LOPMENT SERVICES -f4 MEETING DATE: MARCH 21, 1995 SUBJECT: PROPOSED AMENDMENTS TO GRAPEVINE COMPREHENSIVE ZONING ORDINANCE - SECTION 26, HIGHWAY COMMERCIAL AND SECTION 28, CENTRAL BUSINESS DISTRICT RECOMMENDATION: Development Services recommends consideration of amendments to Section 26, Highway Commercial District, relative to used car lots. The Heritage Foundation recommends consideration of amendments to Section 28, Central Business District relative to temporary outside festival uses. Staff requests authorization to set a public hearing April 18, 1995 to amend Section 26 allowing used car lots as a conditional use only and Section 28 regulating permitted temporary outside festival uses. Staff has noticed the increased number of used car lots along Northwest Highway. Automotive sales, and service, for new or used cars and trucks is a permitted use in the Highway Commercial District. Requiring a conditional use permit for used automotive sales and service will help to reduce the increasing numbers and will allow the opportunity to review each request on an individual basis. Festival Coordinators in the past have incurred problems during the festivals with Main Street merchants having outside sales within the festival area. The proposed amendment will limit all outside sales in the festival area to only festival sanctioned activities. McCallum, Convention & Visitors Bureau SUBJECT: Zoning Code Amendment On behalf of the Board of Directors of the Grapevine Heritage Foundation I am requesting an amendment to Section 28 CBD Central Business District, A. Permitted Uses to include new item 12. to be in place prior to Main Street Days, May 19, 20, 21, 1995 which will read: "Outdoor sales are prohibited at all times, except by the holder of a special permit issued by the Grapevine Heritage Foundation authorizing outdoor sales of merchandise only, during sanctioned festivals, upon execution of a release and hold harmless agreement." Following GrapeFest 1994 a Festival Policy Review Committee, Chaired by Gary Blagg, was established to look at festival operations and policies. After months of study the committee recommendations were presented to the Grapevine Heritage Foundation Board of Directors. One of the policy issues recommended for change is the above zoning code section as it relates to outdoor merchandizing within the Historic District during festival periods and special events. Attached are the minutes from the March 8, 1995 meeting of the Grapevine Heritage Foundation at which this recommendation was unanimously approved. Thank you for your assistance in this matter. HC Highway Commercial District PURPOSE: The HC Highway Commercial District is established to provide adequate space and site diversification for commercial uses which depend upon high visibility, uses with outside storage unless specifically prohibited by Section 26A, convenience to arterial highways and will involve development that may be more intensive than other commercial districts and objectionable to adjacent residential uses. USES GENERALLY: In an HC Highway Commercial District, no land shall be used and no building shall be erected for or converted to any use other than as hereinafter provided. A. PERMITTED USES: The following uses shall be permitted as principal uses except as provided in Section 26.D. 1. Any use permitted in the CC Community Commercial District, except that there shall be no limitation size of planned shopping centers or total floor area. 2. Auction sale, new or used goods located within a completely enclosed building. 3. Retail sales of building materials within a completely enclosed building. 4. Plumbing supply within a completely enclosed building. 5. Public utilities as required to serve the district. 6. Truck and trailer rental. 11. Swimming pool and spa sales. 12. Restaurant with outside dining. 13. Planned Commercial Centers. 14. Automotive repair garages, within a completely enclosed building. Salvage and/or wrecking yards are prohibited. All storage areas must be surfaced and screening shall be provided in accordance with Section 58 and Section 50. 15. Automotive sales, and service, new or used cars and trucks. All vehicles must be in an operating condition and all open display or storage areas must be surfaced and developed in accordance with all applicable Ordinances of the City. LIMITATION OF USES: 1. Publicly operated parking facilities. 12. Outdoor sales are prohibited at all times, except by the holder of a special permit issued by the Grapevine Heritage Foundation authorizing outdoor sales of merchandise only, during sanctioned festivals, upon execution of a release and hold harmless agreement. B. ACCESSORY USES: The following uses shall be permitted as accessory uses to a principal use provided that none shall be a source of income to the owner or user of the principal use: 1. Uses normally incidental to the above permitted uses. 2. Off-street parking in conjunction with a permitted use. 3. Signs, in accordance with Section 60 of this Ordinance. C. CONDITIONAL USE: The following conditional uses may be permitted provided they meet the provisions of Section 48 and a Conditional Use Permit is issued pursuant to Section 48 of the Ordinance. 1. Alcoholic beverage sales provided a special permit is issued in accordance with Section 42.B of this Ordinance. 2. Drive-through restaurants. 3. Automotive repair garages, within a completely enclosed building. Salvage and/or wrecking yards are prohibited. All storage areas must be surfaced and screening shall be provided in accordance with Section 58 and Section 50. 4. Studios for the creations of crafts, furniture, and heritage arts which are handmade or handcrafted, that do not exceed 20% of the total floor area of a permitted use listed in Section 28.A of this Ordinance. HARDY, DIRECTOR OF DEV OPMENT SERVICE MEETING DATE: APRIL 18, 1995 SUBJECT: PROPOSED AMENDMENTS TO GRAPEVINE COMPREHENSIVE ZONING ORDINANCE 82-73 - SECTION 26, HIGHWAY COMMERCIAL AND SECTION 28, CENTRAL BUSINESS DISTRICT RECOMMENDATION: Development Services recommends consideration of amendments to Section 26, Highway Commercial District, relative to automotive sales and building trades contractors and take any action deemed necessary. The Heritage Foundation and Development Services recommends consideration of amendments to Section 28, Central Business District relative to temporary outside festival uses and take any action deemed necessary. BACKGROUND INFORMATION: Staff requested permission to set public hearings at the March 21, 1995 meeting after noticing the increased number of used car lots along Northwest Highway. Automotive sales, and service, for new or used cars and trucks is a permitted use in the Highway Commercial District. Requiring a conditional use permit for automotive sales and service will help to reduce the increasing numbers of small lots with numerous cars and will allow the opportunity to review each request on an individual basis. Additionally, Staff would like to clarify existing language for building trades contractors relative to outside storage as a conditional use. Currently there are existing uses that have outside storage yards for materials and equipment. Festival Coordinators in the past have incurred problems during the festivals with Main Street merchants having outside sales within the festival area. ACCESSORY USES: The following uses shall be permitted as accessory uses to a principal use provided that none shall be a source of income to the owner or user of the principal use: 1. Accessory uses permitted in the CN and CC Commercial Districts. 2. Mechanical equipment no nearer than one hundred twenty (120) feet to any residentially zoned district. 3. Screened garbage storage, on a concrete pad no nearer than fifty (50) feet to any residentially zoned district. 4. Off-street parking, provided that all areas devoted to the parking of vehicles or the sale and display of merchandise, except nurseries, shall be surfaced in accordance with Section 58 of this Ordinance. 5. Provisions for the parking of automotive vehicles provided within sixty (60) feet of any residentially zoned district shall be separated from said lot by a blind fence or wall at least six (6) feet high. 6. Other structures or uses which are customarily accessory and clearly incidental and subordinate to the permitted use and/or structure. 7. Signs advertising uses located on the premises in accordance with Section 60 of this Ordinance. C. CONDITIONAL USES: The following conditional uses may be permitted provided they meet the provisions of, and a Conditional Use Permit is issued pursuant to, Section 48 of this Ordinance. 1. Commercial off-street parking lots for passenger vehicles less than one ton carrying capacity. 2.
