SUBJECT: CONSIDERATION OF AMENDMENTS TO APPENDIX D ZONING
ORDINANCE, SECTION 13, R-20 SINGLE FAMILY DISTRICT,
SECTION 14, R-12.5 SINGLE FAMILY DISTRICT AND SECTION
26, HC HIGHWAY COMMERCIAL DISTRICT
RECOMMENDATION:
Staff recommends City Council consider amendments to Section 13, R-20 Single
Family District, Section 14, R-12.5 Single Family District and Section 26, HC Highway
Commercial District.
BACKGROUND INFORMATION:
SECTION 13, R-20 AND SECTION 14, R-12.5 SINGLE FAMILY DISTRICTS
Attached are proposed amendments to the R-12.5 and R-20 Single Family Districts
creating a new Section D.4. Prior to the rezoning in 1984 all single family development
in Grapevine was zoned R-1 Single Family District with the design criteria being consistent
with the R-7.5 Single Family District adopted in the Appendix D Zoning Ordinance. In the
1984 rezoning, several existing developments were zoned R-20 and R-12.5 Single Family
Districts assuming that they met the requirements of those districts. In a recent review of
a building permit in an R-12.5 Single Family District, Staff noted many inconsistencies in
the way the property was actually developed as compared to the current zoning of R-12.5
and R-20 Single Family Districts. Most of these developments do not meet the front or
side yard setback requirements, and many lots do not meet the minimum square footage
requirement of the R-12.5 and R-20 Single Family Districts. The proposed new section
D.4. would allow subdivisions approved prior to December 4, 1984 to continue as they
were originally developed and it would allow Staff to issue permits on properties with yard
requirements consistent to when the subdivisions were approved. The amendment would
not allow subdivision of lots smaller than presently required in the R-12.5 and R-20 Single
Family Districts.
SECTION 26, HC HIGHWAY COMMERCIAL DISTRICT
Also, attached are proposed amendments to Section 26, Highway Commercial District. On
October 14, 1997 11:24am
July 15, 1997, the Planning and Zoning Commission and the City Council held a public
hearing to consider amendments to Section 26, Highway Commercial District. The
amendments were requested by Marvin Balvin concerning uses on his property located on
Central Avenue. The amendments to Section 26, HC Highway Commercial District were
not approved by Council on that public hearing date. The amendments considered on July
15, 1997 would have greatly changed the Highway Commercial District allowing many
intensive commercial uses that could have ultimately had access on Wall Street and other
streets having Highway Commercial zoning. Since that time, Staff was asked to draft
amendments to the Highway Commercial District which would not impact the entire
Northwest Highway area as dramatically as the previously proposed amendment. The
attached amendment would allow only Central Avenue to have uses allowed along
Northwest Highway. Staff feels that if this amendment is adopted, it would be helpful in
resolving all the nonconforming uses along Central Avenue which was platted on
December 18, 1984 as Central Business Park having nine lots. All nine lots, except for
Whataburger, now have nonconforming uses due to changes that have been made to the
Highway Commercial District after the property was developed. The nonconforming uses
were legal permitted uses at the time they were developed, after the city wide rezoning in
1984. Seven of the lots have automotive related uses, and one is developed as Dennis
Electric Co., electrical contracting business. Under the present zoning regulations of the
Highway Commercial District, none of the nonconforming uses along Central Avenue can
become conforming. With the proposed amendment to the Highway Commercial District,
the same uses allowed along Northwest Highway would be permitted along Central
Avenue. The existing nonconforming uses could then be permitted with a conditional use
permit if granted by Council.

2. Non profit community centers and swimming pools and tennis courts.
3. Public and private country clubs and golf courses excluding miniature
golf courses.
4. Memorial gardens and cemeteries.
5. Any off-street parking for churches, convents and other places of
worship developed on property other than the platted lot of record of
the principal use, provided all or a portion of the property utilized for
parking is located within 300 feet of the platted lot of record.
D. LIMITATION OF USES:
1. No more than three (3) persons unrelated by blood or marriage may
occupy residences with an R-20 Single-family district.
2. Storage of mechanical or farm equipment incidental to any permitted
or conditional use shall be screened in accordance with the provisions
of Section 50, Alternate B or E, from any adjacent residential
development or use.
3. Private or public alleys shall not be located in the 25 -foot required rear
yard.
4. Subdivisions approved prior to December 4. 1984 shall be
deemed to be lawful. These subdivisions shall have the same
status as subdivisions authorized pursuant to this ordinance.
Buildings, or structures, within those subdivisions may meet the
requirements of Section 15.F.. 15.G., and 15.1. of this ordinance,
except no lot existing at the time of passage of this ordinance
shall be reduced in area below twenty thousand (20,000) square
feet.
E. PLAN REQUIREMENTS: No application for a building permit for the
construction of a principal building shall be approved unless a plat, meeting
all requirements of the City of Grapevine, has been approved by the City
Council and recorded in the official records of Tarrant County.
F. DENSITY REQUIREMENTS: The following density requirements shall

