ACTS OF THE 1993 TEXAS LEGISLATURE, THE BUILDING BOARD OF APPEALS MEETING AGENDA WAS PREPARED AND POSTED ON THIS THE 11TH DAY OF OCTOBER, 1996 AT 5:00 P.M. STATE OF TEXAS COUNTY OF TARRANT CITY OF GRAPEVINE The Building Board of Appeals for the City of Grapevine, Texas, met in regular session, Monday, October 14, 1996, at 6:00 P.M., in the Court Room, Room #205, 307 West Dallas Road, Grapevine, Texas with the following members present: Joe Lipscomb Chairman Art Gordon Member Charles Bloomberg Member Catherine Cotter Smith Member Russell Kidd 1 st Alternate constituting a quorum with Members Dennis Roberts and Tim Long absent. Also present were Council Representative Roy Stewart and the following City Staff: Scott Williams Building Official Mike Butler Code Enforcement Officer Gerrie Anderson Secretary Chairman Joe Lipscomb called the meeting to order at 6:00 P.M. Chairman Joe Lipscomb recommended moving BBA96-12, Laura Suarez, to the end of the meeting since no one was present to represent the case. The item of business for the Building Board of Appeals to consider was Dangerous Building DB96-01, 845 Dawn Lane, legally described as Tracts 3B and 3131, Sunshine Harbor Industrial and to determine if it was a dangerous building pursuant to Chapter 7, Article II, of the Grapevine Code of Ordinances. Mr. Williams explained that Staff recommended the Board table this case until the November 11, 1996, meeting, due to the owner, Mr. George Day, not being able to attend because of illness. Art Gordon made a motion to table DB96-01 until the November 11, 1996, meeting. Y • , 0 The next item of business for the Building Board of Appeals to consider was DB96-02 for property located at 713 East Texas Street, legally described as Lot 11, Block 105, College Heights Addition, to determine if it was a dangerous building pursuant to Chapter 7, Article II, of the Grapevine Code of Ordinances. Mr. Williams explained the case and noted that Staff recommends the Building Board of Appeals determine this property a dangerous building. Should the Board order the property to be repaired, vacated, or demolished, the owner must comply with said order within thirty (30) days. If action is not taken within this thirty (30) day period then the Board shall report the act of noncompliance to the City Attorney, so that an action for injunction may be filed in district court. Mr. Butler presented and described the slides of the abandoned house located at 713 East Texas Street. Mr. Butler noted an error in the memo to the Board that the owner was notified of the violation on August 1, 1995, not August 1, 1996. Ms. Debra Hankins, owner of the property spoke and explained that her father had passed away one year ago and the property was in an inheritance dispute. Ms. Hankins noted that she would choose to have the house demolished, should she ultimately obtain ownership. With no one else to speak either for or against the request, Art Gordon made a motion to close the public hearing. Charles Bloomberg seconded the motion which prevailed by the following vote: Ayes: Lipscomb, Gordon, Kidd, Bloomberg Nays: None Absent: Roberts, Smith After further discussion, Charles Bloomberg made a motion to determine that the property located at 713 East Texas Street was a dangerous building pursuant to Chapter 7, Article II, of the City of Grapevine Code of Ordinances. Art Gordon seconded the motion which prevailed by the following vote: 0 BBA MINUTES 10/14/96 Ayes: Lipscomb, Gordon, Bloomberg Nays: Kidd Absent: Roberts, Smith Art Gordon then made a motion to give the property owners ninety (90) days in which to repair or demolish the structure at 713 East Texas Street. Russell Kidd seconded the motion which prevailed by the following vote: Ayes: Lipscomb, Gordon, Kidd, Bloomberg Nays: None Absent: Roberts, Smith The next item for the Building Board of Appeals to consider was DB96-03 for property located at 614 East Texas Street, legally described as Lot 4, Block 107, College Heights Addition, to determine if it was a dangerous building pursuant to Chapter 7, Article II, of the Grapevine Code of Ordinances. Mr. Williams explained the case and noted that Staff recommends the Building Board of Appeals determine this property a dangerous building. Should the Board order the property to be repaired, vacated, or demolished, the owner must comply with said order within thirty (30) days. If action is not taken within this thirty (30) day period then the Board shall report the act of noncompliance to the City Attorney, so that an action for injunction may be filed in district court. Mr. Butler presented and described the slides of the abandoned building located at 614 East Texas Street. Ms. Alva Herndon, owner of the property spoke and explained that the building is sturdy, but does need a new roof. She added that it stays locked and is being used to store her furniture. Wayne Cross, Ms Herndon's son-in-law spoke and explained that the building was solid, there was no electricity or gas, and agreed that a new roof was needed. Mary Fuller, a neighbor that lives on East Texas Street, noted that the building was not a distraction nor a bother to her. 9 BBA MINUTES 10/14/96 In response to a Board member's inquiry, Mr. Butler noted that the property around the building was well maintained. Mr. Bloomberg noted that judging from the slide presentation, the structure was serving a purpose as Ms. Herndon's storage building and is suitable for the use. After further discussion, Charles Bloomberg made a motion to close the public hearing. Russell Kidd seconded the motion which prevailed by the following vote: Ayes: Lipscomb, Gordon, Kidd, Bloomberg Nays: None Absent: Roberts, Smith Art Gordon made a motion that 614 East Texas Street was a dangerous building according to Mr. Butler's comments concerning the building. The motion died for lack of a second. Russell Kidd then made a motion that 614 East Texas Street was not a dangerous building. Charles Bloomberg seconded the motion which prevailed by the following vote: Ayes: