The Building Board of Appeals for the City of Grapevine, Texas, met in regular
session, Monday, November 11, 1996, at 6:00 P.M., in the Court Room, Room #205,
307 West Dallas Road, Grapevine, Texas with the following members present:

constituting a quorum with Member Russell Kidd absent. Also present were Council
Representative Roy Stewart and the following City Staff:

Chairman Joe Lipscomb called the meeting to order at 6:00 P.M.
The first item of business for the Building Board of Appeals to consider was BBA96-
12 submitted by Ms. Laura Suarez who requested a variance for her property located
at 2808 Rock Port Cove and platted as Lot 20, Block 1, Trail Lake Addition. The
request was to the City of Grapevine Code of Ordinances as follows:
Section 7-125, Rear Yard Requirements which prohibits fences in any rear yard or
along any rear yard lot line from exceeding 8'-0" in height.
The applicant requested to allow a fence to be constructed exceeding the eight (8)
foot minimum height by 2'-0" as shown on the plot plan.
Mr. Williams, Building Official, explained the case and added that the applicant feels
additional privacy is necessary due to the elevation of the properties to the rear. Mr.
Williams explained that staff feels the request is not a valid hardship, as this type of

situation exists in many other locations in Grapevine. Mr. Williams also noted that
this case was tabled at the October 14, 1996, meeting due to no one being present
to represent the case.
Ms. Suarez, applicant, spoke and explained that their fence is presently six (6) feet
and eight (8) feet would not be high enough to provide the privacy needed from the
neighbors yard.
With no one else to speak either for or against the request, Art Gordon made a
motion to close the public hearing. Charles Bloomberg seconded the motion which
prevailed by the following vote:
Ayes: Lipscomb, Gordon, Roberts, Smith, Bloomberg
Nays: None
Absent: Kidd
Ms. Smith commented that the homeowner deserves their privacy and was in favor
of the request.
Mr. Gordon felt a 10' foot fence would be too high and obtrusive to the neighbors.
Ms. Suarez did explain that because of the slope of the yard, the fence would look
like the normal height.
Catherine Smith made a motion to approve the variance. Charles Bloomberg
seconded the motion which failed for lack of a majority vote:
Ayes: Smith, Bloomberg
Nays: Lipscomb, Gordon, Roberts
Absent: Kidd
Art Gordon then made a motion to deny BBA96-12, requesting to allow a fence to be
constructed exceeding the 8' maximum height by 2'0" as shown on the plot plan.
Dennis Roberts seconded the motion which prevailed by the following vote:
Ayes: Lipscomb, Gordon, Roberts, Bloomberg
Nays: Smith
Absent: Kidd
Ms. Suarez asked if a retaining wall could be constructed with a fence on top of it.

Mr. Williams suggested she contact the Public Work's Department to look at the
drainage of the property if she is going to install a retaining wall, otherwise, a wall
could be built with an eight (8) foot fence on top of it.
The next item of business for the Building Board of Appeals to consider was
Dangerous Building DB96-01, 845 Dawn Lane, legally described as Tracts 313 and
3131, Sunshine Harbor Industrial and to determine if it was a dangerous building
pursuant to Chapter 7, Article 11, of the Grapevine Code of Ordinances.
Mr. Williams explained that this case was tabled at the October 19, 1996, meeting
due to Mr. Day's illness and not being able to attend the meeting. Mr. Williams highly
urged the Board to demand demolition of the building because of the numerous times
staff has notified the owner and the lack of response from the owner.
Should the Board order the property to be repaired, vacated, or demolished, the
owner must comply with said order within thirty (30) days. If action is not taken
within this thirty (30) day period then the Board shall report the act of noncompliance
to the City Attorney, so that an action for injunction may be filed in district court.
Mr. Butler presented and described slides of the abandoned building located at 845
Dawn Lane.
Mr. Day was present and explained that a number of circumstances were responsible
for not responding in a timely manner. Mr. Day explained that his wife Shirley was
owner of the company who recently obtained title of the property. Mr. Day also
explained that A. D. Berg Construction has made an agreement with the them to
remodel the building in 90 days to satisfy the City codes. Mr. Day noted that A. D.
Berg Construction Company has made a commitment to lease the building to be used
for their office and would immediately secure all entrances into the building.
Mr. Berg of A.D. Berg Construction spoke and explained that he would be replacing
the flooring, wiring and plumbing and would need the 90 days to complete the work.
With no one else to speak either for or against the request, Charles Bloomberg made
a motion to close the public hearing. Dennis Roberts seconded the motion which
prevailed by the following vote:

Dennis Roberts made a motion to determine that the property located at 845 Dawn
Lane was a dangerous building pursuant to Chapter 7, Article II, of the City of
Grapevine Code of Ordinances, to start construction and obtain a permit within 30
days from the date of the hearing and complete construction with 90 days from the
date of the hearing. Art Gordon seconded the motion which prevailed by the
following vote:
Ayes: Lipscomb, Gordon, Roberts, Bloomberg
Nays: Smith
Absent: Kidd
An amendment was added to the motion that if no action was taken in the 30 day
period, then Staff was to bring this case back before the Board.
Scott Williams explained that 604 Cannon Street, that was on October's agenda as
Dangerous Building 96-05, was purchased by Ms. Evelyn Daniel. Mr. Williams
explained that the new owner submitted a letter requesting an extension in order to
repair the garage, and Staff was working with her on the matter.
Last for the Building Board of Appeals to consider were the minutes of the October
14, 1996, meeting.
Charles Bloomberg made a motion to approve the minutes with corrections. Art
Gordon seconded the motion which prevailed by the following vote:

With no further business, Dennis Roberts made a motion to adjourn the meeting.
