ACTS OF THE 1993 TEXAS LEGISLATURE, THE BUILDING BOARD OF APPEALS MEETING AGENDA WAS PREPARED AND POSTED ON THIS THE 8TH DAY OF AUGUST, 1997, AT 5:00 P.M. B, 14L 14'NG OFFICIAL C STATE OF TEXAS COUNTY OF TARRANT CITY OF GRAPEVINE The Building Board of Appeals for the City of Grapevine, Texas, met in regular session, Tuesday, August 11, 1997, at 6:00 P.M., in the Council Room, 200 South Main Street, Grapevine, Texas with the following members present: Joe Lipscomb Chairman Dennis Roberts Member Charles Bloomberg Member Russell Kidd Member Daniel Banse Member constituting a quorum with members Art Gordon absent. Also present was Council Representative Roy Stewart and the following City Staff: Scott Williams Building Official Tim Fleming Plans Examiner/Field Coordinator Mike Butler Code Enforcement Officer Gerrie Anderson Secretary CALL TO-DRDER Chairman Joe Lipscomb called the meeting to order at 6:20 P.M. OATH OF OFFICE Gerrie Anderson administered the Oath of Office to newly appointed member, Daniel Banse. NF N BU_SfNE_SS BBA97-05, COUNTRY OAKS_APARTMENTS The first item of new business was for the Building Board of Appeals to consider Building Board of Appeals Case BBA97-05, submitted by Country Oaks Apartments for 2913 Mustang Drive, platted as Lot 1A, Block 1, Mustang Addition. The request was to the Grapevine Code of Ordinances, Chapter 7, Article IV, Section 7-127, Fences, Front Yard Requirements which restricts fences placed in an established or required front yard to a maximum height of 36 inches and requires at least 50 percent through vision. The applicant requested to allow a six (6) foot fence to be constructed in both the required and established front yard. The fence will meet the 50 percent through vision requirement. BBA MINUTES 6/10/97 Mr. Williams explained that the application was submitted by Mr. David J. Merzanis, representing EMES Management, the property owner whose intent of the request was to provide security. Mr. Williams also explained that staff became aware of the potential violation through plan review of a permit submittal. Mr. Williams noted that both the Fire and Public Works Departments were provided plans, but neither departments had objections. There was discussion regarding the main entrance remaining open and the entrances on each side having access for the Fire Department. With no one else to speak concerning the request, Russell Kidd made a motion to close the public hearing. Charles Bloomberg seconded the motion which prevailed by the following vote: Ayes: Lipscomb, Roberts, Bloomberg, Kidd, Banse Nays: None Absent: Gordon Dan Banse then made a motion to approve the request to Grapevine Code of Ordinances, Chapter 7, Article IV, Section 7-127, Fences, allowing a six (6) foot fence to be constructed in both the required and established front yard meeting the 50 percent through vision requirement. Dennis Roberts seconded the motion which prevailed by the following vote: Ayes: Lipscomb, Roberts, Bloomberg, Kidd, Banse Nays: None Absent: Gordon BBA97-06. ALLEN-TRLB13LE The next item of business was for the Building Board of Appeals to consider BBA97- 06 submitted by Allen Tribble for 907 S. Riverside Drive, platted as Lot 12B, Block L, The Woods Phase II Addition. The request was to City of Grapevine Code of Ordinances, Chapter 7, Article IV, Section 7-126, Fences, Side Yard Requirements which permits a maximum eight (8) foot tall fence along any side lot line. The applicant requested the Board to allow existing 8.7 foot and 9.25 foot sections of fence to remain along the side property line as shown on the plot plan. Mr. Williams announced that the applicant, Mr. Allen Tribble submitted a letter requesting the Board to postpone BBA97-06 until the September 8, 1997, meeting due to misreading the Meeting Agenda Schedule and from not receiving a letter confirming the time and date of the meeting. 2 BBA MINUTES 6/10/97 Charles Bloomberg asked to hear the background information from Mr. Tribble who was present. Mr. Williams explained that the panels to the fence were erected without a permit from the Building Department. Mr. Williams explained that the violation came as a complaint and that staff recommended denial of the request. Mr. Williams also explained that the Building Department told Mr. Tribble the violation had to be removed and Mr. Tribble chose to come before the Board. Mr. Williams also passed around photographs of the property. Mr. Tribble spoke and explained that he was unable to provide pictures, at this time, showing the direction of his neighbors floodlights that shine through his windows and a video camera pointing toward his house. Mr. Tribble explained that he installed the panels for privacy from his neighbors and did not realize he needed a permit. Mr. Tribble showed pictures of his neighbors back porch light that shines on his hot tub. Don Kiker, 905 Riverside Drive, and next door neighbor of Mr. Tribble, spoke and showed pictures of a spotlight Mr. Tribble had shining at his bedroom window. Mr. Kiker explained that he and Mr. Tribble have had a legal dispute going on for about four (4) years. Dennis Roberts explained that the Board could only discuss the illegal fence and could not discuss the legal dispute. With no one else to speak either for or against the request, Charles Bloomberg made a motion to close the public hearing. Dennis Roberts seconded the motion which prevailed by the following vote: Ayes: Lipscomb, Roberts, Bloomberg, Kidd, Banse Nays: None Absent: Gordon After further discussion, Charles Bloomberg made a motion to deny the variance request to Grapevine Code of Ordinances, Chapter 7, Article IV, Section 7-126, Fences. Russell Kidd seconded the motion which prevailed by the following vote: Ayes: Lipscomb, Roberts, Bloomberg, Kidd, Banse Nays: None Absent: Gordon 3 BBA MINUTES 6/10/97 CONSIDERATION OF ADOPTIONSJF 19�4 11NLF__ORA BUILDINCi--CQDE_AND 1994 J-NIFORM MEC HAN1CAL-CODE Mr. Williams explained that he has been working on the draft copy of the ordinances but because of the current workload on the Building Department, was unable to have it ready for the meeting. Mr. Williams discussed reducing commercial handrail dimensions to a maximum of 1 Y2 " to bring them into compliance with the Texas Accessibility Standards. As directed by the Board, Mr. Williams called the State and clarified that the intent was to limit the actual outside diameter to a maximum of 1 '/2 " which he feels is appropriate. 1SCELLANEO11SA1EPORTS Mr. Williams updated the Board that permits had been issued for Tres Hombres Restaurant, a free standing building located on an outparcel at the mall; Michaels, another free standing building on a mall outparcel; and Polar Ice, a two rink ice skating rink on the south end of the mall building. Mr. Williams also noted that there would be approximately 175 tenants at the mall, not including the anchors. Also Mr. Williams informed the Board that he had been informed by the project architect that the Bass Pro Shop would take approximately 14 months to build. MIN 1.1 TES Next the Building Board of Appeals considered the minutes of the June 10, 1997, meeting. Charles Bloomberg made a motion to approve the minutes of the June 10, 1997, meeting. Dennis Roberts seconded the motion which prevailed by the following vote: Ayes: Lipscomb, Roberts, Bloomberg, Kidd, Banse Nays: None Absent: Gordon ADJD U RNMENT With no further discussion, Russell Kidd made a motion to adjourn.
