The Building Board of Appeals for the City of Grapevine, Texas, met in regular
session, Monday, February 10, 1997, at 6:00 P.M., in the Court Room, Room #205,
307 West Dallas Road, Grapevine, Texas with the following members present:

constituting a quorum with Members Dennis Roberts and Catherine Cotter Smith
absent. Also present was Council Representative Roy Stewart and the following City
Staff:

Chairman Joe Lipscomb called the meeting to order at 6:00 P.M.
The first item of business was for the Building Board of Appeals to hear information
relative to Dangerous Building D1396-01, 845 Dawn Lane, legally described as Tracts
3B and 3131, Sunshine Harbor Industrial. At the November 11, 1996, public hearing,
the Board determined the structure to be a dangerous building, ordered a permit to
be secured for renovation within thirty (30) days and repairs to be completed within
ninety (90) days. Since the hearing, no permit has been secured.
Mr. Williams explained that Staff felt the buildings needed to be rehabilitated or
demolished. Mr. Williams asked the Board to forward an injunction or make a motion
that work begin immediately upon variance approval by the Board of Zoning
Adjustment which meets on March 3, 1997. Mr. Williams also explained that on
February 3, 1997, Mr. Day submitted an application and site plan for the variance
request and correspondence requesting an extension of time for the process.
Chuck Bloomberg asked if the City had money available to have the building
demolished. Mr. Williams commented that no money was available in the current

budget for demolition.
Joe Lipscomb explained that he did not feel comfortable filing an injunction since Mr.
Day had taken action in applying for a variance. Mr. Lipscomb then recommended
that the case be moved to the next regular meeting.
Next, the Building Board of Appeals heard information relative to D1396-06, 234 Ruth
Street.
Mr. Williams explained that this case was before the Board on October 14, 1996, at
which time the Board determined the residence to be a dangerous building. Since the
hearing, no action was taken. Mr. Williams explained that Staff recommended the
Board forward to the City Attorney a request to file an injunction in District Court for
the demolition of the structure located at 234 Ruth Street, pursuant to Chapter 7,
Article 11, of the Grapevine Code of Ordinances.
Mike Butler explained that he had talked to the owner, Ms. Peterson, and she relayed
to him that the property was still in litigation with other relatives and a clear
ownership of the property still had not been determined.
Charles Bloomberg made a motion to request that the City Attorney file an injunction
in District Court for the demolition of the structure at 234 Ruth Street.
The motion failed for lack of a second.
There was discussion among the members about giving the Petersons more time but
also the potential of the vacant building presenting a fire hazard and harboring
vagrants.
After further discussion concerning the building existing in a hazardous state, Charles
Bloomberg made a motion to direct the City Attorney file for injunction for demolition
of the building as recommended by City Staff. Art Gordon seconded the motion
which prevailed by the following vote:
Ayes: Lipscomb, Gordon, Bloomberg, Kidd
Nays: None
Absent: Roberts, Smith

The next item was for the Building Board of Appeals to consider Dangerous Building
DB96-07 for a garage on property located at 619 Austin Street, to determine whether
it was a dangerous building pursuant to Chapter 7, Article II, of the Grapevine Code
of Ordinances.
Mr. Williams explained that the owner, Mr. Rex Young, was initially notified of the
violation on September 19, 1996, and since the notification, no action had been
taken.
Mike Butler showed slides of the property and explained that Mr. Woolweaver was
the current owner and lives in the house on the property. Mr. Butler explained that
the garage was the dangerous building and not the residence.
Art Gordon made a motion to close the public hearing. Russell Kidd seconded the
motion which prevailed by the following vote:
Ayes: Lipscomb, Gordon, Bloomberg, Kidd
Nays: None
Absent: Roberts, Smith
The Board recommended moving the case to the next regular meeting, due to the fact
that the notice to the property owner had not been mailed within the required 15 days
from date of the public hearing.
Mr. Williams explained that a building permit was issued for 713 E. Texas Street for
work to be performed to bring the structure into compliance. The structure was
before the Board on October 14, 1996, and was determined at that time to be a
dangerous building.
The last item for the Building Board of Appeals to consider were the minutes of the
November 11, 1996, meeting.
Charles Bloomberg made a motion to approve the minutes as amended. Art Gordon
seconded the motion which prevailed by the following vote:

With no further business, Art Gordon made a motion to adjourn. Charles Bloomberg
seconded the motion which prevailed by the following vote:

The meeting was adjourned at 6:40 P.M.