F. DENSITY REQUIREMENTS: The following density requirements shall
apply:
1. Maximum Density: The maximum density within the R-12.5 District
shall not exceed three (3) dwelling units per acre of gross area.
2. Lot Size: Lots for any permitted use shall have a minimum area of
twelve thousand five hundred (12,500) square feet.
3. Minimum Open Space: All areas not devoted to buildings, structures

13. Planned Commercial Centers.
HIGHWAY COMMERCIAL DISTRICT
14. Automotive repair garages, within a completely enclosed building. Salvage
and/or wrecking yards are prohibited. All storage areas must be surfaced
and screening shall be provided in accordance with Section 58 and Section
50.
15. Automotive sales, and service, new or used cars and trucks. All vehicles
must be in an operating condition and all open display or storage areas must
be surfaced and developed in accordance with all applicable Ordinances of
the City.
16. Automotive rental.
17. Outside display boat and marine sales and/or service.
18. Outside display camper sales and camper trailer sales and service, lease
and rental.
19. Pawn Shops.
D. LIMITATION OF USES:
1. Residential structures and uses are expressly prohibited in the HC Highway
Commercial District. Existing residences may remain as non -conforming
uses, but it is intended that new residential construction not be allowed in the
District.
2. (a) All property zoned HC, Highway Commercial, shall have driveway
access and frontage in accordance with Section 26, paragraph G.2.
only from a State Highway or Central Avenue except as provided in
Section D.3.
(b) Additional driveway access on a corner lot from other than a State
Highway for the intersecting street only, may be approved by the
Planning and Zoning Commission and City Council with the filing of
a Concept Plan in accordance with Section 45. For purposes of this
Section 26.D, corner lot shall mean a lot located at the juncture of a
State Highway and a street which intersects such State Highway.
3. Access to and frontage on a street other than a State Highway or Central

Avenue will be permitted only for property zoned HC, Highway Commercial
prior to the 15th day of July 1986, provided the principal uses and conditional
uses are limited to the following uses:
(a) Principal Uses:
1. Plumbing supply with a completely enclosed building.
2. Public utilities as required to serve the district.
3. Automobile washing business; automatic, coin-operated or
moving line wash.
4. Restaurants, including drive-in and drive-through restaurants.
5. Feed and grain sales within a completely enclosed building.
6. Furniture or appliances, new and used within a completely
enclosed building.
7. Mortuary and funeral homes.
8. Nursery or greenhouses.
9. Job printing or newspaper establishments.
10. Upholstery shops.
11. Retail sales, other than those listed above, business services
and merchandise displayed within a completely enclosed
building.
(b) Conditional Use
1. Commercial off-street parking lots for passenger vehicles less
than one ton carrying capacity.
2. Alcoholic beverage sales provided a Special Permit is issued
in accordance with Section 42.13. of this Ordinance.

AMENDMENTS TO COMPREHENSIVE ZONING ORDINANCE 82-73
The City of Grapevine's City Council and Planning and Zoning Commission do hereby
notify each of you that a Joint Public Hearing will be conducted by both the Commission
and the City Council to consider amendments and changes to the City of Grapevine's

Comprehensive Zoning Ordinance, No. 82-73, as amended, same being Appendix D of
the Code of Ordinances of the City of Grapevine, pursuant to and in accordance with the
City of Grapevine's Comprehensive Zoning Ordinance, No. 82-73, as amended and Texas
Local Government Code, Title 7, Chapter 211. All interested parties will be given an
opportunity to appear and be heard and express their views. The City Council and the
Commission will consider amendments and changes to the Comprehensive Zoning
Ordinance, No. 82-73, same being Appendix D of the Code of Ordinances, specifically
amending Section 26, Highway Commercial District relative to Central Avenue, Section 13,
R-20, Single Family District and Section 14, R-12.5, Single Family District, relative to
developments approved prior to the city wide rezoning, and any other additions, deletions
or changes to various section, articles and provisions contained in said Ordinance No. 82-
73.
After all parties have been given an opportunity to speak, the public hearing will be closed
and the Commission and the City Council will deliberate the pending matters. Please
