council consider
amendments to the Comprehensive Zoning Ordinance, relative to Section 12,
Definitions, and Section 49, Special Use Permits, relative to a provision for paid off-
street parking, and take any action necessary.
BACKGROUND INFORMATION
Sections 12 and 49
Currently, the City's zoning ordinance has no provisions regarding landowners or
tenants that elect to charge patrons to park in their off-street parking lots. At the
medical office building located at 1601 Lancaster Drive, the property owner has installed
ticket gates at the entrance and has been charging a fee to visitors and patients that
park their vehicles in the parking lot. The situation has created a number of problems.
Specifically, customers are now parking their vehicles on Lancaster Drive and other lots
in the area rather than in the lot. Fire and other large emergency vehicles are unable to
enter the site because of the gates. Staff recommends adding a provision into the
zoning ordinance which would require a Special Use Permit for paid off-street parking to
help prevent another situation in the future.
Staff has drafted an amendment to Section 12, Definitions, to broaden the definition
"Off -Street Parking" and incorporate `paid parking'. Also, Section 49, Special Use
Permits, has been amended to create a mechanism for regulating the implementation of
paid off-street parking lots. An exception has been provided to the Special Use
requirement for valet parking services. While valet services typically use required off-
street parking spaces, the use of the services is also voluntary.

Section 12 - Definitions

279. NURSING HOME shall mean an institution where persons suffering from
generally permanent types of illness, injury, deformity, deficiency of age, are
given care and treatment on a prolonged or permanent basis, and which is
licensed by the State of Texas or the City of Grapevine.
280-299. RESERVED FOR FUTURE USE.
300. OFF-STREET PARKING shall mean asphalt or concrete surface areas upon
which motor vehicles may be parked and which area has access to a public
street. The minimum reauired off-street parkins shall_ be provided to
patrons of the associated use free of charge, unless approved with a
Special Use Permit in accordance with Section 49 of this ordinance.
301. RESERVED FOR FUTURE USE.
302. OPEN SPACE shall be all land designated for the recreational enjoyment
and/or natural beauty of area.
303. OUTDOOR ADVERTISING SIGN shall mean a signboard advertising a
service commodity, goods, wares, merchandise or opinion not sold or offered
to the public at the site upon which the signboard is located.
304. OUTSIDE STORAGE shall mean the storage of commodities, goods and/or
refuse outside of an enclosed building.
305. OCCUPANCY shall mean the purpose or activity for which a piece of land
or its building, part thereof, is used or intended to be used.

B. AUTHORIZED SPECIAL USES:
15. Off-street parking lots, accommodating a permitted or conditional use
within the "LB" Limited Business District, "GV" Grapevine Vintage
District. "CN" Neighborhood Commercial District, "CC" Community
Commercial District, "HC" Heavy Commercial District, "PO"
Professional Office District, "CBD" Central Business District, "HGT"
Historic Grapevine Township District, "HCO" Hotel and Corporate
Office District, "RA" Recreation/Amusement District, "LI" Light
Industrial District. "BP" Business Park District, "PCD" Planned
Commerce Development District, and "PID" Planned Industrial
Development District, which require any payment for parking
(a) EXCEPTIONS: The following uses shall be exempt from the
requirements of this section.
(1) Valet parking services.
C. APPLICATION: An application for a Special Use Permit may be filed by the owner
of, or other person having a contractual or possessory interest in, the subject
property. Any application filed by a person who is not the owner of the property for
which the special use permit is sought shall be accompanied by evidence of the
consent of the owner.
D. CONTENTS OF APPLICATION. An application for a Special Use Permit shall be
filed with the Director of Development Services, or such other official as he may
designate. The application shall contain the following information as well as such
additional information as may be prescribed by rule of the Commission or the
Director of Development Services.
The applicant's name and address and his interest in the subject property;
2. The owner's name and address, if different than the applicant, and the
owner's signed consent to the filing of the application;
3. The street address and legal description of the property;
4. The zoning classification and present use of the subject property;
5. A description of the proposed special use;

RECOMMENDATION
Already included in your agenda packet are proposed amendments to Section 12,
Definitions, and Section 49, Special Use Permits, relative to paid off-street parking
requirements. After further review of the proposed amendments, staff felt it was
important to include the paid off-street parking requirements in Section 56, Off -Street
Parking Requirements. Please see attached the proposed amendment to Section 56.

Section 56. Off -Street Parking Requirements
In all zoning districts there shall be provided in connection with appropriate allowable uses,
off-street parking space in accordance with the following requirements:
A. MINIMUM OFF-STREET PARKING REQUIREMENTS: The minimum number of
off-street parking spaces herein required shall be computed and provided in
accordance with the following specifications:
1. The number of spaces required shall serve residents, customers, patrons,
visitors and employees.
2. Each parking space shall have adequate drives and room for ingress and
egress to each parking space with a minimum size of eight (8) feet by
twenty-two (22) feet for each parallel parking space and nine (9) feet by
eighteen (18) feet for each angular head -in parking space, and shall be
designed in accordance with minimum City standards.
3. All maneuvering for off-street parking shall be accomplished on private
property.
4. The minimum required off-street parking shall be provided to patrons
of the associated use free of charge, unless approved with a Special
Use Permit in accordance with Section 49 of this ordinance.
B. UNCLASSIFIED USE: Where the proposed land use cannot be classified within the
uses herein specified, the City Council shall determine the specified use most
clearly related to the proposed use and the minimum requirements for the specified
use so determined shall apply to the proposed use.
C. NUMBER OF PARKING SPACES REQUIRED: Multi -use projects shall have
aggregate parking requirements. The minimum number of off-street parking spaces
required shall be as follows:

Please be aware that I am fully supportive of Grapevine's Code Ordinance —
Appendix D, "Comprehensive Zoning Ordinance Relative to Paid Off -Street
Parking". I am also an occupant of Christ Medical Plaza (1601 Lancaster),
which currently has parking gates requiring our patients to pay $1.00 upon
departure. Not surprisingly our largest complaint is the parking gates. A large
percentage of our patients are on fixed income needing frequent doctors visits
to maintain a healthy lifestyle. Needless to say our patients feel the owner is
taking advantage of this situation. Parking is not scarce around Baylor
Medical Center at Grapevine and I simply do not see the logic around the
owner's decision to charge for parking.

