A A�'" STATE OF TEXAS COUNTY OF TARRANT CITY OF GRAPEVINE The Building Board of Appeals for the City of Grapevine, Texas, met in regular session, Monday, June 12, 1995, at 6:30 P.M., in the Council Chambers, Room #205, 307 West Dallas Road, Grapevine, Texas with the following members present: Joe Lipscomb Chairman Art Gordon Member Greg Czapanskiy Member Russell Kidd Member Catherine Smith Member constituting a quorum. Also present was Council Representative, Gil Traverse and following City Staff: Scott Williams Building Official Mike Butler Code Enforcement Officer Kelly Doughty Secretary Chairman Joe Lipscomb called the meeting to order at 6:30 P.M. NEW BUSINESS The first item for the Building Board of Appeals to consider was BBA95-02 submitted by Mr. George Dixon for David Weekley Homes who is requesting a variance for the property located at Lot 1, Block 10, Lakeside Estates and addressed as 2810 Stonehurst Drive. The request is to the City of Grapevine Code of Ordinances as follows: Section 7-128, Reverse Frontage Corner Lot Requirements: On all reverse frontage corner lots it shall be unlawful to construct a fence within the required side yard area that is adjacent to front yard area at a distance closer than fifteen (15) feet to the side property line or at a height greater than eight (8) feet. The request would allow a fence to encroach five (5) feet into the required side yard as shown on the plot plan. Scott Williams, Building Official, explained the case to the board and added the plot 1 BBA Minutes 6/12/95 plans for the BBA95-02 and BBA95-03 were reviewed and an on site visit was made by the Public Works Department for site visibility for the proposed fences. Mr. Martin Shelling was present to speak for the case. With no one else to speak for or against the request, Greg Czapanskiy motioned to close. Art Gordon seconded the motion which prevailed by the following vote: Ayes: Lipscomb, Czapanskiy, Gordon, Kidd, Smith Nays: None Absent: Long, Roberts Catherine Smith moved, with a second by Russell Kidd, to grant the variance to the City Code of Ordinances, Chapter 7, Article IV for Lot 1, Block 10, Lakeside Estates and addressed as 2810 Stonehurst Drive allowing a fence to encroach five (5) feet into the required side yard, therefore, allowing a ten (10) foot setback for the fence from the side property line as shown on the plot plan. Ayes: Lipscomb, Czapanskiy, Gordon, Kidd, Smith Nays: None Absent: Long, Roberts BBA95-03 - DAVID WEEKLEY HOMES The next item for the Building Board of Appeals to consider was BBA95-03 submitted by Mr. George Dixon for David Weekley Homes who is requesting a variance for the property located at Lot 29, Block 9, Lakeside Estates and addressed as 2703 Pinehurst Drive. The request is to the City of Grapevine Code of Ordinances as follows: Section 7-127(a), Corner Lots: It shall be unlawful to erect a fence in the required front yard setback area or the established front yard area, whichever is greater in depth on any corner lot, except along the interior lot line in accordance with subsection (b). The request is to allow a fifteen (15) foot encroachment for a fence in the thirty (30) foot required front yard allowing a fifteen (15) foot setback for the fence from the front property line as shown on the plot plan. Scott Williams explained the case to the board. With no one else to speak for or against the request, Russell Kidd motioned to close. Greg Czapanskiy seconded the motion which prevailed by the following vote: 2 BBA Minutes 6/12/95 Ayes: Lipscomb, Czapanskiy, Gordon, Kidd, Smith Nays: None Absent: Long, Roberts Art Gordon moved, with a second by Catherine Smith, to grant the variance to the City of Grapevine Code of Ordinances, Chapter 7, Article IV for Lot 29, Block 9, Lakeside Estates and addressed as 2703 Pinehurst Drive allowing a fifteen (15) foot encroachment for the fence in the thirty (30) foot required front yard setback and also allowing a fifteen (15) foot setback for the fence from the property line as shown on the plot plan. Ayes: Lipscomb, Czapanskiy, Gordon, Kidd, Smith Nays: None Absent: Long, Roberts CONSIDERATION OF GRAPEVINE CODE OF ORDINANCES AMENDMENT TO TABLE 5-13 1991 UNIFORM BUILDING CODE The next item for the Building Board of Appeals to consider and forward to City Council was the deletion of the amendment to Table 5-13 of the 1991 Uniform Building Code. Section 503, 1991 U.B.C. provides that buildings of mixed uses be provided with fire rated occupancy separations. The level of fire protection of these separations is determined by the relative fire hazard, or compatibility of the two occupancies. The code further provides that these occupancy separations... "shall be vertical or horizontal or both or when necessary, of such form as may be required to afford a complete separation between the various occupancy divisions in the building. Basically, this means that if a building houses different occupancies, a fire rated wall and or ceiling must be provided to separate these occupancies. Furthermore, if doors, windows, or other openings are provided in this separation, they too must be fire rated assemblies. Table 5-13 lists the required fire rating between different occupancy groups. It should be noted that a fire rated separation between two group B occupancies (such