Lipscomb, Gordon, Kidd, Bloomberg Nays: None Absent: Roberts, Smith The next item for the Building Board of Appeals to consider was DB96-04 for property located at 2030 Anderson -Gibson Road, to determine if it was a dangerous building pursuant to Chapter 7, Article II, of the Grapevine Code of Ordinances. Mr. Williams explained that this structure has been demolished and asked the Board to withdraw the case. With no one to speak concerning the case, Russell Kidd made a motion to close the public hearing. Charles Bloomberg seconded the motion which prevailed by the following vote: Ayes: Lipscomb, Gordon, Kidd, Bloomberg Nays: None Absent: Roberts, Smith 0 BBA MINUTES 10/14/96 Charles Bloomberg then made a motion to withdraw DB96-04. Art Gordon seconded the motion which prevailed by the following vote: Ayes: Lipscomb, Gordon, Kidd, Bloomberg Nays: None Absent: Roberts, Smith The next item of new business for the Building Board of Appeals to consider was DB96-05 for property located at 604 Cannon Street, legally described as Lot 1, Block 118, C.H. Jones Addition, to determine if it was a dangerous building pursuant to Chapter 7, Article II, of the Grapevine Code of Ordinances. Mr. Williams explained the case and noted that Staff recommends the Building Board of Appeals determine this property a dangerous building. Should the Board order the property to be repaired, vacated, or demolished, the owner must comply with said order within thirty (30) days. If action is not taken within this thirty (30) day period then the Board shall report the act of noncompliance to the City Attorney, so that an action for injunction may be filed in district court. Mr. Butler presented and described slides of the garage at 604 Cannon Street. Mr. Butler explained that the owner, who lives out of town, was trying to sell the property, but did note that he had stated he would like to have the garage demolished. Since no one was present to represent the case and there were no comments from the audience, Catherine Cotter Smith made a motion to close the public hearing. Art Gordon seconded the motion which prevailed by the following vote: Ayes: Lipscomb, Gordon, Kidd, Smith, Bloomberg Nays: None Absent: Roberts Charles Bloomberg made a motion to determine that the property located at 604 Cannon Street was a dangerous building pursuant to Chapter 7, Article II, of the City of Grapevine Code of Ordinances. Russell Kidd seconded the motion which prevailed by the following vote: BBA MINUTES 10/14/96 Ayes: Lipscomb, Gordon, Kidd, Smith, Bloomberg Nays: None Absent: Roberts The next item of new business for the Building Board of Appeals to consider was DB96-06 for property located at 234 Ruth Street, legally described as Lot 6, Block 1, D. E. Box Addition, to determine if it was a dangerous building pursuant to Chapter 7, Article II, of the Grapevine Code of Ordinances. Mr. Williams explained the case and noted that Staff recommends the Building Board of Appeals determine this property a dangerous building. Should the Board order the property to be repaired, vacated, or demolished, the owner must comply with said order within thirty (30) days. If action is not taken within this thirty (30) day period then the Board shall report the act of noncompliance to the City Attorney, so that an action for injunction may be filed in district court. Mr. Butler presented and described slides of the garage at 234 Ruth Street. Mr. Butler explained that he had spoken with Ms. Peterson and she would be in favor of having the house demolished. Wanda Peterson, owner of the property spoke and explained there was a contract on the property, but there was pending litigation on the estate which was previously her mother's. Mr. Williams asked if Ms. Peterson would maintain the structure in a secured state; Ms. Peterson agreed. With no one else to speak concerning the case, Ari Gordon made a motion to close the public hearing. Charles Bloomberg seconded the motion which prevailed by the following vote: Ayes: Lipscomb, Gordon, Kidd, Smith, Bloomberg Nays: None Absent: Roberts A BBA MINUTES 10/14/96 Russell Kidd made a motion to determine that the property located at 234 Ruth Street was a dangerous building pursuant to Chapter 7, Article II, of the City of Grapevine Code of Ordinances. Catherine Cotter Smith seconded the motion which prevailed by the following vote: Ayes: Lipscomb, Gordon, Kidd, Smith, Bloomberg Nays: None Absent: Roberts Art Gordon made a motion to add a 90 day time period to Mr. Kidd's motion. Charles Bloomberg seconded the motion which prevailed by the following vote: Ayes: Lipscomb, Gordon, Kidd, Smith, Bloomberg Nays: None Absent: Roberts The next item of business for the Building Board of Appeals to consider was BBA96- 12 submitted by Laura Suarez who was requesting a variance for the property located at 2808 Rock Port Cove, legally described as Lot 20, Block 1, Trail Lake Addition. The request was to the City of Grapevine Code of Ordinances as follows: Section 7-125. Rear Yard Requirements. It shall be unlawful to erect a fence at a height exceeding eight (8) feet in any rear yard or along any rear yard lot line. The proposed variance would allow an addition of a two (2) feet to an existing eight (8) foot fence in the rear yard. If approved, it would allow a total fence height of ten (10) feet. Since no one was present to represent the case, Charles Bloomberg made a motion to table Case BBA96-12 until the November 11, 1996, meeting. Art Gordon seconded the motion which prevailed by the following vote: Ayes: Lipscomb, Gordon, Kidd, Smith, Bloomberg Nays: None Absent: Roberts 7 BBA MINUTES 10/14/96 Next for the Building Board of Appeals to consider were the minutes of the August 12, 1996, meeting. Russell Kidd made a motion to approve the minutes of the August 12, 1996, meeting as written. Art Gordon seconded the motion which prevailed by the following vote: Ayes: Lipscomb, Gordon, Kidd, Smith, Bloomberg Nays: None Absent: Roberts With no further discussion, Art Gordon made a motion to adjourn.
