The Building Board of Appeals for the City of Grapevine, Texas me in regular session, Monday
evening, March 8, 1993, at 6:30 P.M., in the Council Chambers, Room #205, 307 West Dallas,
Road, Grapevine, Texas, with the following members present:

constituting a quorum with member Dennis Roberts absent. Also present was City Council
Representative, Ted Ware, and the following City Staff:

CALL TO ORDER
Chairman Joe Lipscomb called the meeting to order at 6:35 P.M.
NEW BUSINESS
BBA93-03 MICHAEL DEES MJM PREFERRED PROPERTIES
An application was submitted to the Building Inspection Division of Community Development
by Mr. Michael Dees to build a six (6) foot brick fence with six and one-half (6 1/2) foot
columns, and (2) two seven (7) foot entry columns, and (2) two seven (7) foot arch at the entry.
With no one else to speak for or against the request, Art Gordon made a motion to close the
public hearing. Vernie Henderson seconded the motion which prevailed by the following vote:
Ayes:
Lipscomb, Henderson, Gordon, Czapanskiy
Nays:
None
Absent:
Roberts
Vernie Henderson then made a motion to grant the variance, Greg Czapanskiy seconded the
motion which prevailed by the following vote:

ADDITION TO SECTION 7-152 OF THE GRAPEVINE CODE OF ORDINANCES
The Building Board of Appeals has approved and recommended this language to the City
Council when the 1991 Edition of the Uniform Building Code and Amendments were approved
by this body and recommended for adoption by the City Council. Staff did not realize the
mechanical registration section lacks the authority to deny, revoke, or suspend registrations of
mechanical contractors. This oversight was discovered when Lone Star Gas Company contacted
our office with an extension they removed for a final gas test and found that a plug was in the
extension and the gas test was good for three (3) inches of gas pipe. The City Considers this
a grave endangerment of the future citizens that will be occupy this residence.
We have found that we lack any positive action that can be used against any mechanical
contractor who violates City codes and Ordinances. We can not issue citations because the court
system has ruled that "failure to comply" citations are not valid and dismiss the citations. Staff
believes the Building Board of Appeals will support these amendments because this type of
contractor does not need to be endangering our citizens with this type of work.
Greg Wheeler, Building Official discussed the additions to Section 7-152 with the Board and a
problem that had surfaced because we did not have anything in the past to enforce it.
With no on else to speak for or against the request, Greg Czapanskiy made a motion to close
the public hearing. Art Gordon seconded the motion which prevailed by the following vote:

With no on else to speak for or against the request Greg Czapanskiy made a motion to approve
the additions to Section 7-152 of the Grapevine Code of Ordinances, Art Gordon seconded the
motion which prevailed by the following vote:

The Building Board of Appeals considered the minutes of the January 11, 1993. Vernie
Henderson made a motion to approve the minutes, Art Gordon seconded which prevailed by the
following vote:
Ayes: Lipscomb, Henderson, Gordon
Nays: None
Absent: Roberts

OLD BUSINESS
BBA 91-01 RON GAMBLE OMNI INVESTMENTS
Greg Wheeler, Building Official, stated he spoke with Mr. Ron Gamble by phone on January
11, 1993. Mr. Gamble is in the process of tearing down the structure and cleaning up the lot.
Greg Wheeler then explained the case to the Board and the Board gave Mr. Gamble (15) fifteen
days to complete the demolition and clean-up.
Vernie Henderson asked how we would enforce this action if no action is taken. Greg Wheeler,
explained that citations could be issued for each day that no action has taken place.
With no one else to speak for or against the request Art Gordon made a motion to give Mr.
Gamble (15) fifteen days to acquire a permit for demolition of the above the ground structure
and clean up of the lot. Vernie Henderson seconded the motion which prevailed by the
following vote:

MINUTES
The Building Board of Appeals considered the minutes of the October 12, 1992. Art Gordon
made a motion to approve the minutes. Vernie Henderson seconded which prevailed by the
following vote:
Ayes: Lipscomb, Henderson, Gordon
Nays: None
Absent: Czapanskiy, Roberts
MISCELLANEOUS REPORTS AND DISCUSSION
Greg Wheeler, Building Official, updated the Board on the Grapevine Church of Christ building
located on College Street. A couple of the elders and the preacher had informed Greg that they
would be demolishing the structure and would have it down by February 15, 1993. The church
was given until February 22, 1993, to get a demolition permit for demolition and clean up of
the site. The church was informed that if the site was not complete by the above listed date,
they would be put on the Building Board of Appeals Agenda for March 8, 1993. The church
might possibly have a buyer if they could get rid of the burned structure.
The Building Board of Appeals considered the minutes of the February 8, 1993. Art Gordon
made a motion to approve the minutes, Greg Czapanskiy seconded the motion which prevailed
by the following vote:

Henderson
MISCELLANEOUS REPORTS AND DISCUSSION
Greg Wheeler, Building Official updated the Board on 117 Northwest Highway East,
Performance Feed. Greg told the Board that we were making progress with Performance Feed
and most of the debris has been cleaned up.
ADJOURNMENT
With No further discussion, Greg Czapanskiy made a motion to adjourn the meeting, Art
Gordon seconded the motion which prevailed by the following vote.