as two warehouse lease spaces) is not required. The City of Grapevine has amended this portion of the Code to require a one hour occupancy separation between identical occupancy groups, and between occupancy 3 BBA Minutes 6/12/95 groups of similar fire hazard. Staff has run into several situations over the last several months where this amended separation requirement has caused concern with builders and developers, due to increased cost of construction. Discussions with the Fire Marshall revealed that he has no overriding concern to keep this amendment in place. For these reasons, staff has agreed to bring this item to the Board of Appeals for consideration. Barry Stevens, speaking on behalf of J. A. Green, added deletion of this section would be beneficial to the J. A. Green warehouse tenants. With no one else to speak for or against the request, Greg Czapanskiy motioned to forward the request to City Council. Art Gordon seconded the motion which prevailed by the following vote: Ayes: Lipscomb, Czapanskiy, Gordon, Kidd, Smith Nays: None Absent: Long, Roberts DANGEROUS BUILDING - 311 JONES STREET The next item for consideration was the property located at 311 Jones Street and to determine if it was a dangerous building pursuant to Chapter 7, Article II, of the Grapevine Code of Ordinances. Scott Williams explained the case and noted Staff recommends that the Building Board of Appeals determine this property a dangerous building. The property owner, Henry Jones Estate (Willie O'Quinn), was initially notified of the violation(s) on February 2, 1995 and since the notification, no action has been taken. Should the Board order the property to be repaired, vacated, or demolished, the owner must comply with said order within thirty (30) days. If action is not taken within this thirty (30) day period then the Board shall report the act of noncompliance to the City Attorney, so that an action for injunction may be filed in district court. Ayes: Lipscomb, Czapanskiy, Gordon, Kidd, Smith Nays: None Absent: Long, Roberts The Board was next to consider the property located at 409 North Dooley, and to determine whether it was a dangerous building pursuant to Chapter 7, Article II, of the Grapevine Code of Ordinances. Scott Williams explained the case and noted that staff recommends that the Building Board of Appeals determine this property as a dangerous building. The property owner, Ms. Louise Watts was initially notified of the violation(s) on February 17, 1995, and since the notification, no action has been taken. Should the Board order that the property be repaired, vacated, or demolished, the owner must comply with said order within thirty (30) days. If action is not taken within this thirty (30) day period then the Board shall report the act of noncompliance to the City Attorney, so that an action for injunction may be filed in district court. Ayes: Lipscomb, Czapanskiy, Gordon, Kidd, Smith Nays: None Absent: Long, Roberts DANGEROUS BUILDING - 214 WEST NORTHWEST HIGHWAY The next item was for Board consideration of the property located at 214 West Northwest Highway and to determine if it was a dangerous building pursuant to Chapter 7, Article II, of the Grapevine Code of Ordinances. Scott Williams explained the case and noted that staff recommends that the Building Board of Appeals determine this property a dangerous building. The property owner, Clarence Edgar Millican was initially notified of the violation(s) on March 8, 1995 and since the notification, no action has been taken. Should the Board order that the property be repaired, vacated, or demolished, the owner must comply with said order within thirty (30) days. If action is not taken within this thirty (30) day period then the Board shall report the act of noncompliance to the City Attorney, so that an action for injunction may be filed in district court. Scott Williams explained the case and noted that staff recommends that the Building Board of Appeals determine this property a dangerous building. The property owner, H. E. French was initially notified of the violation(s) on April 20, 1995, and since the notification, no action has been taken. Should the Board order that the property be repaired, vacated, or demolished, the owner must comply with said order within thirty (30) days. If action is not taken within this thirty (30) day period then the Board shall report the act of noncompliance to the City Attorney, so that an action for injunction may be filed in district court. Ayes: Lipscomb, Czapanskiy, Gordon, Kidd, Smith Nays: None Absent: Long, Roberts l7 BBA Minutes 6/12/95 MISCELLANEOUS REPORTS AND/OR DISCUSSION Scott Williams, Building Official, noted to the Board that more dangerous buildings will come before the Board in the future. Gil Traverse, City Council Member, told the Board that he would be replacing Ted Ware as the Building Board of Appeals City Council Representative. MINUTES The Building Board of Appeals considered the minutes of the March 13, 1995 meeting. Russell Kidd motioned to approve the minutes of the March 13, 1995 meeting. Catherine Smith seconded the motion which prevailed by the following vote: Ayes: Lipscomb, Czapanskiy, Gordon, Kidd, Smith Nays: None Absent: Long, Roberts ADJOURNMENT With no further discussion, Catherine Smith made a motion to adjourn.