Dear Ms. Huff,
I am writing to issue my strong support of Grapevine's Code Ordinance — Appendix D,
"Comprehensive Zoning Ordinance Relative to Paid Off -Street Parking", I am a Family
Physician whose practice is located in the Christ Medical Plaza (1601 Lancaster Drive).
Unfortunately, the owners of the building installed pay parking gates on our patient parking
area, something which I feel is not only inappropriate for Grapevine and our hospital community,
but a potential danger to our patients. Many of our elderly and disabled patients have felt that
they had no choice but to park in the street, get out in traffic, and walk quite a distance to the
entrance, which is on the back side of the building. Some have had to maneuver their wheel-
chairs around the gates, in the rain, in order to even get into the lot which takes them to
the entrance. On an occasion where an ambulance was called to the office, the ambulance was
unable to get through the gates, so the patient had to be carried by stretcher out to the street.
Our patients, overall, have been quite angry about the gates, and I believe I speak for them
when I strongly support the above Code Ordinance.

despite the adequate spaces to accommodate them in the lot. In addition, fire and other
large emergency vehicles cannot enter the site because of the installation of the gates
and obstructions. Staff feels that adding a provision into the zoning ordinance requiring
a Special Use Permit for paid off-street parking would enable the City to prevent
problems like this in the future.
Staff has drafted an amendment to Section 12, Definitions, to amend the definition for
"Off -Street Parking" to incorporate paid parking; as well as an amendment to Section
49, Special Use Permits, to create a mechanism to regulate the implementation of paid
off-street parking lots. Some exceptions have been provided to the Special Use
requirement, including paid off-street parking lots associated with City -sponsored
special events; valet parking at hotels and restaurants; and tenant parking at multifamily
developments.

278. NONCONFORMING USE shall mean a building, structure or use of land
lawfully occupied at the time of the effective date of this ordinance or
amendments thereto, and which does not conform to the use regulations of
the districts in which it is situated.
278a. NUDE MODEL STUDIO means any place where a person who appears in
a state of nudity or seminudity or displays specified anatomical areas is
provided, to be observed, sketched, drawn, painted, sculptured,
photographed, or similarly depicted by other persons who pay money or any
other form of consideration.
278b. NUDITY or a STATE OF NUDITY means and includes either of the following:
The appearance of a human bare buttock, anus, male genitals, female
genitals or female breast; or
2. A state of dress which fails to opaquely cover a human buttock, anus,
male genitals, female genitals or areola of the female breast.
279. NURSING HOME shall mean an institution where persons suffering from
generally permanent types of illness, injury, deformity, deficiency of age, are
given care and treatment on a prolonged or permanent basis, and which is
licensed by the State of Texas or the City of Grapevine.
280-299. RESERVED FOR FUTURE USE.
300. OFF-STREET PARKING shall mean asphalt or concrete surface areas upon
which motor vehicles may be parked and which area has access to a public
street. The minimum required off-street parking shall be provided to
patrons of the associated use free of charge, unless approved with a
Special Use Permit in accordance with Section 49 of this ordinance.
301. RESERVED FOR FUTURE USE.
302. OPEN SPACE shall be all land designated for the recreational enjoyment
and/or natural beauty of area.
303. OUTDOOR ADVERTISING SIGN shall mean a signboard advertising a
service commodity, goods, wares, merchandise or opinion not sold or offered
to the public at the site upon which the signboard is located.

Section 12
(b) The following minimum design requirements shall be required for
Neighborhood Day Care Centers permitted as a Special Use.
(1) Lots for Neighborhood Day Care Centers permitted as a
special use shall have a minimum lot area of one (1) acre.
(2) Width of lot, feet - 150.
(3) Depth of lot, feet - 175.
(4) A landscape plan, meeting the requirements of Section 53.
(5) Required front yards shall be landscaped with grass,
shrubbery, vines, or trees and no part shall be paved or
surfaced except for minimum access, driveways, and
sidewalks in accordance with Section 53 of this ordinance.
(6) Garbage storage shall be screened on all four sides by a solid
wooden or masonry fence and located on a concrete pad not
less than fifty (50) feet to any adjoining property.
14. Churches, convents and other places of worship that exceed the maximum
height regulation established for the zoning district in which they are listed
as a permitted or conditional use. All other district regulations shall apply.
15. Off-street parking lots, accommodating a permitted or conditional use
within a zoning district, which require any payment for parking_
(a) EXCEPTIONS: The following uses shall be exempt from the
requirements of this section.
(1) Paid off-street parking lots operated during City -sponsored
festivals and other City -sponsored special events
(2) Off-street parking, such as covered parking or garages,
within a Multifamily development for which tenants can
choose to pay a monthly premium, often incorporated into
their lease agreement.
(3) Valet parking associated with a hotel or restaurant
